Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I, too, got a call last night from this number.(9/14/13  They had my name, place of employment, my bank name & even worse, my account # !!!!!!!!!! They told me if I didn't pay $300 right now, they were going to have the Florida Sheriff's office arrest me Monday at my place of employment & would freeze my bank account  They said I had taken a payday loan from Cash Advance.  Yes, they were yelling at me too. He spoke with such broken english, I could hardly understand them. I asked him where he was calling from & all he said was that he was an attorney.

Listen just tell them you kno there scam. what is happening is if we go to file a loan ap online there able to see the activty.. There screen shooting your info they put it in there system and then call you a 1000 times. Listen dont put your info online. you want a loan go to a place. NO ONLINE STUFF. im telling you this from experince. do not pay them. yes they have your info but dont worry bc they cant do anything with it. it was only to scare you and once they scare you you pretty much cave in and pay. But dont. its a scam and they make 1000s of dollars a day doing this. if they shall call back just say look call me again and ill have the cops tap the phone line they will stop. i was on the phone with one. and i had to witness there scam to an older woman it was very heart breaking and i bagged the guy to not call me again. he refused but is block now. change your number if you have to BUT STOP PUTTING YOUR STUFF ONLINE.

i also got the same call they started calling my job yesterday. a co worker took a number down so i called and this indian dude says i owe some money and were arrested me today. Im still waiting!!!!!!! so weird that he has my bank information need to check with my bank. Whatever you do dont give him any info this is a scam.

Received a phone call from a co-worker who informed me a voice message was left on our company recorder.  The caller did not leave his name but left a threatening tone that if I did not return the call that they would report me to an attorneys office and basically GOODLUCK!  I'm concerned that a call of this nature was sent to my place of employment.  I called this number back and informed that if they did not remove me from their directory and any contact list, I was reporting them to the Better Business Bureau or any consumer protection agency I could receive help from.  Companies like this need to be stopped.  This is definitely a form of harrassment.  Thank you for any assistance in this matter.  It is greatly appreciated.

This guy called over 12 times in one day a few days ago on the 31st of Aug. 2013. Said he was from the payday loan company Plain Green (which we applied to a day earlier for a loan and got denied.   He had a very strong India or Pakistan accent and was very hard to understand. He knew all of my wife's personal information. . He threatened my wife. Called her work 6 times too and got her in trouble at work. Said we defaulted on a loan we took and we would got to jail if we didn't pay. He said he was a lawyer and threatening her with a lawsuit. We are afraid as he's got all of my wife's personal info. We are closing out bank acct tomorrow morning the 3rd of Sept. 2013. Beware of the guy. Call the police and file a complaint. Let them find him. Let the district attorny handle it and put this guy in jail where he belongs..

They are now calling and saying you get approved for a loan.  You pay the amount they tell you wait an hour and money will be deposited in your account!!  Three hours later no money and you call and the guy is rude and says he wants you to suck his d**k and f**k you when you try to get your money back and then started screaming at me and telling me "I GOT SCAMMED YOU STUPID B**CH" and to never call back.  wanted a walmart green dot card!!  So I'm out $150!!!  So be careful!!!

I got a phone call today saying if i don't pay him $465.32 within the next 35 minutes from WALMART he would have me arrested and threatened to take me to federal court and file 3 CRIMINAL charges on me for fraud for a payday loan i NEVER took out but would not tell me the exact amount or the date that i supposedly took out this loan! I am a paralegal and little does he know I am a current law student and am well aware of the law and I currently work at a law firm this is NOT how a law firm would go about this matter and DEFINITLY would not give personal information like you SS# or FULL NAME or DOB over the phone! THIS IS A SCAM! hE INSISTED HE WAS LEGIT AND HE GAVE ME THE NAME ATTORNEY MIKE BROWN. THIS IS A LIE!

