No, simply calling PoE is not illegal unless barred by state law or doing so is already known to be "inconvenient". As usual it's the thug's conduct during that call which created FDCPA violations. Mainly it was the same old PDL collector song about shame and disgrace and pretending that loan delinquency can be a criminal act.

The excuse of "I'm not a debt collector, I'm a (blank)" is another common ruse of the desperate hustler. The whole point of the call was to coerce you to pay off some imaginary debt. That is enough to meet the FTC definition of "debt collector" and therefore make Ms. "Investigator" subject to the FDCPA, despite her effort to fog the issue.

I would hope that by now both you and your superiors realize the sham for what it is, and that you are not punished for hostile phone calls which, assuming foreign fakers place them, you cannot control. You are dealing with creepy lawbreakers; you have done nothing wrong. Thugs like these absolutely love calling people at workplaces to create false shame and urgency, not to mention confuse everyone with their lopsided version of American legal process.

A responsible employer will help you document the offenses for the authorities and/or your own lawsuit, should by chance you learn that your tormentors have a U.S. address.

If you would learn your rights you will never again be fooled by the lies told by such extortionists.

- A payday loan is *a loan* and not a "hot check", and therefore cannot give rise to "check fraud".
- Consumer debt is a civil matter in America and not criminal. Police and prisons are not in the business of debt collection.
- Anyone who contradicts the above while supposedly collecting debt is violating state and federal laws.

Even if we take away the above factors, very common in South Asian style fake collection, "Sharon" still fails the laugh test. The moment it's known that an attorney has stepped in, a legally compliant debt collector cannot contact the alleged debtor again. Certainly that news must not inspire yet more threats against a person. But again, we aren't discussing debt collectors but hustlers using debt as a convenient narrative.

Oh my!!! Sharon Daniels called me too. She stated that I had committed check fraud and that I would be arrested the next day at my place of business. I am a nurse and I have NEVER been arrested before in my life. I called my bankruptcy attorney and gave her the number. My attorney office called she was rude and kept hanging up in her face. She called me back at my job and said since I had my attorneys office call that she wasn't going to work with me and that I would be served at work. My attorney giggled her company and so did I. She really had me going for a second. Thank God for blogs, she needs to be stopped seriously!

My supervisor called me into her office this morning,she had investigator Debra Thorton on the line,
This woman told my supervisor when would be a good time to arrange my arrest at work?!! I got on the phone and I asked some questions, she did verify my correct social, which is scary. I was told by her,was going to be arrested for check fraud for some payday loan company. She said I was going to br arrested at my place of employment or I could turn myself in. When I told her, I would turn myself in she said, "for what?!"Reading all this posts makes me feel better, I know I have not wrote any checks but I did take out a payday loan a few yrs back, which  I payed back! This is horrible nd she did have me shaking in my boss office.

NEVER pay anyone unless they have MAILED (not emailed or faxed) a debt validation letter to you.  This is your right under the FDCPA.  If a debt collector or "investigator" tells you they refuse to send you this legally mandated documentation, they are attempting to scam you.  No proof that you owe the debt = you owe them nothing.

No one calls you ahead of time to state you'll be arrested or served papers.  That is a violation of the FDCPA.  Debt is also a civil matter, not criminal, so no, you cannot be arrested for not paying back a loan.    It's not check fraud if you didn't pay a loan back.  You only commit check fraud if you're going around writing actual checks from accounts you know don't have any money in them.  

Your wages cannot be garnished without you receiving a court summons and even then, you'd have the chance to present your side in court.  Again - scammers tell people things like this to scare them into paying money on debts they don't owe or have already paid off.  When she calls back, let her know you've reported her call to the FTC, the FBI and your state's Attorney General - and DO report the calls.  Also tell her that you're recording all calls she makes to you per your attorney's advice (even if you don't have one) for your own lawsuit against her company for multiple violations of the FDCPA.

A lady who identified herself as Invetigator Sharon Daniels called me at work yesterday asking to speak with me or my supervisor. She kept enforcing Investigator, when i asked her to repeat her name. She said that i had committed check fraud for an old payday loan and that my wages would be garnished and also i would be arrested at my job on friday. She sounded like a black lady, very rude also. She kept saying that she was not a debt collector but was an investigator for the law firm for Robert Williams. I asked her where she was located and she said NewYork and gave me a 1-877-931-2352 telephone number. She had personal information about me and said that i was guilty of taking out a loan and never paying it back. Mind you, i am at work and i see clients, she held up a lot of my time with these lies. I was worked up at first because i kinda believed her. But the more i spoke with her, i began to feel that she was just another debt collector posing as a law firm. Here in Texas, they dont give you a warning that you are about to have a warrant, they just file one! I hope they catch this Sharon Lady because she is committing an illegal act by calling someones employment.

She drives a brown Tahoe and recently paid for a new black range rover with silver on dide. Also she recently move from.  449 Hambersham Sqare, Jonesboro Ga 30236. I was told that her boss gave her the dis witch have everyone personal information on it. Shes married to some trucker nam calvin matthews he works for a company by the name of pro drivers out of Atlanta Ga. U also can take the information or contact clayton county detector to take out a warrant they can track her down by ising her jail record she was arrested in on step. 13 2012.  Or Sep 12. Just got a call from Sharon Jackson and she got me for $600.00 on my credit card.  I am in the process now of trying to get it back.  She scared me to death telling me that I was on a pick-up list from the sheriff's department.  I was so freaked out that I wasn't thinking clearly and fell right for it!  SHe better be glad that she doesn't live in my town or she would be needing a ride in an ambulance!

I had a lady call from 904 762-6473 and said she was trying to collect on a payday loan, that i owed and didn't pay. i told her yea i knew about the loan in 08 and was trying to pay it. she said i owed 240.00 plus fees totaling 640.00 so i paid her with my mast card come to find out it was a scam and i had to file a police report. Dont fall for this sharon jackson lady>

I just recieved a phone call from, "investagator Sharon Jackson" also.  She was telling me that she was going to have the police come and arrest me at work and that she was going to be filing the warrant in Sarpy county.  Funny thing is that I dont live anywhere around Sarpy county.  Also asked her to fax the so called loan information and she said she does not do faxes!  Be careful everyone.  I have reported to the nessacary agencies!

Regarding a court case i have no idea about so i looked up my court access record for my state and there is no case pending. This lady had my social security # and everything. How is a person from Florida going to have me arrested in Wisconsin?

This is the new number "Investigator Sharon Jackson"  is calling from.  Just thought I would let everyone know.  Funny how a court person is calling and answering on their cell phone.  Way after hours, I might add. She got all flustered when I repeatedly called her back to harass her.  Funny!
