On January 8th, 2014, The State of Minnesota, Attorney General Lori Swanson won her case against Bradstreet & ASSociates, LLC, case #27-CV-14-302.  It is hereby ordered that ALL CASES filed in any MINNESOTA conciliation or district court by Bradstreet or Bridgestone is hereby vacated and the complaint dismissed with prejudice.  Court has ordered Bitchstreet to close all of its accounts, cease all collection efforts and will refrain from assigning, reselling or otherwise transferring its accounts to anyone else.  These a***oles got theirs and consumers received justice for all!  Further harassment by anyone affiliated in anyway from this company or continued harassment by any third party debt collector on behalf of US Bank should contact Lori Swanson at the MN attorney general's office immediately!  651-296-6196.

They have been garnishing my wages for awhile now and then today at work when i got my pay check they had reimibursed me for 520$ for overpayment, total i owed them was for a old bank account at wells fargo for 1700$ and i was wondering why they kept taking money from my checks, and they would also soemtimes take money out and then there were times that they wouldnt garnish me it was really fishy i am wondering who i can talk to about this because it makes me worried that they took more then what they should have and when i alo called them when i first started getting garnished the guy wouldnt tell me hardly any info and told me he wouldnt send me paper work in the mail either that they had already sent me the paper work.

I received a lawsuit on2-28-13 from this company. I disputed this account back in december its almost march and there still trying to get me to pay. I had a guy call my phone from three different numbers he kept leaving messages with an addituted I will be calling US bank and speaking with them I also will report them to the FTC because they want me to pay for something that was deleted back in december. Before someone is sued do your homework instead of spending money and not having any facts that are correct

Bradstreet now sent us a letter, certified mail. The mailman walks up to the door and asks for 15 cents because Bradstreet didn't put the proper postage on the letter, so we sent the letter back. They keep proving themselves more retarded than I originally thought.  They say this debt is from wells fargo bank for $3000 from over 5 yrs ago. Get this, they sent a letter prior to this one we sent back today. The letter was addressed to our business name's payroll department and is asking the employer to garnish the debtors(my wife) wages. My wife is the payroll, its a 2 person run business. I just don't get these guys. Yeah, okay bradstreet and a***oles LLC, my wife is going to garnish her own wages. Hilarious.  It still seems like a joke and eventually someone is going to call us and say "gotcha! Haha we so had you scared you were getting sued".

They sent me a letter stating they were going to sue me. I looked into the debt and realized after pulling all my info that the debt doesn't exist. Pay no attention and have no fear. Verify your debt with all 3 agencies. See if it is even legit debt, or is actually owed. By the way, i believe they are located in Southdale center. Maybe stop in a pay them a visit? Also take note that it is against practices to threaten anyone when collecting debt. You can file complaints with the FTC (i did). Go look up all your rights and know what you can do. If you can, try to record them as i did. I have them on multiple violations that add up in fines that will be far greater then the supposed debt i owe to them. I talked to the wonderful gentlemen from Bradstreet Associates on 2-04-2013.  Brad was such a lovely man, haha.  They made me so angry, The first things out of his mouth was the name of my home business. He says "are you guys still up and running?", We just started our business and have been open for a month and how did this guy have my name and phone number?  Brad tells us that if we dont fill out a packet he is mailing to us, he is sueing us, I asked what for and what the packet was, he stuttered and he says "basically your being sued, get a lawyer and have him look over the paperwork".  I called for Brad at Bradstreet later that night and asked the guy who answered the phone "what is going on and why are you guys calling my phone repeatedly?". He would'nt tell me his name, he starts throwing political b.s. at me about President Obama not having a birth certificate, he then tells me he doesn't want to talk to me an doesnt care to talk. He cut off every one of my questions, he answered questions with questions that didnt make any sense.  According to my research, there are 6 people who work at Bradstreet in Minneapolis and from my experience, they all need customer service training and need to learn people skills.  When you answer a phone or make a phone call, you must state your name, company name and what your calling about. Dont start it off with a "your going to get sued and your wages garnished.  My wife and I both repeatedly told 2 different guys that we run a daycare, the guy asked If he should send the papers to our payroll, we dont have payroll man. the man I talked to when I called them back that night told me that I am my wifes employer. my wife and I are both co-owners as in 2.  Very unpleased about the way they run their scamming business and if it is a legitimate business, their ethic makes it seem like a joke and unbelievable.

