This guy is an All-Time j***-off extraordinaire. He was extremely rude, will not tell me what company he works for, no matter what. His "name" he gave me was Greg. When I called him back and asked what company he worked for he got all kinds of bent out of shape and asked Me how I got his number and what was I doing.!. and of course he hung up on me. But yet he keeps calling me, leaving b.s. messages, but hangs up when I call him back trying to find out what is going on. Don't waste your time on this cretin.

I have been getting calls from these jerks for months now -- Chris Smith, Stacey Edwards, Adam Hall (who sounds exactly like Chris Smith) and this morning a new one -- Laticia, who left a message that it was "imperative" that I call her back.  Their messages are all recorded and it is robocalling.  One time early on, I tried calling back -- just got muzak and no one ever picked up the line, so WTF?  They call from a variety of telephone numbers, they never say the name of the person they are trying to reach (and I have a generic voice on my answering machine -- all legitimate callers usually say "this call is for ...."), and they don't identify the company they are calling from.  I have looked up other numbers that they have used and people say that this is a medical collection agency, which would exempt them from the do-not-call rules.  However, I have no medical bills overdue so it is harassment as far as I'm concerned and I wish there were something that we could do about it.

This number called my house this morning at 7:45am. When I asked who it was calling this early all she could say was Nicole. She would not tell me the name of the company stating that she doesn't have to give me that information. She then hung up on me. I called back to ask for a fax number and was told that they were not calling for me. Then this woman hung up on me. I then called back a second time asking for a supervisor and was transferred to "Adam". Adam told me that I was acting silly and my phone number would NOT be removed from there list. He also told me that "Sherry Edwards" spoke to a person at my house last week and they have it recorded. Well they are LIARS. We were out of town.

I sent a certified debt validation request letter to the 2120 Crestmoor Rd. address on 09-11-2010 only to have it returned on 09-16-2010. The post office couldn't deliver because the business was unknown at that address. I guess my next step is to try the PO Box listed in previous post. When I was contacted by this company, they never identified who they were, that this was an attempt to collect a debt and any information would be used for that purpose. The number that showed up on my caller id was a local number. It wasn't until I began asking questions about the company that I was told they were based in Nashville. If the PO Box doesn't work, I may have to go to the original debtor and try to get some information from them.

I did not see any number come up associated with the call. I only got 'Houston, TX.' and they have been calling me non stop. When I try to discuss this matter with them, they go far off track. They called me several weeks ago and legitimately my son was missing. I filed police reports, the whole nine yards. He was missing in a custody type case for 2 weeks. That is my personal issue to deal with and none of anyone's business. I told the woman point blank that day that quite frankly I was tired of talking to her since she wasn't listening and that my son was missing and I was too distraught to even deal with her and hung up. She calls back today and my son is no longer missing. That issue was resolved but I tried again to explain the situation to her and why I feel this debt is not owed. She then goes on to question me as a parent, to say I lied about my son being missing, to say I am making excuses to not pay my debt and so forth.

I called and spoke to Mr Greg Williams. I told him they shouldn't call here anymore, I notified him I would be sending a cease and desist letter and told him I would not tolerate his employees talking to me that way. Basically I was told by Mr. Williams that his employees will continue to call and have a right to talk to me any way they choose because they are attempting to collect a debt.

After interviewing with this company and after working a legitimate collections position, I have come to the conclusion that the collectors are indeed bottom feeders.  My interview consisted of a 25 minute conversation, and then a short series of emails asking me when I could start.  The hours for this company are from 730 - 600, Central, Monday through Friday (consistent with FDCPA of 1977 for call times).  All of the collectors are receive a salary plus a small commission of what they collect.  That's fine.  That's called incentive.

What I have a problem with from what I have observed is the actual collection practices that are employed.  None of the collectors use their real last names (which I can understand -- if you were collecting on a debt with someone who had a decent bit of technological savvy, would you want anyone to have your real last name?  nope, me neither.).  What I have an philosophical issue with is the incredibly berating manner in which all collectors deal with their clients:
- Hanging up on the debtors is a regular occurrence.
- One collector in particular, going by the name of Adam Hall (not his real name), will say things like "Good luck with getting your finances in order." and "Good luck getting this off of your credit score for the next 7 years."  He is the worst kind.
- No one that I've observed in my visit to the office indicated that any of the information that they were obtaining was for debt collection purposes.
- The PO Box is valid but corressepondence go through yet ANOTHER party.  Sending anything but a payment (which is frowned upon by this company) to the PO Box that's been listed here will get you nowhere.

