Someone called me from 909-658-0918 today around 1:00pm CST.  I didn't answer the phone, and then looked the number up online and found this site.  It looks like it was from Wells Fargo.  Therefore, I saved the number in my phone and labeled it as "Wells Gankage" and will not answer any incoming calls from this number again.

These people at American Servicing Company are idiots and rude!!!  If you answer they are rude and if you don't...they don't even leave a message, they just call back 2-3 times a day until you answser. And there is not enough room in this msg area to comment about them giving you the runaround if you want to try to modify your loan. They have you get a bunch of information for your modification and then turn around and deny you.  These loan companies are a bunch of bu***hit and the Government bailed them out to help us???? For what???? I hope this one goes bankrupt!

Just checked with our actual mortgage holder - we're in fine shape,  they still service our mortgage.  The only conclusion I can come to: that we're being phished, and hard.

Received 10+ calls from these guys in the last 2 weeks, up to 2 a day.
We don't have a loan through Wells Fargo, have never once missed a payment, are always on-time, and are paying down our mortgage so that we'll finish our 15 year loan in about 9 years.
I called their 877-222-7875 number, and got the recorded prompt for the "last 4 digits of SSN", and repeatedly said "Agent" into the phone - no luck, no response.

I'm certainly not giving them any personal information.

Hope your lawyer specializes in dealing with mortgage issues. You shouldn't have had to resort to hiring a lawyer. If you go to your local housing authority, there should be a HUD representative there that will help you with ASC. It took us about 18 months and we didn't have to pay any attorney fees. The only thing we did pay were the down payments Wells Fargo wanted to do a forbearance. We did 3 of those and our HUD rep put a stop to that. Wells Fargo modified our first mortgage and because they screwed up by not including the 2nd mortgage in the modification, they had to write the 2nd mortgage off. We went thru our ordeal with ASC simply because my husband was suddenly unable to work and had to wait almost 7 months to get SS Disability and no retro. Hopefully you aren't wasting money paying your lawyer. Our house was right on the verge of being auctioned. We stopped it at the last minuted filing a Chapter 13 Bankruptcy which we did not go through with but it was needed to stop the auction of our house. With the bankruptcy filing and the down payments Wells Fargo required on the forberances we spent close to if not over $10,000.00 all together. We wouldn't have needed the bankruptcy filing had we known how HUD works before we got down to the wire. Good luck to you Hernz. I will keep you in my prayers.

We received 2 calls yesterday from guess who? ASC. The first call they left no message. The 2nd call we answered and talked to the idiots for about 5 minutes. We got a modification on our Mortgage 20 months ago. Haven't been late or missed a payment in all that time. My husband is now working on refinance under the VA. They were calling us to hassle us because they didn't get their payment on the first. Oh tsk, tsk, they are such jerks. I forgot to change the online banking so payment debited on the 2nd instead of the 1st. Pmt is made electronically from my financial institution to them so this was nothing but harrassment...probably manuvers on their end to attempt to block the refi. My husband called the guy over at HUD. He called ASC and ripped them a great big new one! Legally they are not even supposed to call us. They are supposed to call him. They were also put on notice that they dare not show our payment being posted late. If it's paid on the 2nd, you have it and it better be posted to their account. I see I've had a ton of responses to the post I made a while back. Sorry I haven't replied. Yes there is hope. You need to contact the HUD representative at your local housing authority. That is what they are there for. If you can show that with a loan modification that you are able to afford the payments and keep them up on time, they can help you. If you have a loan that is larger than the value because of the housing market, a HUD representative can help you with your mortgage holder to enforce the law and get your loan modified. As I said though, you have to be serious and willing to stick with it. It took as about 18 months to finally get our modification. If they are unable to help you they will direct you to someone who can. Under no circumstances go to anyone that wants money up front. It's a scam and you'll wind up losing your home.

