I got laid off and I called capital one auto to let them know as soon as I get my first unemp check. They call me 6 times a day. I talk to rep today and said why are you calling me there are notes I will pay Sept. 13 and I have spoken with 5 reps about this. The reps that call are not nice and you can't understand them. I had them for several years now and I would never go with them again and would not recommend them to anyone.

I'm having the same issue.  WHO THE HECK IS CHERYL BRUCE?????????  Every time I tell them there is no one here by that name, they just call back the next day and then the next and the next.  Is there a legal remedy for this terrible year long harrassment?

I recieve many calls per day from Capitol one starting at exactly 8am.  They call several times a day(9) via an automated calling system.  They talk to me reguarding the account but the automated system continues to call.  

I have talked to them about this and they stated to me that they can not remove me from the automated sytem, but if I pay in full the calls will stop shortly thereafter.

These call have had a definite effect on my psychological well-being and I have endured stress to the point of cancelling work for that night ( I am a Night shift trama nurse).  I can not sleep as I am woken by these calls.

I tried turning off my ringer, however, once I missed an important call from the school nurse because the ringer was off.  

I feel that my phone should be private and that it disrupts my home environment as well as my rest and mental health in relation to the stress it delivers with every call.  Its is similar to being legal for me to put a speaker in their house and yelling in it whenever they sleep, eat dinner, have a family meeting or even procreate.

I am interested in pursuing a class action lawsuit for this and similar tactics that invade the privacy of American  citizens.

recieved a BILL from Capital one for my Husbands credit card payment...My Husband has NO bank account,has NEVER talked to anyone from Capital one, has no credit rating to even think about credit cards...now, every evening there is a call from a machine saying to press numbers 1, 2, or three if whomever is answering is my husband...a 1-800 number only gets another machine saying to press in the non existent credit card number he supposedly has...I'm 79 years old...I don't want or need this nonsense and it's wearing on my nerves...this is a scam and shouldn't be allowed but I really don't know how to stop it...the better business bureau perhaps...

Here's how it works people.

You will start receiving phone calls if you are 3 or more days past due on your payment.  It sucks, but that's how it is.  CapitalOne is sub-prime financing, meaning the majority of the customers have horrible credit, and therefore do not pay on time.  The only "grace period" you have on your payments is 10 days, after that you'll get a late charge.  That 10 days doesn't mean you don't have to make your payment for 10 days.  Also, if you are past due and receiving calls, it's not harassment.  Someone posted above that if you ask them to stop calling, legally they have to.  That's not true at all.  The only way to stop the calls, is to pay what you owe.  That's it.  You will receive (up to) 15 calls per day from 8am-9pm until you do, and this is legal according to the Federal Debt Collectors Privacy Act.

If they call you looking for someone else and you honestly don't know who they're looking for, I'm sorry.  You're probably going to receive some calls for a few days even if you answer the phone and tell them that.  Multiple attempts at a number are required in order to remove it, even if it is a wrong number.  I promise you the calls will stop.

Now for the rest of you, if they call all the time and all you do is ignore it because you don't feel like paying your bill, that's your own problem.  Ignoring the calls won't make them stop, and if you don't plan on paying what you owe any time soon, don't complain about the calls because you wouldn't be receiving them if your account were current.  Yelling at the person calling you or using profanity towards them won't help the situation... in fact you'll probably piss the employee off which will only cause them to call you more.  They're just doing their jobs.  Yes, there are a lot of a***oles that will call you, unfortunately.  If you're nice to them, they'll be nice back.  No one calls you looking for a fight, trust me.

Keeping in touch with them will help, especially if you have the same associate calling you each time.  However, answering the phone every time and saying "I keep telling you I can't pay for another 3 weeks, there's nothing I can do about it," is not a good answer.

Follow through with your plans.  If someone calls you, don't just tell them what they want to hear to get them off the phone.  Meaning, don't lie about when you can pay, because that means your payment promise on the account will break.  What that boils down to is broken promises = less ability to work with you, and faster escalation of your account to repossessions.  

A last but important note:  If you cosigned the loan, you are just as responsible on the acct as the main signer.  So, if you and your brother are on the loan but your brother has the car and makes payments, you are both getting the phone calls regardless.  Second, a divorce doesn't change anything on the account.  Your ex-wife may have been ordered by the court to have the car and make payments, but if she's late, you (the ex-husband) are getting the calls too.  The court CAN NOT order a name off an account.  Why?  The signed contract existed prior to the divorce, the divorce doesn't change that fact.  The only way to get a name removed is to refinance the loan (which you should have done after the divorce anyway if you were smart about it).  

So you can complain about the calls all you want.  The bottom line is, bring your account current, stop the bull s***, and you'll never hear a word from CapitalOne.

And I can guarantee everything I've written here.  I worked collections at CapitalOne Auto Finance for a little over a year.

This is just another number with people that call asking for Scott for me. They never say anything outside of asking for Scott and I've told them dozens of times to stop calling... It's beyond irritating.

