they identify themselves as capital auto finance and even if you ask them politely not to call they still do. At one point my wife and I were yelling at them and they still called back many many times. I would really like to stop them from calling.

It is Capital One Auto Finance and the only way to get them to stop calling is to pay your bill...no matter how many times you tell them you'll pay it on a certain day or whatever, they will hound you to he** and back until they get their bounty.

Yup definitely Capital One Auto Finance, but I disagree with the person who said they just call for past due money.  I just got a loan through them last week, and haven't had a payment due yet!

The problem for me is that when I call the number, it requires I put in my account number or social security number to talk to someone.  That seems risky to me.  I'll do my best to answer one of the next times they call and will update here if I have any luck!

Tried to call the number back, it goes immediately to a message that says "Due to emergency conditions, we are unable to answer you call at this time."

I also got calls from this number. Called back once asking them to stop calling me  (I did not have any auto loans, and I never had any business transaction with them).
They continue to call, so I enterred it as "Son Of A Bi***" in the phone book and did not answer it any more.
Called them back asking to remove my number.  After a while, they stopped calling me.

Make that payment - They will ruin your credit. We just found out that we have "severe deliquencies" on our credit and have never been more than 30 days late. We used to have the loan with Northfork until they were taken over by Capital One. Northfork had a 10 day grace Capital One calls 3 days past the due date non stop - They are terrible and I will never do business with them again.

just purchased car financed by capital one.  after seeing other posts tried cb of caller id.  capital one.  only 2 options account number or social security number.  did not want to give ss to automated system but since others indicated really was capital one I gave it a stab.  it is automated message telling amount and date for next payment.  Then you have other options for other account information in an automated system.  Don't like that set up at all.. but now I know ... thanks for the info here so I know getting crank calls at work.  Would have never known.  I too have cell phone for emergencies only and get very few calls.  I don't answer calls I don't know. Capital one system should leave message to cb.

I bought my car on the 18th and had a few issues with title and registration due to a horrible expereince with the dealership now I am having calls from multiple numbers...I just called my cell phone service to request a phone number change and if you have a cell phone I would do the  same and just send out a mass text message on your new phone number and never give it to Capital one...

This number started calling our cell phone today about 6 times throughout the day. Leaves no message. Just the phone number shows up in our missed calls. Since we only use this number for one special person to call on and they have another number. We don't answer this line if it's not that certain number. We have had this number for about 9 months.

We do not have Capitol.one anything and do not live near Texas and the number they are calling is a Louisiana number. Some one should tell these people to get their numbers straight.

COLLECTION AGENCIES

Collection agencies do not fall under the National Do Not Call Registry's restrictions.  Collection Agencies are governed by the FDCPA (Fair Debt Collection Practice Act); therefore, to cease calls, you will need to do the following:

(1) Send a letter to the agency via USPS Certified Mail with Return Receipt to cease calling you.  NOTE: A Cease and Desist is different than this request and may bring on additional and immediate unwanted actions.  Once the agency receives this, they are required by FDCPA to stop calling you, EXCEPT for the following:
15 USC 1692c
§ 805. Communication in connection with debt collection
(c) CEASING COMMUNICATION. If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except?
  (1) to advise the consumer that the debt collector?s further efforts are being terminated;
  (2) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or
  (3) where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy.  If such notice from the consumer is made by mail, notification shall be complete upon receipt.

(2) File a complaint with the state's Attorney General's Office for which the company is located: http://www.usdoj.gov/usao/offices/usa_listings2.html

(3) File a complaint with your state's Attorney General's Office: http://www.usdoj.gov/usao/offices/usa_listings2.html

(5) File a complaint with the Federal Communications Commission (FCC): http://www.fcc.gov/cgb/complaints.html

(6) File a complaint with the Better Business Bureau (BBB) office for which the company does business: http://welcome.bbb.org/

(7) File a complaint with Consumer Sentinel:
   Consumer Sentinel
   600 Pennsylvania Avenue, NW
   Washington, DC 20580
   Website: http://www.consumer.gov/sentinel
Consumer Sentinel is a consumer complaint database maintained by the Federal Trade Commission. The database was created to allow law enforcement to track consumer complaints involving Internet cons, telemarketing scams and other consumer fraud-related complaints. Consumers can file complaints on-line on the website mentioned above.

(8) If you suspect fraud, file a complaint here, too: http://www.fraud.org/

(9) Post complaints in forums such as these used to identify the callers, especially those who are ignoring the FDCPA, to assist others in researching issues similar to yours!

By all means, please share this information!  They (Collection Agencies) rely on consumers not being knowledgeable and enforcing their rights, so don't fall prey!  And I highly recommend taking Dave Ramsey's Financial Peace University (http://www.daveramsey.com/fpu/home/) if there is one near you; very educational and enlightening!

TIP: If you are receiving calls from telemarketers or other scams, you may use some of the above links for filing complaints as well!

Harry, it's not going to happen. Sorry. I would also like to see the changes but it's not going to happen. They don't care about you. Elect some different ones, give the lobbists a couple of days and it will be even worse. The current group of bankers has made such a mess of things they had to get the multi-billion dollar bailout and are now receiving the million dollar bonuses for their hard work.

I would like to see a big B tattooed on the forehead of bankers so when they walk into my little store they are charged my fees such as the lights on or off, want to walk on the carpet (and the carpet cleaning fee), answers to questions and so on.

you want all this crap to stop?   or at least become fair? Vote out your current US congress(wo)man and senator, put in new blood, and demand they regulate credit card/bank loans so they cant keep gutting people with endless doubled and tripled fees when you run into trouble. They make SOOOOOOOOOOO much money on credit accounts it is incredible. When they sell them off to collection agencies it is often for 50% of the amount owed.. and THEY STILL MADE MONEY OFF YOU.   Regulate banks   limit credit interest rates and stop UNFAIR bank rip-off policies like being able to change the terms on their whim, ELIMINATE "universal default" - where they all up your interest rates when you are late on JUST ONE account...  finally, 18% is the HIGHEST it ever should get... charging people who are in difficulties 29.99% with late fees and over limit fees is EVIL.

I know how you feel people. The samething is happening to me. The generated phone system. All hours of the day every day. I am late as well, but there is no reason to continue the generated calls. They must think people are getting annoyed with this. Plus, calling ur cell phone and doing the samething.

My friend just assumed an auto loan through capital one auto, and used me as a reference.

EVEN as a reference- they call ME non stop. I dont have any credit cards, and my loan through GMAC was paid off 3 years ago. They call asking for my friend, Ive told them a dozen times she doesnt live here and gave them HER phone number, yet they still call 10 times a day.

Yes, the caller is Capitol One. The company does not care if you give them an extension number they will relentlessy call you at work on your personal phone so be ready to deal with at least 10 phone calls a day if you cannot answer. They also do not leave messages for you to reply to them after work. I keep my phone on in case of emergencies and even work in a hospital they really could care less about any situation. This all goes on if you are in good standing with them as a new client or if your loan is in anyway defaulted (ie. late payment, insurance, wrong insurance info.).

Be careful! Caller asks for lots of financial and personal information, claiming to be from Capital One but caller could not verify or prove that he was really who he said he was.  NEVER give personal information to someone unless YOU initiated the phone call.  If you get a call from this number, do not give them any information and then hang up and call Capital One to verify the authenticity of the caller.
