Duane Romanello, who is now listed as the agent for H&P, is also (according to the state of Florida) the registered agent for a ton of other companies, including several other debt collectors and finance companies. He IS an attorney in Florida...but he is not listed as an officer, just the agent for process. This is normal for a corporate filing, actually.

As you see above, there was a dissolution that was pending in September, but it was dismissed. The original agent's name was Gary Henrion who is NOT an attorney in Florida but is now listed as the Vice President of the Company. Neither he, nor Noel Pooler nor Tammy (Mackey) Williams are attorneys in Florida.  Again, all of this is easily verified through the State of Florida's website and the State Bar.

These people also were connected with Legal Mediation Practice, which was a debt consolidation firm that is no longer is business. The addresses were the same a year ago.

H & P, obviously, stands for Henrion and Pooler... and by the dates, you can see that H & P came about not longer after the other company closed around  October 2008. It appears the they went from debt consolidation to focusing on collection of payday loans.


Gary Henrion is a Business Broker or Real Estate developer of some kind.

Tammy Mackey/Tammy Williams is listed as the Treasurer for both H & P as well as Legal Mediation.

Duane Romanello was the registered agent for Legal Mediation, but not for H&P initially. Mr. Romanello specializes in bankruptcy, real estate and collections.

You are laughable. You need to evolve some to be a good collector these days you need to "work with" them and not try these Gestapo tactics. This post is by a collector who thinks by showing he/she went through this (which is entirely fictitious) they will make more people pay. Such a waste of my air. They are not changing their names, they are executing a industry standard "Double Up" which is where they pass the call off to a supervisor and have them firm up demands of the client, There is no trickery here, it is a new voice to make things sound more official.

Be mindful here folks, when you applied for these payday laons you filled out a references list which often includes those closest to you. Make sure you understand that your not paying this debt has brought this attention to your door and nothing else. The inclusion of people calling your parents and then saying they have nothing to do with the payday loan is false and a lie, YOU included them by adding their phone numbers to your contact list. That is part of the business model. Also many of the people you use in this capacity are generally prying and all about knowing about your "juicy" business and will trying to get it out of the collector. If they disclose what this is about in ANY way, that is a 3rd
party disclosure and a violation of your basic rights as a consumer under the FDCPA. The most I have ever said to a 3rd party is "This is in regard to a serious Personal Matter and I cannot disclose further without violating federal law" if the 3rd party continues any questioning I ask them "Are you asking me to violate Federal Laws?" if they continue after that, I hang up. Simple. That is a moral way of doing it in compliance with FDCPA.

Advise here, the company is legitimate. I used to work for them. Yes, they seem to use a heavier hand
but it is designed for one purpose, to get you to call them back. "Actions" referred to are as follows.
1. FCA or Further Collections Actions. Usually in the form of calls once a day and letters generated to
your address. Often times though the addresses are not good that they have due to alot of the consumers tend to move often to avoid being found and held accountable for these loans.

2. Some of their clients do, in fact, sue their former clients// consumer// debtor because they are unable
to locate (usually your balance determines if this is viable) mostly in the form of Judgements or wage
garnishments.

The lawyers here are right though, you should know your rights. I quit the company due to it's somewhat amoral practices. I would say it is better to just call them attain your account # and balance and name of the creditor and the address of the agency, then mail in your payments. If you are bold enough on the phone negotiate a sif or Settlement in Full, to alieviate yourself of some of the debt
do so only if they provide a reciept via fax releasing you of all liability and obligation. The only reason you would do any of what I just typed here is to get it over with and done. It is not cost efficient to change your phone number and move away to avoid the hassle, grab this particular bull by the horns, and watch as talk of $$ will slow their roll and pacify even this dumb beast.

These people use false names all the time (which is also illegaL) when they call.....they are just a bunch of Phone COllection Thugs who are trained to harrass and instill fear in people to pay up which is illegal also.  If florida, this is strictly a civil matter and arrests are not made for "Debts".

Some lady from H&P capital called my ex and hung up. My ex called the number back, the same woman answered the phone and hung up again. Then she called back to tell my ex and I quote "you don't know me but if you go to this girls Facebook page you will see what your boyfriend does behind your back"! Not only was the call harassing to my 8 month pregnant ex but it had absolutely nothing to do with debt collecting at all... Needless to say we are heading up there tomorrow and I am seriously considering hiring an attorney to fix this issue. It's a business, when you're there conduct business and leave peoples person lives alone

I got a call from this number talking about a filing that they have in their office and they want me to call them by 5 for a voluntary disposal of the filing.  I think they are some payday loan collection agency but they are wasting their time if they wanna call me with a bogus number and think i'm gonna return their call.