I'm sure the Vet's post was "very upsetting to you". I laughed so hard, i nearly pissed myself when I read your post "Mr. President of the company." (laughed when I read that too). You guys don't give a flying f**k for whether a debt is valid or not, unless you are going to get sued because of it. All you want is the money. In recent years, third party debt collectors have been buying up old debt for pennies on the dollar and telemarketing collection calls to debtors to get what they can from their "investment". This old debt is sometimes legit, sometimes not (expired statute of limitations for example). In parallel, scammers have also been making extortion calls using bought/stolen/phished loan data, sometimes to debtors who may or may not have already paid off their debt, sometimes to random people, while pretending to be legit debt collectors. Problem is, both employ similar tactics to scare debtors/victims into paying legit/fake debts. If you don't have debt, you know for sure your caller is a scammer. If you have debt, you have to figure out whether it is a legit third party collector or a scammer -- not a comfortable position to be in but here's how you can perhaps tell the difference:

The FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf treats the INITIAL CONTACT between collector and debtor (first call, first letter, first whatever) as a special event. Legit collectors per section 809 of the FDCPA *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it (coercion) is illegal.
If they say the FDCPA does not apply to them because they own your debt, the debt-owner exemption only applies to the original owner. A 3rd party who buys the debt for the purpose of collecting debt is treated as a debt collector and not an owner and must obey the FDCPA as explained in this FTC Staff Opinion letter here http://www.ftc.gov/os/statutes/fdcpa/letters/arbuckle.htm

You can tape, then sue collectors (google "fdcpa attorney") for violations described in sections 805, 806, and 807, per section 813 of the FDCPA.
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint with your state AG.

Between two recorded phone calls and about 4-5 violations that i can count... i guess i will see you guys in court. Trying to sue me for an almost 7 year old debt that the bank wrote off long ago?  I also submitted a complaint to the Federal Trade Commission reporting the violations made. How can you even look at yourself in the mirror knowing you are just a bottom feeder ?

If you were treated so badly, why didn't you call and speak with a supervisor?  We are here to help you anyway we can.  Again, we can work with you and direct you to a US BANK or Wells Fargo manager.  Instead of getting upset lets work through this.  For someone who sounds like they care, or served our country, the last thing we want to do is put this on your credit, or worst case pursue litigation in small claims court.  We work with a lot of proud vets who would never, ever speak the way you are.  You should be ashamed  by the way you are making threats and insults.  It saddens me when a small percentage of people have to write such negative things when there are a large percentage of people who are happy with us and save a lot of money by making monthly agreements or settlements.  I want to thank all the people who serve or served our country.  I also want to say thanks to all the people that work with us and want to continue a great working relationship in resolving your debt.

I was contacted by a so called debt collector who identified himself as Justin, 952- 378-1565. I am an Iraq war vet and felt completely disrespected when he called my girlfriends cell phone number which I have no idea how he obtained. He called and right off the bat this guy is telling me I have a debt with US Bank and he is giving me one last chance to pay them or they're taking me to court. The first thing I thought was " this is a scam" and when I asked for proof of the debt he laughed and went on in a rant about how the company doesnt send out written debt paperwork. This company Mark that you are running is illegally obtaining information and harassing the very people that protected you and your worthless family so you have rights in this country and all you want to do is treat people like dirt and force them to pay your company. I think anyone that owes their debt to this company has the right to know who it is they are paying, what that exact amount is and the companies name on the envelope for verification. And if thats a problem for your company Mark CEO of BS Inc. Tough, because Americans deserve more then that with all the fraudulent scams out there, you and your company can't set yourselves apart from all that. Screw this company and its CEO in which no one gives a crap until someone's sues your a** for foul play. I hope a something terrible happens to your company and can never regain its strength and everyone that worked for you comes down with an incurable disease that you can only contract anally. Think this a scam?  Avoid Bradsteet?  Great idea if u could care less about your credit.  Why in the world would you ever take advice from an anonymous person on this blog who owes us money.  Do your self a big favor.  Check your credit and u will see your delinquent account on there.  Of course if you have an agreement with us it would not apply to u.  Why not go down the the bank sit with a branch manger and tell them your account was sold to a collection agency.  All they have to do is call their recovers .  You could roll the dice and avoid it, ruin your credit and possibly be sued.  Believe me when I say we want to help you and work something out.  Don't make a mistake listening to an Internet blogger who owes us money.  Go straight to the source.  Some cases the bank made a mistake and will pay us.  Think to yourself, would a company registered with the Secretary of State and have an office in southdale center run a scam and be in business this long.

I have contacted a lawyer who says my case is very strong for violations of FDCPA. Look for an attorney that will take the case on a contingency basis. If you win, the lawyer will likely be paid by BS&A, LLC, along with what ever damages. Don't do it Pro Se, because they do have lawyers that will tear you apart. BS&A mass files lawsuits against minnesotans.

Federal law limits garnishment to 25% of disposable wages so "can't even pay my rent or other bills" isn't believable. Life for wage-garnished debtors may be rough for a while but the law does not turn them out from hearth and home for how will debtors earn the wages needed to pay their debts without the necessities of life to sustain them?

Check out the statute of limitations on consumer debt in your state. These companies/law firms do often buy debt without validating any part of it. They are aggressive and the harassment will be neverending. Know your state's statutes. I have been pursued for 2 debts by this company despite having paid one off and having documents to show the other was identity theft. Upon further investigation, I found that in my state (TX) the statute of limitations is 4 yrs. Both of these debts were from 2002. Be aware that when you call back you can start the statute time over. I never call any number that claims I owe a debt or that I won something. I also use a PO Box as my home address. These people and others like them are out of control, but unless we as consumers want to incur ridiculous court and attorney fees to sue them, the AGs in the states don't seem to see it as a priority.

