No name of the company on voicemail from Clarence Taylor ext 135 919-861-2400, need not call me again. I owe NO DEBT. When called still no name of company had to call again to ask young lady what's the company name. The lady told me today 6/25/14 that this is a collection agency.

Just got a call from them. I have NO DEBT whatsoever. I have 800+ credit rating and pay my bills in full each month. Tried to tell me I owed money and i asked who provided them with my information. They couldnt reveal that information so I told them when I get a late bill then I'll worry about it. Meanwhile all my accounts and credit cards are at 0 balance.

The issue is not incompetence. Mistrust of any verbal ''wrong number'' claim is standard procedure at all the rogue collection agencies. They assume you are a liar until you give an answer which gets one paid. An ill-considered provision of the FDCPA is abused to permit this.

To halt the misfired skip trace calls, you must take direct action and make it the debt collector's problem to cure. Use of a "shut up" notice has already been discussed on this page. My long form advice for "not me" cases is found here:

I get calls from this company 3-4 times a day asking for Jim Hollen. I tell them I have no idea who that is and ALL my bills are paid early and even the house and car are paid a month prior to due date and I have a credit score in high 700. This has been going on for a year and it's a company phone they are calling. They say they will remove my number but never do. I have had this same company phone for almost 10 years. If they were any good at their job they would have removed me and stop wasting there time calling a number that is no good.

Do not be bullied by these collector scumbags. They are not supposed to be rude to you by law, that is why they always give a false name. If you do speak with them, try and record the conversations, if they give you a fake name, the conversation should not stand up in court. If there is an item on your credit report that you do not recognize, you can write to the reporting credit bureau and reporting company and question it. If they do no reply within 30 days, they have to remove it by law. Also check your states statute of limitations. Most debts may be cancelled within specific timeframes if certain conditions are met. Do you best to pay your debts, but if you are not able to, do not let yourself be bullied into paying what you can't afford.

I pulled up my credit report because i am going through Identity theft and called to get information regarding this collection, well I spoke to Brian was verrrrry RUDE. Tried to get info where services were rendered and stated he couldn't give me that info and for me just to pay my bill, and he is the manager there..pffff was of no help. I have called other collection agency to clear acct. that dont belong to me and they have been very helpful in giving me the info. i need to send them to clear this up. Brian stated it is by law we need to check our credit report once a year BS...but anyways thanks for nothing.

Whether you are called a debtor or some collector thinks you can flush one out, you have rights and options. Many are simple to exercise if you only learn how. You are granted control of how you are contacted, the right to dispute debt claims, and the means to sue violators at low cost. The FTC and the CFPB can start you on your homework. See also if your state laws grant additional or stronger rights.

While your depiction of the debt collector workplace culture sounds accurate, your reading of the laws and the options they provide is not.

} cease and dissist ... send it registered

The term is "desist", but it's really a "cease-communication" notice. Correspondence to a debt collector should be made with proof of receipt, but USPS Certified with return card is sufficient.

A cease-comm is a fine option for people whose debt accounts were already paid, discharged by a judge, or which have aged past Statutes of Limitation or Repose. I also recommend this for "not me" cases. For everyone else there is a chance, however slim, that you can be sued for your assets. Locking off all contact forces your collection agency to file suit if it wants your money badly enough. You have a right to limit or ban all phone contact by written notice anytime. Just be certain to leave a ''convenient'' channel open, such as USPS mail.

That's only true for Texas residents. The 30-day clock under FDCPA is for alleged debtors to send a written dispute. The collection agency must reply with debt validation to lift the suspension on collection activity which that dispute enables. Sometimes agencies won't bother validating and quietly slink away.

This notion of sending multiple dispute letters may disrupt an unusually disorganized office, but it will totally confuse the issue of when the dispute was delivered there. That date is critical in determining "continued collection" violations.

Such a threat is also likely to inspire snickers and derision. The FTC is not going to drop everything to solve your personal problem when we already have a private right of action in that same FDCPA. When your rights are violated and you have proof, you make it the collection agency's problem to solve via summons and complaint.

I am a former debt collector, so I know what I'm talking about here. Let me first start by saying that Debt Collection Agencies are the biggest monkey-f*** you've ever seen. Owners are money hungry and the managers are some of the shadiest characters you'll ever run across. The collectors themselves are usually GED holders, drug users, and/or High School droup outs. In the two offices where I worked I was the only person with a high school diploma, let alone any college. I'm telling you all of this for a reason: because these collection agencies are manned by morons, it is VERY EASY to get over on debt collectors. BTW, I worked there as a way to help pay for college. Here are some tricks that will help anyone being hounded by these folks.

