I just received a call from the same man I presume with the name of David Do. He is attempting to contact me from the office of The Uinited States Attorney. I have not returned his call, and I beleived it was a scam. He did get a hold of my SS# and repeated it in his message.  I see that there is a way to report these scam artist to the police and I think it would be a very good idea.

I just got the same voice mail on my cell from "Mark Foster" calling from the California State Atty office.  Could barely understand him with such a heavy  Indian accent.  A co worker also gets several calls from a "Ted Lawson" from the same company and the same accent.  They just keep redialing , so I answer and hang up without saying anything.  That seems to put the off for about a day until they start calling again

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

In the past several weeks I have received phone calls from a man (with a heavy accent) claiming to be from the state attorneys office. He has left messages on my cell phone stating that my name and social is involved in a lawsuit and if I do not contact them in the next 24 hours then there will be a sheriff at my door the next day (it has been a week). They are now starting to contact my employer and gave all of my information including my SOCIAL SECURITY NUMBER!!! even after my boss told the man that I did not work there. I am in the process of filing a police report, and I am recording all of the conversations. I am also getting calls from a 918-532-6898.

I received a call from a guy calling himself Caul Walker from the State Attorney's office and said that I needed to call back to a George Biloski, I think that is how he spelled it.  He said there was a case against my social security number and that i needed to call this George person, whom he said was the senior attorney.  He gave me a number of 916-304-3295 to call back to.  the original number I got the call from was 916-625-6073.

Where do you go to report these people and can you stop them from calling.

I just received the same call. When I refused to provide my SSN, the caller (who had a heavy Indian accent) told me that I would have the Sheriff at my work and my home to arrest me. I told the man, go ahead.... I too also applied for a loan last week, since then I have had maybe a hundred calls from people with heavy Indian accents asking me if I would like to complete a loan with their company.....

Lesson to be learned, if you are in need of short time finances from a payday loan lender, only apply in person or to well known sites. It is obvious that these people have some sort of way to intercept your information online from what appears to be a secure site. Trusted well known lenders are the only way to go..... Good luck to everyone else!

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I also had the same call! A couple of days ago I filled out some non traditional loans on line and was re routed from different website to website. I proceeded to fill out the information and even giving out my routing number and account number, I feel really stupid for doing that but I didn't think nothing of it at the time, as the website looked la gite enough. I received the call with the information of me having a warrant for my arrest allegedly using my social for a fraudulent act! I was read what those act's were, they were 3 counts of unlawfully using my social to receiving funds I didn't even receive. When I asked for proof of this and to please e-mail me these allegations  that they claim I did, they followed it by saying that we can take care of this and settle the amount owed to prevent me for getting into more trouble. They then told me that if i didn't cooperate that they would ruined my good name and start harassing me in my place of employment. They told me that not cooperating would result in them sending the sheriff to my door. They did not realize that I have friends in the LA county Sheriffs office and LA county Police department. So I immediately contacted one them and asked him to run my name to see if had any kind of warrants, he said no and that I was being scammed. So beware with this number calling you and be careful with giving your information on line. Unfortunately for me I gave my information trying to apply for a small business loan.(NOT A GOOD IDEA).

I received a call from a gentleman while at work stating he was from the State Attorney's Office and that a lawsuit had been filed against me. Gentleman with a very heavy Eastern Indian accent refused to answer any of my questions about the lawsuit until I confirmed my social security number. I advised him that I was not comfortable doing so until I could confirm that he was who he said was. When I called back about 20 minutes later, a gentleman with the same accent answered, minus any type of official title or office name. He then gave me the name of my assigned attorney "George Velowski" who sounded exactly like the guy I was just talking to. He then proceeded to tell me everything the previous guy just did. When I again refused to verify my SSN with George, he read me my address and stated that two uniformed officers would be at my home and work shortly to take care of this for me.

I received a call from (916) 304-3295 claiming that they were calling from the CA Attorney General's Office and looking for someone named Michael. I informed the guy (who had a heavy Indian/Pakistani accent) that he had a wrong number, and hung up. He called back and got abusive, so I informed him he had reached the Department of Defense (he had) and that he needed to stop calling this number. He called back a number of times, pressing me for whatever information he thought he could get, refused my demand to speak to his supervisor, and made some pretty poor but funny (from my perspective) attempts to insult me. And, of course, he never could tell me the name of the CA Attorney General (Kamala Harris).
