BUFFALO?Attorney General Eric T. Schneiderman today announced a settlement with Joseph Bella, the operator of several debt collection companies in the Buffalo area, for illegally collecting on payday loans, violating the privacy of consumers by soliciting their personal information through employers, and sending letters that purported to be from an attorney in order to collect. Bella will pay $165,000 in restitution and penalties and be ordered to substantially change his business practices.

?Across the state, we?ve worked aggressively to ensure that debt collectors who exploit desperate consumers and break the law pay a price for their behavior. In this case, we?re pleased that consumers who paid on payday loans will receive full restitution and that Bella will receive heavy penalties,? said Attorney General Schneiderman. ?With this action and many others, my office will continue to fight to protect New Yorkers from illegal business practices and stop companies that seek to prey upon consumers facing tough economic times."

Since November 2008, Joseph Bella has operated various debt collection companies in the Buffalo area, including Check Systems, LLC; Interchex Systems, LLC; Goldberg Maxwell, LLC; Mullins & Kane, LLC; Morgan Jackson, LLC, and National Check Registry, LLC, that the Attorney General found had repeatedly violated the federal Fair Debt Collection Practices Act. Bella operated several of these companies on a one-at-a-time basis for very short periods, usually for less than six months. Then, he would shut the companies down and began operations under a new name.

Bella?s debt collection companies routinely sent Verification of Employment forms to the employers of consumers. Federal law, however, strictly prohibits debt collectors from communicating with employers except to obtain location information about the employee. Bella?s debt collection companies illegally sought information about consumers, including their consumer's Social Security numbers, hourly wages, dates of hire, and information on whether their consumer's wages were being garnished. The form improperly implied that the Bella debt collection companies would garnish the wages of consumers even though they had never obtained judgments against the consumers and, therefore, had no authority to do so.

Bella?s debt collection companies also routinely violated the law by sending letters to consumers under the name of an attorney, M. Robert Madia. Madia, however, did not have any direct personal involvement in the sending of the letters; had not reviewed the consumers' files before the letters were sent; had not determined that the letters should be sent, and did not know the identities of the consumers to whom the letters had been sent. Indeed, despite the fact that Bella terminated Madia in November 2012, as late as February 2013, one of his companies continued to send letters to consumers from Faith Galloway, Legal Assistant, that, according to the letters, were copied to the terminated Madia.

Finally, Bella?s companies collected on, or attempted to collect on, payday loans from New York State residents. Payday loans are a type of short-term borrowing in which an individual borrows a small amount at a very high rate of interest, often 450 percent or more. These loans are also called cash advance loans or check advance loans. Payday loans are illegal in New York State.

This matter was handled by Assistant Attorneys General James Morrissey and Michael Russo, and Senior Consumer Frauds Representative Karen Davis, under the supervision of Martin J. Mack, Executive Deputy Attorney General for Regional Affairs.

You have the correct fax number - I've tried it, and it works. And if these so-called people have told your work colleagues about your situation, then you have grounds to sue. I'm not suggesting that you do so, but I am suggesting that you write a very nasty, but professional sounding, letter in which you state that the company has violated your privacy, as regulated by debt collection practices of the US. If they've threatened you with a false docket number, or being served with papers, you can add to your letter that you are reporting them to your state's Attorney General's office for impersonation of a law enforcement officer (a crime,) for deliberate misrepresentation of the firm's true identity, and in general, attempts to threaten and intimidate you into paying. Request that they send you a written verification of debt, as per the fair debt collections regulations in the US, and pick a lawyer's name out of the phone book, and tell them to refer all further correspondence to this attorney. And make sure you tell them that you are recording all further conversations, as proof of their intimidation practices. Know you rights!

im am reporting a scam that took me for $500.00.  there number is 19722327105 and 19726748307 there names were mark johnston and joseph stone.  They must have taped into the system because they informed me that they were collectors of a payday company with sandpoint and sds procesing and was collecting for them.  since i know i possibly owed these two companies i paid and got scammed.  i never received a confirmation of my payments in the mail as requested or on my email.  Now when i try to contact them, both numbers are disconnected.  I am unemployed and could not spare any money at this time but they threatened me and said i would have to go to court and have to pay more cost.  I really hate them for that and more of myself because i got my unemployment money taken from me.  They kept calling my mother first and in turn i would call them from the message my mother would give to me.  It made my mother scared and she really old. The have caused me to be sick at my stomach.  I really hate these scammers that take peoples money knowing everyone needs everything they receive.  Im so made because im a single mother trying to get my son to college and now this.  They really hurt me.  If theres a rich person out there that would help me with getting my son to college please help.  I really need it.  my email  is  mitwk17@gmail.com

This group called mullins and kane try to collect  pd loan that was paid in 2007 i believe this company and acs group are connected some kind of way they are very rude and threatening i have already reported both to my states attorney. Beware do not give them any info because they are a scam.They have called my parents my job and my home over and over. They play mind games on those with a great level of integrity.Also they will try to scare you with you will be served and have to appear in court.
Look for these numbers also 888-836-2736, 214-919-4183, 214-919-4138. The same person will contact you with different names be aware and report them.In closing they never will send a bill through the mail they only send emails with no return addresses and there bills look like something made on the computer at home.

