The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I called this number for a friend because she received threats from it.  When I started asking questions the lady hung up. She said her name was Shannon Dixon... Funny how the name of the company changes with who answers the phone.  They say they are a legal processing firm    LIE      then they told my friend she was going to be arrested.  Knowing some about the court system  and how that works I started asking more questions.   again was hung up on.  I was threatened that if I called again they were going to turn my phone off...hahahahaha...if these people had half the power they think they have they would be dangerous.   Basically it is a high pressure debt collection agency trying to use threatening tactics to get people to pay their bill.  Well Goof ball  if they had the money I'm sure they would.

Thomas Curran with Smith, Dean & Associates called my brother and told him he was leaving for court in 40 minutes and I needed to have this $1125 debt paid by wiring him the $$ BEFORE he goes to court.  Said I was the only one in 57 people he bothered to call to give a chance to pay their debt before he issues 2 felony warrants.  I called the Federal Trade Commission as well as the Attorney General's office and filed complaints to go with the 1200+ that have already been filed.  Both the FTC and the Atty General's office told me you can't file a felony warrant for consumer debt.  They warned me not to send them any $$ - they move offices and change telephone #'s  every other month so they don't get caught!!!!  Do not send then any $$!!!!!!!!!!!!!!

The internet is a very influential and effective part of any business in today's fast paced, global economy. A major problem that comes from this is that anyone can post anything they want to about a company without any truth or consequence on the many internet outlets. Many times, after a professional and ethical company is smeared through anonymous ratings, it is the company's good reputation that is in the end, unfairly tarnished.

We would like to set the record straight and state the facts for all to understand once and for all.

Before any one of our clients place an account with us, or any other collection agency, they attempt to collect the debt themselves for 30-90 days before placing the DELINQUENT debtor to us. After our client (the lender) realizes the debtor (the borrower) is not going to pay them, they then forward the now very past due balance to us (the collector).

The ridiculous nature of the statements made by the complainants (the debtor) is that not a single one of these people ranting about us and other collection agencies will take one ounce of responsibility for the fact that they borrowed $ MONEY $ from some business and DID NOT PAY IT BACK!! In many instances, these individuals broke laws by writing worthless checks.

They also fail to mention that every one of them could have worked out an affordable payment plan with our client (the lender) during the 30-90 days before we received the account. After breaking every payment arrangement or flat out just not paying the debt, they decide to go to the internet and post anonymous comments making them out to be the VICTIM!

We maintain that we follow the letter and the spirit of the law in every instance in attempting to collect a debt. Furthermore we are always in complete compliance with the Fair Debt Collection Practices Act (FDCPA).

All we can say is that in a perfect world, if the borrower (now debtor), would have paid back the monies they borrowed in the first place, there would be no reason for us to be contacting them at all.

So potential clients, please keep in mind, the people who are on the internet complaining about collection agencies are the very people who have taken your money and refuse to pay you back. YOU ARE THE VICTIM. Not them...........

I have just had the opportunity to work with this agency and I cannot say enough "GOOD" things about them.

I had a family member become jobless and near homeless.  If there was any kind of luck in this person's life, it was bad.  This was a person who had been a responsible member of society for more than 20 years -- and now they were down on their luck like so many other Americans.  People that have worked all of their lives are now near financial ruin with little to no self worth.

I was contacted by this group because my name had been used as a reference.  The unfortunate part was that I did not receive the message in time and the legal process was already in motion.

However, I called and spoke with 3 members of this team -- and each of them gave me an opportunity to try to clear up this problem for my sibling.  When I explained what was happening in this person's life, not only did they take the effort to understand, but gave me a chance to make things right.  

I promised that I would get the money owed via an Express Moneygram.  Before I had processed the check, the person I spoke to was making "another" trip to the court house to stop the legal proceedings.  He did this on my word because I was up front and honest.

These people have a job to do because people that "don't" pay their bills and avoid their responsibilities have to be held accountable.  I realize that there are collectors that are not as kind and understanding, but this group "trusted" me because I told the truth.  And if people would not avoid their responsibilities, stand up and ask for help, and ALWAYS tell the truth -- people like these outstanding and caring people will do all that they can to help.

I am forever thankful that they listen and stood by me when all my sibling needed was just a small break.  And because of their assistance, each day is getting better and each challenge is becoming more manageable.

Someone named lisa s. called saying they're investigating a relative & left this phone#. There's no reason for this relative to be investigated. I think it's a scam.

I received a message to call this phone number back and talk to a A. Freeman in the "fraud unit", he told me about a check that I had written in 2007 and said if I did not pay them today they would file a case in court for 2 counts of fraud and attatch $1200 on top of it.  I told him that I had tried to make payments on this through the company I owed and thier collection agency and was told "No" both times and that "it had to be all or nothing".  I told him I couldn't pay that today but I could pay it next week. He told me "No" that it had to be all in full today or they would be going to court today to sign the papers and have me charged with 2 felonies & I would not be able to work in my state again due to my profession. He advised me to call all my friends, family, co-workers and employer to get the money by today.  Luckily I have some really smart friends and a family member who reads the newspaper cover to cover as they told me that they couldn't do this and to call the sheriff's department.  Well I called the county attorney who had a talk with them and they told me that what they are doing is ILLEGAL. I guess Mr. Freeman works in the right department. They write above about "if the borrower (now debtor), would have paid back the monies they borrowed in the first place, there would be no reason for us to be contacting them at all.", that is true but what about those of us who had a run of bad luck and ar trying now to make things right? If they are a collection company why won't they try to work with you to make it right? Why are they so quick at saying no?  I want to pay this debt. I always wanted to pay this debt. I will pay this debt off but now it will be what I can afford a month and not "in full now". I hope that none of these rightous collectors never run into difficult times in thier lives and can't pay thier bills, but then again maybe I do hope they can't and they get phone calls from companies like the one they work for.

i got a call from "ANGIE SMITH" today.  she told me that i had an outstanding debt with blue rhino(havent bought anything from them).   she told me that i had to pay this or there would be a cop knocking on my door.   she said i had 2 hours until they would be here.  i was frantic, thinking i had 3 felony warrants.  this company needs to quit harrassing and threatening with jail time.  

this is the second time they have done this to me.  the first time i actually paid it fearing i would go to jail, but not this time.  

every post they(smith, dean & assoc) write, says the same s***.  do they not know that cops are watching every move and collecting all this info for charges.