I just got a call from this # (951)658-1420 I think after reading all the responses it was ASC calling about my mortgage. I had a PERFECT payment history with them a year ago. I called to look in to modification because I was concerned with the steady decline of income from my small business. They said they could help before I became in default and enrolled me in the HAMP program and gave me a trial payment that I had to make for 3 months during the trial period. I asked if I would owe the money later that they were not making me pay for those three months and they said no....THEY LIED!!!! Not only are they sending me foreclosure letters and adding late fees, but it has damaged my once perfect credit. I sent paper work over and over and I called repeatedly to check the status, they never did anything with it and later after I threatened to sue sent me a letter saying I was denied. They are now demanding the amount that I had been discounted for those three months plus late fees or they will foreclose. They continue to keep my payments in a suspense account instead of paying the monthly note so it always looks like I am farther behind. I flat told them I am not giving them the $1900.00 and asked them to finance it back in to my loan so I can just pick up where I was before they decided to "HELP" me. They refuse! I don't understand why they wouldnt just lower my interest rate or payment and keep me in the house because I have proven to be a good credit risk. If they sell they will only get half what its worth anyway...proves how backwards they are! I don't know what to do!!!!!!!!!!!!!!!! They SUCK!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!  Don't get involved with them if you arent already it is bad news!!

The phone belongs to ASC or America's Servicing Company a Wells Fargo company.I have been trying for almost a year now to modified my mortgage.Have been denied a few times and they keep trying to put me in a 'different "program to see if I qualified.I have fax the so many papers like pay stubs, hardship letter, expense report and what have you so many times I have a block of papers like two inches thick.when you talk to them on the phone they are always looking for excuses not to help you ans pretty crappy excuses like having to resend all the paperwork because I forgot to date or sign here.I have accepted reality and as much as it pains me I know I am gonna loose my house. We are already in foreclosure for over a year now so I am guessing it should be any day now.I try but I'n just too tired dealing with this people.Good luck to the rest of you and God bless!

Can you send me more info with details on what I need to show that certain laws(which)are broken?
I have been working with another servicing company that ASC now has started doing because of the Wells Fargo/Wachovia thing.
I had finally  gotten really great help with HOMEQ Servicing Company. They have been really great in assisting. Now I am concerned all the work that I have been done will go by the wayside. Sounds like this company is really bad. I have gotten calls (although nothing on paper from them yet) many times this past week. I have not answered because I did not recognize name or number. My answering machine is set to take no messages,   just says I am not available at this time.
I would like more details on what you are doing and what I need to do. There have been some major situations happening that have  tried to bring me down the past couple of yrs. I thought I finally was seeing the light from such a deep hole. I am totally disabled and hubby walked  out when the life got tougher. Now I need to fight a battle to keep my home once more. I am also concerned on how to find an attorney.
Well; if you could let me know what you are doing, more info in your battle.

Thanks
God Bless

If you haven't resolved your problems with the lender, go through HOPE.  After this lender kept saying no, we called HOPE (1-888-995-HOPE) and got a yes from the lender.  HOPE does not charge you anything.  It's best to call them early in the morning and don't be discouraged if you have to keep calling back.

When I called and asked for a modification loan the gal told me to suck and up and give her my credit card number.  The gal was a total bit#h! She talked to me like I was a boy. She said, there are a lot of people in your situation so "just suck it up" and now how do you want to pay me.  I hung up.  I quit paying my mortgage in March and they have called me 2x a week with no message. I figured it was them calling to harrass me.  They'll not get another dime from me. Good luck to you all.

So much for the little guy.  I wasn't surprised when I heard about Wells Fargo giving back a building they bought in San Francisco because it had lost about 200 million in value. They called it a Strategic Business Decision. What's good for the goose is good for me.  My place is underwater 100G. The Bankers win this round and get their bonuses to boot!