I did return your call, only your employee acted like a child with his little "whining" and "threats" so he transferred me to his "executive" boss. (they sounded alike to me) anyway...I was willing to make a payment arrangement however, you wanted me to use a credit card to pay this payday loan off NOW! I laughed & explain to you that I've watched tv & heard all about collection companies such as yours. As I tried to explain to you that I would be more than happy to send a money order for the full balance. You said that wasn't acceptable. We went toe-to-toe for a little while on the phone & I guess you didn't like what I had to say. Hanging up on me...REALLY??!!!! I mean, how do you expect to collect any money from me? Our conversation was recorded as well & I'm sure either you will hear from my attorney, or I will hear from you soon.

Been getting calls from 904-418-5000 telling me they want a statement from me and that legal action is being taken.  I know its a debt collector, lies as usual. If they take a check for a payday loan and i never paid the full ammount is that a crime?  The original company said that they will report it as a HOT CHECK?  doubt it but wonder if its true?    I live in tx and like most states DEBT is a civil matter not criminal.

The person stated that I have 24 hrs to contact them, that a decision had already been made regarding the matter, they just need for me to confirm. I have no idea what this is about. They also called my granddaughter which has a cell phone under my name. He told me to call back #877-442-1601 X128.

You sound like someone that works for, what I believe to be a Mofia type company, H&P Capital. This company called me and put my wife in fear that someone would come and kick down the door! This is, in my opinon, nothing more than an illegal company that thinks it can bully and badger people into something. No where are you required to pay 3 times the amount you would owe, so right there you are a liar. You can tell you buddies at C&P that I will personally expose their Mofia tactics on the internet and advise anyone and everyone to not do business with anyone that does business with C&P. Anyone that makes such threatening phone calls that it puts people in fear of their life and well being should be in jail, and I hope I can find a law that will put you and your friends in the deepest darkest jail avalible.

ughh i got a call from some DO***E BAGS from "H&P inc" 904-418-5000 ext. 109 and the guy where so0o0o rude!!! A "Nathan Davenport" called me around 6:30pm out of no where telling me i had a complaint against me b/c when i was 18 (now 23) i took out a advanced payday loan for 600 bucks. and that i had 4 hours to pay back 605 dollars or if not that i had to pay it by 10am next day that if not he was going to send my info so it could be processed so they can start doing legal papers to take me to court and blah blah blah! so i called a few pple and couldnt come up with the money so i called him back to tell him ya kno i really dont know what to do i dont have 600 just to pay right now give me atleast a week or so and i will pay it. he tells me NO! and hangs up on me!!! i mean how UNprofessional can you be!!! i called him back and asked him..did u really just hang up up me? and he replied "oh yeah, i thought our conversation was over, you said you couldn't pay it so i just stamped it so it can start being processed" i was like omg are you serious and outta no where that son of a B says "ok you have until 12 noon tomorrow to come up with the money if not im sending the papers" it makes no0o0o sense he told me 10am was my deadline now outta nowhere its 12pm when he said he couldnt do anything else when it was for 10am!! ughhh idk what to do?! are these guys for real? or should i worry?and i wonder how they got my telephone number!?in the past 5 years i've had like 50 new numbers i wonder how they found my recent one after 5 years!

i wonder if these guys ever had anyone drop in on them to say hello. i will be passing by on my vacation during spring break. perhaps i can help them understand that they cannot collect in any way in the state of texas. only the attourney general can garnish wages for child support. and only thr irs can put a lein on any property that i own. any judgements are un-enforcible in the state or texas. texas is the best state to live in, as it is a debtors state. all they can do ask for their money back nicely, but it isn't theirs anyway. these guys buy up old uncollected lists of people who never paid, and was charged off by the lender as a loss. they get these lists for pennies on the dollar. some stool pigeon always ends up paying somehow because they get scared. if they are representing themselves as attorneys, or say they are about to sue, just ask them for their bar association #, so your counter suit can be accurately filled out. donavin warrens house looks like a dump. my sister drove by it last week. she lives in st augustine. maybe i can visit all of his neighbors or call them and tell them what a loser they have for a neighbor. connelly is doing well. his home is tucked back off the cul-de-sac. must be alot of idiots paying these guys.

The caller called me and said I needed to call them and give a statement before the file a claim against me in the county where I live. They said they were HPC, but on my caller ID it said H&P Capital Inc. I don't know who these people are but I'm not giving them my information.

These calls are scams. They are trying to get your personal info and your money. Don't give them your social security number to "find your file". If this was a real collection agency they wouldn't hang up on you when you don't give them the info they want.

I sent these people nearly half of what they sad I owed about a past debt and unpaid loan.  Is this legitimate, did I do the right thing by trying to pay them A.S.A.P.  I've already contacted my lawyer for futher assistance from a legal standing.  I just need to know did I just lose $235.00 that I could have paid other bills with.  I needed that money, and still do, but I was made to feel my freedom was immediately at state so I of coarse did what I could.

Debtors don't go to jail for debt but collectors who use illegal tactics to harass them certainly can and even sometimes do.  The ignorance you demonstrate in this little lecture confirms your situation in life and work, and it's always so amusing to see when collectors have to come on the COMPLAINT board to lecture the "downtrodden" in the hopes of making their weekly quotas.  Your break is over, it's back to the boiler room with you now.