I too received a call from Bradstreet and Associates, actually my husband did at his work.  They were calling to speak with me claiming I had a debt which needed to be collected or they were going to court.  The number they left was 952-715-6826 her name was "Rita", she left a message.  I called the number back and asked who I was speaking with and the man said he could not tell me for "privacy reasons"  WHAT?!  This group is sketchy - and how can it be legal to call someone's husband at his employment to reach a wife for a debt when you don't even know for sure if you have the right extension or the right person.  Then there were all the questions from my husband, who was actually angry with me because he thought I had a debt - which I do not!  I have never owed anyone anything - all the money and credit is in my husband's name!

I agree with the others.  I am also receiving harassing phone calls from 952-378-1565.  The calls are NOT for me, but rather someone who had the number years ago. They refuse to stop calling and, leave annoying messages that put you back into their system.  I have been on the "National DO NOT CALL list" for years.  I plan to report them.  I would not give them any information - they are not professional in the least.

Beware of JB tactics.  Do not allow this person to push you around.  Essentially, Bradstreet has purchased old debt from US bank for pennies on the dollar.  So say you have a $2,000 debt with US Bank, Bradstreet probably paid $2 for it.  The law allows them to purchase old debt, which is not right.  This law needs to be changed and someone in Minnesota needs to fight for consumer's rights.  The banks already received their money from the bail out of wonderful Obama.  I'm not saying that people shouldn't be responsible for their bad debt, but companies like Bradstreet and associates should not be able to purchase the debt when US bank has written it off and been paid for it by tax payer dollars.  Bottom line, change your telephone number, don't give Justin any of your information to find you.  If he continues to call your family and friends, write him a cease and desist letter - he is required to stop immediately.  Loop holes in the law allow 3rd party debt collectors to continue to line their pocketbooks.  If you are interested in seeing the debt Justin Balfany owes, go check it out here.  Turn him into his creditors and give him a taste of his own medicine.

I cannot believe how many of you there are all over the internet that are having the same issues I am. My debt to us bank was real and I paid it off several years ago. I just want to let you all know Mr. Berringher is a Co-OWNER of the company! I contacted them today and luckily he wasnt in. However he has been harrassing me non stop for the last two weeks telling me I have an attitude and i couldnt resolve this debt because he was going to sue me for double the amount no mater what i did. I told him he was harrassing me and said how he thought it was funny how people throw that word around, and he was going to destroy my credit etc. etc. Hanging up on me, then calling at work and not verifying who he was speaking with!!!!!!!! it was a chance of luck i answered the phone. I told him not to call me at work and i couldnt talk then. There was no reason for his call and after harrassing me some more and trying to scare me he hung up!!! I called the company today and talked to the man who takes poeple to court and he is working with me to resolve the dispute, YES YOU CAN DISPUTE THIS DEBT IF YOU PAY IT! NO MATTER WHAT THIS DAVID BARRINGER SAYS! If you paid it and even if they do take you to court, if you can prove it they wont make you pay it again its unconstitutional. If your sick of calls from this psychotic creep who gets off on harrassing you contact the attorney general. ALL OF THEIR PHONE CALLS ARE RECORDED!!!!!! I am not a professional debtor, I am I  a financial planner.  This company is try to collect a debt from my aunt, which, I have no doubt, is legitimate as my aunt IS a professional debtor.  I have no quarrel with them harassing my aunt. I do object to their repeated calls to my grandmother who has dementia and to my grandfather who has heart problems.  Brad hangs up on them, is rude, and calls them 3 or 4 times per week looking for my aunt.  Monday, he called my grandmother while we were all at the hospital in the intensive care unit, meeting with doctors about my grandfather.  When I informed him we were in the middle of a family crisis and asked that he call my aunt directly, he refused and said he'd wait to speak to her.  I informed him I was hanging up.  I called the next day to provide my aunts contact information, he told me I was a horrible person for hanging up on him, then he proceeded to hang up on me.  This is not a company seeking to peacefully resolve a debt dispute, it is a collective of bullies harassing a frail elderly couple

Behringer calling me on an old US bank account saying i owe 2600 and that he would settle on 1300 but i would need to come up with it prettty much now!. and i got too fed up with how rude he was being. saying i have the gall to say hes not trying to help me. this account was full of bad checks with my signature signed by my mother when i was just barely 18 and i was telling him i'm not paying for something i didnt do. anything that you can prove that was me i will pay but this is not mine. he said stop coming up with excuses etc. and pay it then go after your mom for the debt you paid to us. i hung up on him. and then when i called him back after about a week or so hes like u are a child and stop coming up with excuses why you cant pay it, your not even trying and ive been trying to stop the auditors from going ahead with employement verification and garnishing you wages to help you out. but i havent received any paper work about this. and him saying we will take you to court and we will win and then you will have to pay attorney fees as well. then hung up and called back and he said pretty much too late this is going to the auditors who are requesting to do employement verification with where you work and we know where you work saying the place where i work. and we willhave to process the garnishment of wages.

im wondering with you what happened. did they take you to court? garnish your wages?
