This is a legitimate call from Debski & Associates, P.A....they used to be Rubin & Debski...they play hardball...I am paying them because they had me served with legal papers from the  Lee County Florida courthouse and were threatening to take me to court to sue me. They don't take no for an answer...so now I am on a monthly financial plan till who knows when...if I hadn't complied the would have taken me to court before a judge and from the documents the court sent...they weren't playing games

This is interesting. By what you say, they can attempt to collect at least for so long as someone is alive to target for the payment, but without the ability to gain judgement, there is no teeth behind their claim after seven years.

So really, if this is all correct, the only folks who would wind up paying a dime after seven year statute of limitations, are the dumbasses who get duped into it somehow.

Yes, old debt collectors. Interesting that they'd be calling on a credit card debt that the bank sent me a 1099 on! Scumbags!

Not true once they have a judgment against you they can garnish up to 25% of your wages, put a lien on your home or prevent you from being able to take out a home loan. In florida this stays on your credit for 20 years and only falls off if the collector does not renew it

As you've done, Statutes of Limitations are frequently confused with the seven year FCRA time limit for reporting of accounts to the credit bureaus, which has *NO* bearing on the ability to collect any debt. Under federal law, debt collectors can chase an account through the end of human time. They just can't get a judge to help them once SoL expires. Curiously, not one state has a seven year SoL on any form of debt, putting the lie to any confusion of SoL with bureau reporting.

Age does tend to erode the proof needed to validate a debt claim, moreso as a debt account is resold and tossed around like a beanbag. Aged debt claims should always be disputed, given the likelihood of wrong details and illegal collection tactics.

The statute of limitations is different in differing states, but for the most part it is 5 years on a written contract. "No Joke" obviously works for these do***ebags. Everyone telling you to fear these sleazebags are probably employees trying to scare you.

hey "No Joke"....if you paid on an 8 yr old debt then shame on you.  A debt that old can not be enforced for collection.    The statute of limitations is 7 years.....And the person who got you to pay, got a nice big old bonus....

Tag the phone number in your phone, name it "DUCHEBAG COLLECTOR" and then set the ringer to "no ringer"...load your voicemail so you can't get any messages left, set the recording for your phone voicemail announcement as the default or just number so you're not specifically identified (so they don't know they are getting you) and then don't ever answer your phone unless it is a number you recognize or someone you know. Done deal!  Then you don't have to worry about the idiot low life collectors... :)

You're a moron...there's no debtors prison and worse they can do is get a default judgement against you for the debt and wtf cares, in 7 years it's moot anyway.  Credit card companies/banks don't have a leg to stand on with unsecured debt, if you don't pay the worse they can do is harrass you and/or sell your "uncollectable" account (after writing it off as bad debt) to some scum collection agency for pennies that will try for 6 - 12 months to collect on it at which point they either dump it on another collection agency (lower life scumbags) or it just gets forgotten about.  The end result is the same, you don't pay back the debt owed, you get bothered a bit and life goes on, period.
