This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information from unscrupulous websites like the one you may have filled out an application with, and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

ABC News released an investigative report on this scam a year ago:

I have had calls like this so many times. No matter how many times I threaten to sue them or have them arrested they still call. I am not working at this time but when I was they called me there too. I use to get stressed and upset about it but not anymore. I just ignore them. I know I don't owe them money. The thing is they are not calling from the U.S.A, so there is nothing that can be done. Because they are from India they feel women have no value and if you yell at them they find it very disrespectful. I had one tell me to "Shut Up" I was like, really that is professional. I just block them and send them straight to my voice mail.

I was called on my cell phone by a John Smith who had a very thick accent . He told me the last 4 digits of my ss # and said that I needed to call 916-672-1781 back ironically that was the number that he was calling from. He said that I had charges filed against me and I needed to call Mike Anderson back immediately to discuss this matter. Something needs to be done with these people because they are seriously crossing the line !! I received a similar call last year and reported it to the Attorney Generals Office .

Someone called my cell # 3 or 4 times in less then 30 minutes; then called my work # (with a very thick accent) telling me to call an attorney Brandon Vown from states attorneys office in Cal. re: charges filed against me.  When I asked him what it was about, he said that there are 3 charges against me wanted my attorney information. When I called the number, it rang several times and then went into an blank -what sounded like an answering machine. WHAT A SCAM!!!

I could barely understand who the caller was and who they were trying to call. The weirdest part of the calls:

I answer the phone in a timely manner, but dead air. Then I see I have a voicemail.
Same thing an hour later, I answer the phone in a timely manner, but dead air. Then I see I have another voicemail. Both voicemails are near identical, and nearly identically unintelligible except that they wanted me or some person they had me mistaken for to call back. I try calling the number back from my work line (which caller IDs as our company's generic number) again, dead air. I still have no idea what the deal is.

Best guess: someone owes someone money and somehow a collection agency has a wrong number. The collection agency uses bizarre and shady tactics to establish contact with the people they harass. Are their tactics illegal (especially in the case of wrong numbers?) Do I have grounds to file a complaint?

I too have gotten a call from this number in addition to a secondary TX number stating that I owed a debt to Cash Advance USA ... I could barely understand the gentleman on the phone and was told to call back the number and press extension 212 and when I asked isnt that the same number and he said yest but I need to talk to Mark Victor his supervisor.  I tried to call back and when the phone rang it was automatically disconnnected.  In addition, I researched Cash Advance USA and their website states "If you receive a call that is not directly from their number IT IS A SCAM."  Please notify the Internet Fraud, alert your bank and the three credit reporting agencies.  This is really scary!

I got a call from this number today. After hearing a man with a thick accent tell me "F*** you!" for 10 minutes straight and tell me to always make sure I keep my kids close by and that my wife sucked his d#$% last night, I let him speak with an officer (I just so happened to be at the court house when it happened). He proceeded to tell them to f#$@ themselves and he would kill them also. Ridiculous that they can get away with this. When you threatened someone's children, especially mine, you have crossed the line.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

This number called with a guy that I could not understand and I work in an industry that is very diverse.  I had to ask him to repeat himself several times.  He told me that there were criminal charges against me and my social security number.  Yep, I'm breakin' the law!!  I made the mistake of applying for an online loan.  These idiots and others like them have called nearly non-stop for a week now. I told him I would take down the number for the attorney and contact him as soon as we hung up.  I'm not calling, nor will I ever.  I hope he calls again so I can have some fun!!!

Receiving calls from 916 672 1781.    Caller with heavy accent leaves unintelligible message on voicemail.  When I call the number back and ask who it is calling me they say it is the "State Attorney General" in Sacramento California.    I think they are saying something about paying a debt.  It is an obvious scam as the Attorney General's Office would be investigating crimes, not personal debt.

I got a call from this number (916) 672-1781 to speak to an attorney Mike Anderson, something about me supposedly being sued from a debt collector, but what is so funny about it is that, im not in debt. So yep!!! Its a scam. I mean i applied for a loan on-line, and was approved. I guess that is how they got all of my information like my social security number and my work number. The dude that called me i could not understand anything he was talking about, so yea that was pretty weird. I just hope they dont do anything with my social security number. My credit is good and i want to keep it that way.

This number kept leaving threatening messages so I had my daughter return the call.  They told her they were from the San Diego States Attorneys office.  She then told them that they would understand why she would be recording their conversation.  They immediately backed off their smart mouth and started with "I have't asked for money, have I?" and kept repeating it.  They had a LOT of my personal information but didn't get specific on what I was suppose to get arrested for!  Someone has to stop the people.  Older people just can't take this.
