I got the same call and they are calling my relatives saying they are charging me with criminal charges! He treatned to take my house,shut down my checking account,send me to jail for check fraud etc. I took out a payday loan and didn't finish paying it! I contacted my local Fair credit practices dept and was told here in VA Internet payday loans are illegal and by law they cannot sue me for the bill. They also gave me three places to lodge a complaint and they also have lodged a complaint. Today thy called and I told them that it was illegal to pursue me or my family for this debt and he got irate and called me every name in the book and said I would be seeing an officer at my door to arrest me!!! How people like that sleep at night!!

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

ACA will not do anything at all.   they are allowing these illegal debt collectors to be members in spite of their illegal tactics and refusal to follow the law.  

They KNOW who these members are and the industry as a whole REFUSES to do anything about them.

ACA has on the news FLAT OUT DENIED that there is anything illegal going on,  but they sure WHINE about how a few bad apples are making the entire industry look bad.   Yet they refuse to REMOVE the bad apples.

The owner of the company is Shawntina Jones, and she knows all the tricks seeing how she has debt collectors knocking down her own door. Her house in Mount Dora, FL is in foreclosure, and the Homeowners Association where she lives in Stoneybrook Hills has filed a foreclosure on her too since she hasn't paid her HOA dues in three years!

FPPSG LLC.  aka (Fortune Portfolio and Processor Service Group) is actually who is calling about these payday loans.  Their phone# is 512-236-5451, The tend to change their phone numbers so be careful.  The company acts like "Processors" but they are collectors.  National Credit Works is out of New York and owns the debt FPPSG LLC is collecting.  This is completely illegal and unethical.  They call the debtor trying to state they received a complaint to process, and they will deny being a collection agency.  Believe it or not they are registered with the ACA (the association of credit and collection professionals) as a reputable collection agency. The craziest part about the whole thing is that I called my local FBI office and they already have an investigation going. That is all they would tell me but it's crazy that they know who these people are, and they are still in business.

This is who is actually calling, They will state they are "National" and work directly with the National Attorney Network.  This is a complete lie. There is no such thing. They will deny being anything else but "National".

Got a message this morning from a guy by the name of "Eddie Torres" and that he is a Processor with a serious "Criminal Matter". The number he left was 936-465-9374 x.275 and that i needed to call him back as soon as possible so no other criminal charges can be filed against me. So i called back just a few minutes ago to find out that the gentleman that answered the phone told me it was a "Law Processing" office and so i asked if i could speak with a  guy named "Eddie". I was told that he was at some court judgment hearings and when did he call? I said i got the message on my machine from yesterday and that i wanted to know what i was regarding. The guy that answered the phone said that he would go looking for "Eddie" and get him on the phone. This call i have no idea what it had to do with me but i am sure i will hear more from them!!!

Got a message on my parents phone from Alex Lopez. The message stated that I was implicated in a serious legal matter and that I was "more than likely unaware of the charge". When I called, he represented himself as an attorney (said he was with National Attorney Network). He told me his company receives all check fraud complaints the day before they are filed in court. He told me that he checked my criminal history and there was nothing to show that I had ever done anything like this before, so he was concerned that I would be needlessly convicted of a crime. I asked if there was anything that could be done, and he told me that he would call 'whatever' collection agency and see if they would be willing to work with me. After several minutes on hold I was told that the company was willing to accept the entire amount tonight, otherwise it would be filed with the county tomorrow. Thank God for this website as I really was worried about it. I called him back, told him what my own research found out and MAN, talk about back-peddling. "I never asked you for a dime, you called me and asked me to call the collection agency", blah blah blah. Thank you for saving me a lot of worry and headaches. Alex Lopez and all of you scumbuckets at National "Whatever-you-call-yourselves" today, GET A LIFE AND START OBEYING THE LAW, or you will find yourself at the other end of a LEGITIMATE call from an attorney !!

I recieved a call today from an edward harwell of national processing service, said I didnt finish paying a pay day loan from 3 yrs ago, and if I didnt pay it he was going to process to my county for bad check, I told him ok, he put me on hold for several mintues and said he talked with the collection agency, i asked the name, he mumbled something off saying they are in buffalo ny.  looked it up and cant find them.  he will not send me a letter for the terms he discussed.  this is a low life collection agency! its BOGUS

I have received these calls over a period of 6 months. I got a pay day loan on line about 3 years ago. A second company called somehow got my information a deposited money in my account. So I called to inform them that I didn't request a loan from them and to take the money back. They wouldn't so I called my bank and had them to reverse it back to them. they proceeded over a period of months to take money out of my account for repayment of the loan that I never asked for and reversed and now these people keep calling and leaving messages about a file with my name and SS# and email and something about it being critical. I have had enough of these crooks. I think they want to scare people into giving them their checking account numbers to draft money from your account for something that you have paid three times over.

Same thing here. I reported the call as fraud to the do not call registry. If they were honest and unfront about their methods, they would probably get better results. Do NOT pay them any money.

I've been getting calls from these people for over 5 months now. Same thing, I took out a pay day loan and couldn't pay it. The lady that called said that They tried the payday loan company tried to deduct their money from my bank accoutn (8?) times? and that it added up to a felony. She said she would call the payday loan company and see if they could come to an agreement, amazingly after 2 minutes on the phone with them "i think she was b-sing me" she said they would drop the charges if i payed them in a week. Well! five months have passed and all they do is call me with the same old story I stopped answering. They are just a collection agency and I believe have no legal right to press charges.

I'm glad I saw your message because I also got this call a few hours ago saying the exact same thing and also about a payday loan. I was scared of being prosecuted so I told them that I would somehow pay but I would pay with a money order. He told me this would not be possible and only a check or debit card would be accepted. This made me suspicous and since I had an appointment I told him I would call back. When I did call back there was no answer. Is it true that what they are doing is illegal?

I received a similar call from ?Melvin? with National calling from (936) 465-9374.  He said that his company was pressing criminal charges on me regarding a payday advance.  I told him that they could not file criminal charges in connection with a payday advance, since it is not a criminal offense.  Melvin got irate and refused to allow me to speak with someone above him regarding his harassment and dishonesty in connection with a ?debt? that he refused to provide any information in writing regarding.  I am pursuing legal action against them because their practices are illegal.

I've been dealing with the company on the other end of this number for several days now.  They call themselves "National" but upon further prodding I got them to tell me "National Processing Services".  Supposedly they are a processing company that is hired by collection agencies that don't want to call consumers themselves.  In my particular case the collection agency is not a legal authorized collection agency so thankfully I did not give them any money to settle my old credit card issue!

Beware and do your research before you give them anything!