Collection Agencies are governed by the Fair Debt Collection Practices Act, which is a Federal Law. Write the collection agency a REGISTERED letter telling them to cease and dissist any further contact regarding any and all collection actions they may have against you. The reason you send it registered is that they have to sign for the letter so you have proof that they received it. Now if they call you make a note of the time and day of the call and the person you are speaking to. Tell them that you are contacting the FTC concerning their violation of the FDCPA. They will s*** all over themselves and they may just wipe out the debt to get rid of your account.

The other trick is to flood the collection agency with letters requesting that they provide proof of the debt. They are required to do so by law upon your request. The letters you get from collection agencies will tell you this in the fine print. If you get calls ask the collector for a reference or account number and tell them you will be making a request for proof of the debt.

The agency has 30 days to provide you with the above mentioned proof. If they don't then they eat the debt.  So here's what you do...write them a letter asking for proof. Send another one 4 or 5 days later and another one 4 or 5 days after that. Keep sending them every four days for the entire month. It's a long explanation, but basically the agency will lose track of who sent what to who. WARNING: Make sure you send different letters. If you send copies of the original they'll figure it out.

All these places know how to do is call and harrass people. If you give them something to do that requires intelligent thought and organizational skills they will be lost. Good Luck!!

In reply to my own post from earlier today, I just got an email from my mom saying that Todd Johnson had left the same message for my dad, since he was listed as an "alternate contact".  How embarrassing, because I had to tell my parents that I've got some bill collector calling me!

I called the number back and the answer was "Hi, this is Jean, how can I direct your call?" (no, this is such-and-such a business, etc.)  I asked for extension 129, since that's what TJ left on his previous voice mail message, and the line went quiet while she tried the line.  (No muzak or anything like that.)  Then she came back on and said, "Ma'am?  I'm sorry, that person you are trying to reach?his name is Todd?is in a meeting.  Can I direct you to his voice mail?"  

I left a voice mail message for him, telling him I'd Googled his company and saw that they were a collection agency and that I thought this was erroneous, since I have paid all my bills, etc., and I told him to feel free to call me back.

I am hoping this is just an example of a semi-sleazy collection agency buying old debt info and trying to collect on it, which is to say, a *mistake*, as opposed to an all-out scam.  Either way, it sucks.  I'll post again if / when I hear back from them.

I just received a voice mail message from Todd Johnson at (919) 861-2400 ext. 129 from Kross, Liberman & Stone, saying that they had a very important business in their office and that I should return the call and reference a particular file number.  

I'm not behind on any of my bills or loan / credit payments.  I don't know that I want to call back because I can't think of a reason why they'd be calling in the first place (particularly since he didn't mention the reason in the voice mail message).

It just so happens Mr Debt Collector from NC.  I have Legal Proff that this debt was paid in full and I also had it removed from our Credit Ratings.  I have original copies of the information this man left on my husbands phone and am waiting for them to call again and tell me they are lawyers.  Then the fun will begin.  I pay my bills.  I have no problem doing that and if I can't pay it in full I make arrangements with the original company.  Then I pay it off.  Not everyone has a job these days, I am one of the lucky ones who does.  But don't tell people to pay their F***ing bills.... some are paying what they can when they can.  Too many Debt Collectors demand a certain amount of money monthly.  Unfortunately not everyone can guarantee a specific amount.  Even if it is only $5.00 a month they are paying on the bill and should not be harassed.  Enjoy your job but don't blame others till you stand in thier shoes and know the facts..... not their income or if they own a house and want to go for a second morgtage.... that is personal.  Discuss the debt and then hang up.   It's your job.

I used to work for a Collection Agency and I hated it.  I called a man one day about a debt and his late payment, which was my job.  I was so ashamed.  The mad apologized to me and promised to make the payment as soon as he could.  He son had just died that day from years of Cancer and he was devestated.  I marked him as a call in 6 months and let the record show he was in mourning for the loss of his son and his family income.  I also quit that day.  When I left there I sat in my car and cried for the man and his family.  I am not cut out for that type of work and will never do it again.  

BTW a little FYI  Kross Liberman also uses the  phone number 1-800-326-3734.  I found that out when a friend who lives in Florida got a call from them.  It was for payment of a woman who had passed away and the executor had all the bills paid in full with proof so she could probate the will and settle the estate.