My experience is the same as many others here. It appears that the common denominator is Payday Loans.  I have a few of those as well. I just received my first call from this number.  The caller had a very thick Indian or Pakistani accent.  He identified himself as working for an attorney named Michael Davis.  He stated that there is a lawsuit filed against me under my Name and SSN.  He also made the comment about me possibly going to jail.  THAT IS THE TELL-TALE ITEM THAT MARKS THIS AS A SCAM!!!  In a civil lawsuit jail is not a possibility.  In fact it is a violation of the Fair Debt Collections Practices Act to even make such a threat.

Calls about 4 times a day.  I returned their call and supposely they are some kind of lawyers with IRS telling me that I owed them money and I had to take care of that matter right now or the state police was going to arrest me.  He wanted my credit card or bank account number....hmmmm.

Check your credit report too - just in case.  In don't believe you can put a business number on the Do Not Call list though.  Remember - only honest telemarketers use the DNC list.... and most of all, don't lose any sleep over this.  You are not alone!!

Thank you, I did. I work in HR at a call center and deal with arrests and warrants daily but it's very diffrent when it yourself and I have never even been pulled over. I am reporting them to everyone I can think of now. I have registered both numbers on the DO NOT CALL LIST , and working at a call center I am very aware of the DO NOT CALL PROCESS, I am putting them on our company DO NOT CALL LIST as well. Thank you again.

If they continue to call your job, inform your employer about the scam.  It is also illegal to give any information to a third party!!!  Also - owing money is NOT a criminal or felony charge and you won't be going to jail  - another lie to scare people.

I am recieving calls from 2 men stating they are with the attorney genreral office in California and there are 3 felony and criminal charges against me. The names are Brandon Brown and Michael Davis, obivously they are not American nationality, India or foreign, you cant not understand but bits and pieces. I was so upset getting called at work 5 times in a row, being yelled at, and threatened. He stated I had 45 minutes to pay this money owed and not a minute more because my documents were being downloaded and sent to the judge. He told me to go to myu local Walgreens or CVS and do a Vanilla Reload Voucher for bill pay, then call him back for further instructions. Also I had to fax a letter stating I was not intentionlly trying to commit these charges. I was so scared I confided to a coworker, we called the company that I once had  loan with, that was paid in full and yes I had confirmation of this iI even told the man this. The lady we spoke with assured me this IS a SCAM and NOT to give them any money. Glad We called the loan place. I am still worried because they have all my info, but my bank said that you could put your account on a CREDIT only, (which means only deposites can be made) you can draw money out but it has to be in person. You can alsochange this daily if needed to allow a bill to go through until you can close and reopen a new account. So this makes me feel beter for now. Lesson learned I will NEVER do anything online. These people are still calling me today at wrok and now on my cell phon, they never leave a message. Calling my cell phjone is not that big of a issue as I do not answer calls that are not stored in my phone anyways. But calling my job is. The numbers are 916-542-0065 and 916-343-5342.

Just received a call at work a person with a strong accent asking me if I had a lawyer and had a knowledge of 3 law suits and when I said no he said I needed to call Michael Davis right away. I knew I did not have 3 law suits but still of course it made me nervous so I google abd seen all the messages.

I received a voicemail from a woman with a voice that I thought Nigerian.  I returned the call and spoke to Michael David Smith.  He mentioned a payday loan from a company called CASH ADVANCE.  I asked him to send me the paperwork.  He clicked off.

everyone should try to pull as much info from him as possible and post it on these various sites like callercenter.com etc
has a thick accent so it's hard to understand what he is saying , but clearly is a scam from what I am reading on various web pages regarding this number
call your phone provider to report this number as a scam / harassment ask them to file a report with the authorities and to block this number from reaching you , if possible

we all have enough stress in our lives , don't let this scammer trick you into thinking you owe him money !!

Everyone whom has been harassed by the customer service of a payday loan company using this phone number 9165420065 there's a few other numbers they use as well go to the BBB better business bureau website and complaint I did was contacted an hour later and was told that a group law suit will be filled if they can't get them to stop and financially we can bring them down so please everyone whom has been harassed please file a complaint with the BBB company being payday loan customer service 9165420065 ... lets stop the harassment    thanks