I recieve calls at 15-20 intervals sometimes 5 minutes.  I have never answered the calls as I recognize it. I also have an auto loan thru the company and I have been trying to change my date as well and check into autorefinancing.  Obviously they don't do either!  Still refuse to answer the calls.  I have a past due amount as well but I always pay it before the next one is due.  I struggle payday to payday and it is frustrating to see how bill collectors or even Capital One can be a pain in the a** and continue to make things for those of us who are trying to make a living and trying to make things good!  Really p*sses me off!

This number has been calling my cell for days and never leaves a message, they call during my work hours. On Saturday I answered and them and they said they were looking for a Henry. I told them politely that no one named Henry was at this number 3 times. So, now they are calling again!!!!!!!!!!!! I want to file a complait.

Yes, this IS Capitol One Auto Finance.  I finally answered the phone and it WAS them.  It only took one time for them to call me with their "courtesy call" and I refinanced with another company.

Called last month and verified there is a 10 day grace period as I am gone alot this time of year.  My payment is due the 20th and I was out of town so I mailed it on the 24th when I returned.  My caller ID showed numerous calls from this number.  Upon my return, I googled the number to find out who it was.  The next day the calls started again.  At first I ignored and did not answer, but then I got angry.  I asked the person who called why he was calling if there is a 10 day grace period. He said he knew nothing about that and hold on.  I could hear him talking in the background and someone was coaching him what to say.  I asked if he was new and he said no. I then asked to speak to a supervisor. The supervisor said it was just a courtesy call and did I want to make a payment. I told her my husband and I have an excellent credit history and high credit scores and I had received an obsessive amount of calls in the last 2 days.I told her the payment had been mailed. She asked if it was a check and when I said yes, she wanted to know if it was the full amount. I told her "OF COURSE." I also told her that I would be refinancing through another company.
That is my suggestion to everyone who can do so.  Refinance and go to another company where you are not treated like you are trying to beat them out of their $$.  The only thing that will get through to them is to hit them where it hurts - their pocketbook.

About once a month around the 12th I get the phone calls.  Funny thing is I got a letter from Capital One informing me that I have a 15 day grace period in which to pay my car loan.  It isn't due until the 10th......I may be from WV but even with WV math.......10 + 15 is 25.  So they should be calling me until the 25th or so.  Also, I have informed them three times that I am not to accept calls at work......Guess what......they just called me again!!!

This number is for Capital  One Auto in Plano, TX. I live there and drive by it almost everyday. I have a vehicle financed through them and they are the worst. I have asked them several times to change my due date because of the dates I get paid every month. They won't do it because I have late fees (because they won't change it!!!). Now they charge me a $15 late fee every month and my payments although late according to their records is received by them on the same day everymonth. Jack A***S!! They rip you off if you're not careful!!

it started agian this morning at 7:00am the phone started ringing. on every hour. it would ring. I had to turn the ringer off. I looked the no# up on line and it was Capital one. I have told then over and over agian to change my due date to the 19th and they tell me it is done. untill the first come around. the calls never stop.

I had a problem with Capital One I was behind and they called everyday ALL day and then when I was caught up they made curtisy calls......This bother my work and my life for a while. Then I sent a ceast and desist...the calls stopped but becarfull if you need a deffered pay because once you do that the file goes to legal dept. They cant call but they will become worse to work with.

I have a new account with Capitol One (my third in 6 years).  They have called me every day for the last several days but never left a message.  I finally spoke to someone today, and they only wanted to verify my loan information and ask if the date of my monthly payment was good for my budget.  I have had financing with them before and there is never a problem as long as you pay by the due date.  In years past I did need to change a monthly due date once, and there was no problems or hassles and handled very efficiently.  I have automatic bank withdrawals set up so that I never forget to pay, and it has worked well.  I appreciate that they don't geek out if my insurance company is slow in providing renewal information and that they send your paid off contacts and titles in a timely manner.

relentless,soooo relentless.  calls early, late and constantly.  i pick up and hang up and they call back seconds later.  picked up one time and no one was there, if i let it go to the machine no message is left.  pick up hang up, allllll day.  i wonder what they'll do when my phone is gone?

Just got car loan through Cap One and they are already calling me. First payment due 7/20. Ridiculous. They only have my cell number and it is usually turned off so they can just dial themselves into non-answering heaven.

My caller ID just shows this as being an unavailable number (information unavailable).  I finally Googled the number and come to find out it's Capital One Auto Finance.  They don't leave a message on my answering machine, so of course I don't know who it is.  For all I know, it could be a telemarketer trying to sell me vinyl siding or carpet cleaning services.  They already have on my record that I will make a payment this coming Friday for last month's payment due.  Why they keep calling is beyond me, and I really wish they'd stop, or else leave a message.  It only takes 5 seconds to say "please call Capital One Auto Finance at 1-800-###-#### no to discuss your account" or words to that effect.

I also have a loan with Capital One Auto Finance.  They keep calling me for no reason.  My due date is the 20th, I have a 10 day grace period.  I have already noted this with the operator, and after that, they still continue to call.
I have never been late on a payment, or have made arrangements only once with I was five days late.  
THEY NEVER STOP CALLING!!!!!!!!  CAN'T THEY READ THE NOTES ON MY ACCOUNT!!!!  I HATE THESE PEOPLE!