I'd beware if this company ever calls you regarding a debt; don't assume that it's valid unless it's a non-medical related account.  More often than not, there is an error in the reporting... The accounts from vets' offices, lawn care companies, and so (from what I have gathered) seemed to be very accurate, but the rest of them are usually WAY off base.

The collectors though, are the WORST.  No ethics whatsoever and are informed that they should be "money motivated".  

Creditors, beware.  Working with Capital Accounts is only going to p****off your debtors.  Look out.

Can you provide specifics as to collection efforts on debt you don't owe? Did they pull credit report on you?  Did they report to credit agencies that you had collections on debt you didn't owe?  Can you provide names and dates?  A similar matter has happened and I want to know if the company has a history of these types of issues.  Thanks

I have also experienced the same thing by Chris Smith.  When I did talk to him I was being very polite and courteous, but I guess being polite and courteous isn't something he is use to. At the time I wasn't working and trying to take care of my family the best way I could.  When he asked I told him I wasn't working, then he stated "If your not working then how you pay your phone bill," I told him that I was still staying with my mom and this isn't my phone, then he replied "Well why don't you get your mom to pay the bill for you," I was very agitated by that comment.  Another incident I experienced with him, I was still being polite.  I told him once again that I wasn't working and as soon as I get the money I was going to pay them.  Then he asked me was I disable.  So at that time I was very agitated so I told him that I was.  Then he asked do I receive SSI OR SS so I told him that I don't and then he said VERY RUDELY AND DISRECTFULLY I thought you said that you was disabled and etc... So I hung up on him!!!!!The way I see it is that if he don't like his job then he shouldn't be there and to quit harassing me and my family.

I have experienced all of the above scenarios.  The phone calls and the letters are all threatening and rude.  I have spoken to Chris Smith, David Hunter and Carlos Garcia.  They will not allow you to speak to a supervisor nor can you have a calm or civil conversation.  All they will say is, "Are you calling to make a payment?"  Over and over again.

I am now only cooresponding via letter and fax.  Do not believe ANYTHING they say to you or include in a letter or leave in a voicemail.  They lie.  Know your rights.  Their interactions with me have already violated both the Fair Debt Collections Practices Act of 1977 as well as the privacy rights as detailed in HIPPA.  

Do not assume that the debt is valid.  In my case it is not.  Ask in writing for the details of the debt including the original debtor, dates of service and any other pertinent information.  By law, they must provide this information.  Contact the original debtor to determine if the debt is valid and can you pay them.  

This company employs bottom feeders who make a percentage of what they collect.  They will do anything to get you to make a payment.

Let me tell you what. I use to own a collection agency, but always went by the laws governed by the state and federal governments. Capital Accounts harassed me, lied, called me names, contacted my 77 year old mother, and 92 year old father, who live no place close to me, and harassed them. I am one of the smart ones. In the state of Tennessee, it is legal to record a phone conversation, and i recorded all with them. I have proof of may law they broke, and have filed a complaint with the FTC. I have also filed a huge amount on law suit against them. This is where it will hurt, when it bites them the most on their bank account. I have researched collection agencies who have been brought before the Federal Government, and been sued. With proof, the collection agencies lose a bigger percentage of the time, than win. more like 85/15 against them. I recorded all conversations I had with Capital Accounts. I mean i have both Greg and Eric on tape breaking many laws. They use fictious name, but the real name will come out in court. Hey, after they lose in court, and i win all this money, then i will pay the 400 dollars i owe on my medical bil

Ok These boneheads Call and harass me ENOUGH. Here's my collection of info. To stop them calling you need to send a certified Cease Communication Notice stating them to stop calling you, by law of the FTC (Federal Trade Comission #877-382-4357). Call them and file a complaint, get ref. # to include in your letter.

Since this is a PO box and certified requires a signature, you need to ask your local post office to have the Nashville post office sign for it. Even though them calling after you ask them to stop is elegal, You need letter to have any legal standing according to FTC.

DM is correct. The truth is just the opposite of what they told you. The Federal Debt Collection Practices Act doesn't say they can continually harass you with calls. In fact, the FDCPA forbids debt collectors from placing calls for the purpose of harassment.  The FDCPA also gives you the ability to stop the calls and any other contact from them.

The fact is, you have no obligation to communicate with a debt collector and you can put an end to their calls by informing them to cease communication with you. The best way to do that is by sending them a certified letter informing them to cease communication with you and warning them that you'll pursue legal sanctions against them if they don't comply with your request.  If they contact you more than once after receiving your letter, then they are in violation of the FDCPA and subject to being sued by you.  Just be sure to mail your letter via certified US mail with a return receipt request. No, this is not legal.  After you request that they stop contacting you, they have to stop, otherwise you can sue them for damages and to force them to stop calling you.  They have no right to call you after you tell them to stop.
