I don't understand why shills come here and expect everyone to buy their fairy tale story.  If someone is on the DNC list, then they should not receive these calls, period.  The fact that people are receiving calls means that the caller is on track to being hit with fines for violating federal law.  We don't have to listen to any sales pitch just because you have the arrogance to think we "might" like what we see or hear.

I purchased one of these products and am very happy with Aqua cares service I had 3 estimates done and they were the cheapest and the only one that had a lifetime gaurentee. I looked them up. On the BBB and any issues they have had with customers they have resolved. Most people just don't plan for the future and if you fall and hurt yourself you will wish you had one of these products. The contractor was a retired Dr. and came to my house and spent a couple hours going over the process with me even showed me a DVD. When was the last time an actual Dr. made a house call to you for free of charge to offer his service to help maintain your health. I don't understand why when someone offers to show you anything that could benefit your life for free you would be mad. If you don't like what you see or hear the then just don't buy it.

I used to work for this company and I decided I could not work for the Pagano family because I discovered that the entire company is a scam! Every three months they told us to say a different company name to people we "cold called" using an automatic dialing system that was loaded with phone numbers the the owner bought from other companies. The phone numbers are compiled from people that are of the "baby boomer" generation  and credit score of 680plus (this guarantees they can be financed). The call center is located at 3850 SE Beisser Dr. Grimes, IA 50111 and it is called Aqua Care USA but they require their employees to say the company is located in Temecula, CA. Also we were required to say that we are the company you see on television that makes the walk-in tubs and showers (this is a complete lie. This company does not have any commercials on telvevision and is using trying to use another company's investment to make money). Once you agree to an estimate, the company then sends out a sales representative to "YOUR AREA" to try and hard sell you a tub or shower. (Don't fall for the part where they say "we are going to have a representative in you area tomorrow giving your neighbors free estimates".) If you get a call from this company, ask them for a number that you can call them back on and see what answer you get. When they tell you that they are from an outbound call center and there is no way to call them back then hang up and call 877 497 7777 because that is the number where the company can be reached at in Grimes, IA. Take my advice and don't be scammed by this company!

Your question has been answered hundreds of times on this discussion board.  Instead of going through the process of retyping again and again,  please go to the DNC/FTC site and read..   Okay,  one more time:

If you tell him to stop calling,  he must comply.  Since you do not have working relationship with his company, he can begin calling again in 90 days,  unless you send him a certified Cease and desist.

It is legal for him to call because he is considered a contractor who must estimate his costs.   As long as the intended and ultimate purpose of his call is solely to arrange a face to face meeting between you and a representative of that company,  for the purpose of information and estimating cost,  and that no attempt is made to sell and close the deal over the phone is made.....it's legal.  Remember,  once you accept his invitation to send a representative for an estimate,  you have then established a business relationship and he can start trying to sell you the moon and stars above until you advise him to cease...    Why do I have "Do Not Call"?     Well,   there are over 500million phones in the usa.  There are over 1 billion 500 million calls received each day.   Think of all of the legitimate and legally Registered with the FTC  Telemarketers that could be calling you,  but who do NOT,  because you are on the DNC list of which they do honor.  Sometimes we focus on that one caller that we don't want calling so much that we forget about  those many callers who could legally call us if not for honoring the DNC list.....therefore the DNC gets the blame.
Scammers honor no list,  and of course those exempt have their little perks (which I don't agree with either)
Just telling it like it is........so don't shoot the messenger...

Forgot to add:    Also,  since you told him to take you off of his list,   he must do so or he is in violation of the FTC.

Your report will go into the trash can just like most others.  A company can call you if the intended and ultimate purpose of that call is to arrange a face to face meeting with you and a representative of that company,  for the purpose of an estimated cost.  As long as no attempt is made to close the sale over the phone,  It is infact legal.
Whether or not he was a Telemarketer is irrelative.

It's b***s***, the DO NOT CALL list doesn't apply if they aren't selling anything over the phone. Since it requires an in person meeting to complete the sell (They are calling offering free estimates) they, like the million others, are exempt from the do not call list... same for fund raisers or anyone doing estimates or something that requires a in person visit to complete.

The key & the secret I have found that works for me, is when these RUDE individuals call, immediately check Caller ID, if it is a number you do not recognize quickly pick up the phone and hang up.
DO not say a word.  I don't EVEN allow it to go into my voicemail, because to me, that is letting them know its an active number.  There may be times they continue to call, but continue doing the same thing and EVENTUALLY they WILL STOP calling your number!  I've had some RUDE individuals use foul language to me and it is absolutely infuriating. Do they NOT have anything better to do in their lives other than harass innocent people?  IT IS THE ULTIMATE DISREGARD of OUR PRIVACY!  This # just called me, and I refuse to answer it, Caller ID says, "Wireless Caller 19512160982" So, is it a cell phone that are making these calls?

The best way to stop these obnoxious pests is to block their numbers.  After about 3 months they stop calling and you can remove their number from your blocked list and add the next nusiance.

Got the same call as most everyone else.  Home Safety Bath & Shower.  Same phone number.              951-216-0982  Going to be measuring other homes in my neighborhood tomorrow.  I asked him how he got my phone number.  He said from a marketing company.  I said so you are a telemarketer.  Said he was not.  Said I was on the "do not call list" and I was going to report him and asked him to please take me off his call list.  He laughed and hung up.

About 4:30 p.m. we got this call. The woman asked for Mr. or Mrs. (our real name here). She said the company was 'in your neighborhood' and the call was about walk-in tubs like we see on tv. I told her we were on the DNC list and I didn't know why she was calling. Her reply was, 'I don't either,' and she immediately hung up. Good riddance.

In case you get this same call I just had my whole bathroom completely done. Walk in shower, new toilet, sink, medicine cabinet, flooring, AC register, new plaster walls and paint. Total price $6,300. So ask this guy what a total replacement would be and find out what a scam they are. And if they say they will finance you can bet your boots it will cost you.

Update to my Sept 5 comment--I got another call today (12/11/12) from Home Safety Bath & Shower and this time it was a very nice lady who did promise to "talk to their computer guy" and put me on their do not call list.  She also wished me a Merry Christmas.  I did get an address of one of their call centers in Grimes Iowa, but the address she gave me doesn't seem to exist in Google Maps.

I agree with James, no honest company uses these methods.

If you answer numbers you don't recognize, you are only telling them the your number is a good number with a live body on the other end. I let the voice mail get it. They always hang up and leave no message. If I get the same number calling back for a couple of weeks, I pick up and then hang up. If they can't talk to you then your number is of no use to them.

DNC list isn't working......like other Federal/Governmental department's rules and regulations.  I'm in Texas getting calls from a CA telemarketer on  "wireless" phone.  Would it do any good to complain to their wireless provider?

I got a call from 1-951-216-0982 today and the guy said he was looking for a person with a last name he couldn't pronounce. I told him that this was not that household, and he said he could talk to me if I was the homeowner. He then said he was calling about walk-in showers and tubs and had someone in my area that could come out and give me a free estimate. He then asked if that sounded good and I told him that it sounded better if he would remove my number from his calling list. He then told me that could only happen if I removed it from the phone book. I said excuse me, and began a rant of how legitimate businesses have this obligation and that I was on the Do Not Call List (for all of the good that apparently does) and he hung up on me. I (outraged of course) called the number right back, and got a message stating that this number was not accepting calls at this time. The number showed up on my caller ID as a cell phone in CA. I would really like to know how to go about getting these scam artists (and others like them) to leave me the heck alone...