In Responce to your post.I just recieved a voicemail from a David Acosta asking for a family friend ,(this is the second call from you folks and the first one you were told that you have a wrong number but i would gladly pass the message along) .So on my voicemail David stated that if my friend did not call you back within 24 hours you would be filing charges against her and went on to state more details about the debt and again saying that you would be filing charges and she would be arrested .Now you say in your post that you are in complaince with FDCPA laws.Really ? I am also a collector and very aware of the FDCPA laws so Mr David Acosta made quite the error when leaving that voicemail on my voicemail .It will be reported ,As i have saved the mesg .I dont know if this person still owes the debt or anything about her situation ..But what i do know is that i have told this company that they are calling a wrong number for her and my voicemail ID'S my name not hers .So to leave that much of a detailed mesg on my voicemail is in violation of the Fair Debt Collection Practices Act .I will also be notifying the person that the call was for and also give her the number of Attorney Joanne Faulkner and also reporting this to the FTC and Attorney General?s office . So maybe you should let your fellow coworkers,employees whom ever you are to this company  let them know to be cautious of what they are leaving on peoples voicemails incase you get a collector like myself on the other end of the call.

My b/f received a phone call from 904-721-3705 going by the name of Travis dean. He had threatened my b/f that if the balance wasn't paid in 2 hours, that Travis himself would be heading up to the courthouse and filing a warrant out for his arrest. Mind you that Travis dean did not give any info as to what balance he was referring to or anything. My b/f than came to conclusion and made some phone calls to confirmed himself what the situation was about. He than called Travis dean back and of course the rude and illegal man he was (travis) didnt give my b/f the time or day to resolve the matter and hung up. My b/f than playing "ring around the Rosie" with all these people and was able to come to an agreement. Later that night we did some research because thinking back to all that had happened today seemed fishy we came upon this page with numerous threads of similar issues. We are in a debate of persuing this matter. My question is, why is he "dean & associates" still in business calling and threatening people if we all have been victimized, harassed, threatened, and violated? Shouldn't this be enough evidence to put them to a stop? He is using illegal tariff and is NOT from a law firm. He is a debt collector from an agency and his company needs to come to an end!!!!

by law I should not say or do. I make threats and I even lie and say that I'm law inforcment or
the States Attorneys office for that county the debtor lives in and tell them they are on a docet for a court date , Yes Im Angie Smith and I do all these things and get paid under the table for it and nothing you debtors can do about it cause im the person they call when you dont pay your debts..
I will call you your family and friends and belittle you in ways you can't even think of and get away with it cause I can and nobody can stop me or Smith Dean & Associates from doing what we are best at and that is making threats to you DEBTORS that want pay the debt owed so again they call me ....you can to at 1-904-721-3705,1-904-3711and 1-904-855-8026or at
1-904-8028. Why so many numbers you ask? well when the law ketches up with us we must change are names and are numbers so that we dont get caught for all the unlawfull thing we say and do to the DEBTORS.
So to all the ones we will be calling are numbers and so called company name may change in the future. And just to remind you what we say is a lie and no you cant be arrested and no you want have a warrent out for your arrest,  we will lie ad breake the law to make you mad enough to pay your DEBT, and if you dont answer we will be calling those you do and dont even know to lie about you cause thats what we do best!!!!!!!

I never finished school and so I am good at being a so called Debt Collector and my house is now being foreclossed on cause people like you want pay your debts so I vcan pay my bills. They just repoed my car cause again you dont pay your debts. Another reminder that anyone like me can post what they want to about them a company without any truth or consequences on many internet outlets and nothing can be done about it.
But if, as we do call and provide a false statement and use being law inforcement as we do,call those that you dont even have on your refrence info given as we do alot of then thats against the law and we break it all the time.
It is the company's name as we have made a bad one, but never mind if you dont like us because it is are reputation that is in the end tarnished and my house that is being foreclossed on becuase the bank dont understad that I cant pay my debt unless you pay yours,
So please when I call and make my threates and tell you your going to jail its not true, just ask the loan offericer at my bank because I even threatend her and told her I would put her injail for taking my house that I am now 3 months behind on, like you DEBTORS she to dont like me.  So even though it is to late for me , and yes I am pissed off ,so I will take it out on all you so called DEBTORS, and I will be contacting you are againe fill free to call me.....

Well then I consider this call to be fraud.  A Thomas Curr called from this number;  Booth R 904-855-8028 he stated that they were looking for someone who's name I did not know at all.  He said that they didn't want to have to "send people out there"  yikes what is this a mob thing?   He left his number of 904-721-3705 extension 209 and said this was regarding fraud.   From what I read above this is all about trying to collect a bill from someone I don't know.  The tactics are very mob and scary.   They probably picked the wrong person to call considering my husbands job and all ;)

Fine, you owe money.  They still cannot treat you this way!  File charges, quick and often!

While they are allowed to use pseudo names, their real names must be filed with the State and cross-referenced to their pseudo names so that you can file charges against them.

Everyone, stop taking crap from these people, file civil and CRIMINAL charges with the authorities.  That is what will stop them.