I replied to a message in more detail below but wanted to say right on get the government involved.  We must stand up for our rights (and we do have them and they are being violated) because no one will stand up for us.  I am suing my lenders and I know others are too.  Its one way to bring more of their criminal and shady behavior to light

I too have ASC, they have been generous with me on the extensions of the trustee sale but I too ran into the problems your mention (claiming they didn't receive something...) one operator said the application will be rejected on small things too.  I asked well what do I need to include to not be denied for a "small" thing? He said he couldn't say and that he didn't know that someone else makes those decisions.  I asked to speak to the person making the decision on my file.  Of course that wasn't possible.  The even richer detail with these lenders is when asked who owns to loan (who the investor is) the person who already paid a lender for that loan; I am told I can't have that information either.  Well as far as I know the law protects a person's interests when another person or entity tries to make a claim on their property. The lender must PROVE their claim, in this case with the original promissory note I created when I got the house.  Guess what folks - they don't have it because they sold it in pieces a long time ago.  I have filed a lawsuit. I know I am not the only one doing so.  Its about time we take care of our rights and interests, because they aren't going to and popular perception has given them a lot of power that they legally don't have in most cases.  Telling your congressmen is a great idea, tell the FBI too because this is counterfeit securities fraud (selling a note and then asking the originator of the note to still pay on a note they don't have) and file a lawsuit if you are pushed to the wall with foreclosure. There are resources on the net to help. Do your homework and take action folks. Its time to defend our liberties and our property.

I've been dealing with these jerks for 13 months now. They have done everything to me that has been done to all of you in the posts above. In July, they said we "qualified" to apply for the HAMP program (Home Affordable Mortgage Program) sponsored by the government. We made 3 "forbearance" payments while we were being approved which was about $400 less than our regular payment. I called at the end of the 3 months and asked if we had been approved. They said they needed more information and to fax it. Meanwhile, keep on making the payments. I made one more payment and they called and said we were denied for the HAMP program. I asked why and they said that their "investors" were choosing not to participate in that program. I then asked for the denial in writing. They said that they have no form letter or anything stating the reasons for the denial, but that they would put us into another "forbearance" while we applied for their in-house modification. The payment on that was $300 more than the previous payment - which made it only $150+- less than the original payment I couldn't afford in the first place! I got pissed and called my senators office - Max Baucus (D) Montana, who is also the head of the Senate Finance Committee. THey put me in touch with a place in the state capital that is investigating this.

It turns out that ASC/Wells Fargo are not to ask nor receive any more payments until we are officially approved or denied, in writing. We finished with the forbearance payments and now it is up to them to do the work they promised which is to get us into a loan modification that we can afford. In checking into our account with ACS, the company in Helena determined that our HAMP application had not even been processed. They were denying us without even trying! THese people are jerks and the company should be dissolved. The investors and Wells Fargo should also be investigated for fraud - that is exactly what they are doing to people - and they should all be thrown in prison.

The company I work with had their attorney send a cease and desist letter to ASC to halt any foreclosure proceedings. I'll keep you posted as to what happens next. BOTTOM LINE: DO NOT GIVE UP! FIGHT THESE JERKS! It is preposterous that these companies can literally try and pull the rug out from you and take away what we've all worked so hard for. These are lives we're taking about - not just buildings with a value attached. As I understand it, ASC's angle is to harass us until we just give up and hand over the keys. NO WAY WILL I EVER DO THAT! I'm gonna fight these jerks every step of they way.

Like many, I've gotten friendly reminders from ASC. As companies go, they are worse than Countrywide, who was a great servicer, and miles above American Home Mortgage Servicing, Inc. (One of many companies that filed bankruptcy and reopened the next day as a new similarly named company.)

Payments are due on or before the 1st of the month. You may not be charged a late fee until after the 15th, but payments are late after the 1st. ASC, again like Countrywide and unlike AHMSI, allows free payments on their website, directly from your bank account like most credit card companies do.
You also get a confirmation number for your records so no need to mail certified, priority, Fedex, etc.