A guy named Larrious Hayes called and said we owed money and he was from litigation dept.  He kept trying to get ssn and we wouldn't budge.  He then asked my hubby birthdate and he gave it out....supposedly they were looking for somebody older.  They called back again saying they found the correct ssn.  Yesterday, received a call from Goldberg and Maxwell from Mr. Brown but with a 262 area code.  It was that Hayes guy...does he think I am dumb?

These people have apparently changed their number. I received a call from someone claiming to be John Lewis from Mullins & Kane. The number is 262-432-9204; however "Mr. Lewis" transposed the numbers in the voice mail message. I figured he was bogus because he only gave info that anyone could retrieve from any unsecure website. I thonk I've learned my lesson about online searches using name, phome numbers and socials, even if the site is "secure".

I received a call today from this company shwing on my id as 972-532-0086 and was left a detailed message about being summond for check fraud in denton county texas if I did not call and settle before further action was taken, i do not belive it is right to call and leave such a detailed message on a voicemail if these people don't know this is the correct party they are trying to reach.

Mullins and Kane IS A SCAM!!! My husband got a call. they got ahold of his ex girlfriend ...BE AWARE!!! SCAMMERS and anyone can pay to look at your information and scam you into this bull crap. I am so mad! Don't fall for it.  The number they called us on was 214-919-4134. ASK QUESTIONS. True proffesionals will not call and email you information. You will get a verifiable letter! Also, when you ask questions they will not be rude and overbearing. If I could I would kick these guys A*! all the way back to New York or Dallas or where ever they are! DON'T FALL FOR IT PEOPLE! Dont let them bully you into this poop!!

this guy has called me at home, at work, more than once a day, relentlessly.  i finally ave told him it is against the law in the state of massachusetts to call my employers (he has left voicemails with 3 colleagues, including - the latest - my boss). I do not owe anything!!

I am beyong irate and am thinking of suing them. This is a TOTAL ABSOLUTELY SCAM.  I'm furious. i am not going to be bullied by scam artists. Their earlier callers said things like "don;t make me come up there" - they claim to know where i live and work and yet not once have they attempted to deliver a certified letter.

It is RIDICULOUS and SHADY.  I plan to report this firm to the Attorney General of Massachusetts

It looks like these scammers are back at it again. Received an extremely bad message today stating that I had written a bad check and that they wanted to keep this out of the courts. Said that they were going to file some sort of law suit against me in Pima County AZ. I live in Montana The individual that called me left a name of Ryan Jersey.  Using phone number 214-919-4134. Caller ID says, "Dallas TX 972-863-0925" (& MANY OTHER NUMBERS WITH THIS PREFIX AND LIKELY OTHERS) (see below, they could be anywhere, even terrorists out of the country!) & guy called a family member to, "verify" my information, called my cell & left a message about, "multiple complaints" (didn't specify what 'complaints', yet said he was an attorney working with the commonwealth of my area... LOL, we don't have those where I live!)

Whoever these people or this person is, they've been busy & are using multiple phone numbers from apparently the same ISP.

This IS a scam known well by the FBI (It was on the 1st page I brought up on a google search for scams & appears, from the info they have, to be connected to a data electronic break-in that was done to a hospital I had been to. This family member's cell has never been used for any other purpose, except for emergencies & for myself and family to call.

Checked out the phone number & it comes back to a VoIP service that is owned by http://bandwidth.com/

"New Variation on Telephone Collection Scam Related to Delinquent Payday Loans

02/21/12?The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.

Callers pose as representatives of the FBI, ?Federal Legislative Department,? various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim?s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.

The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim?s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it?s the latter, the caller tells the victim that he or she is wanted for hacking into a business? computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.

The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim?s job. In another instance, a phony process server came to a victim?s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.

If you are contacted by someone who is trying to collect a debt that you do not owe, you should:

Contact your local law enforcement agencies if you feel you are in immediate danger;
Contact your bank(s) and credit card companies;
Contact the three major credit bureaus and request an alert be put on your file;
If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
File a complaint at www.IC3.gov ."

There are those of us who don't have a debt, that these ppl are illegally contacting relatives, neighbors, etc., telling them that they NEED to "verify" information regarding a debt, asking for even more information, yet will not say what these "complaints" are about & with absolutely NO notice, a request to call the same day, yet some of us aren't home, and that you MUST call back w/in 24 hours???

IF these were real debt collectors, they have to follow certain protocols & invading a person's privacy, telling others there is a debt at all, or there is a debt collection at all is not only unprofessional, it is illegal! (I was a bill collector, an ethical & legal one - what happened today was NOT legal!)

Lannie, ask yourself if it would be OK if someone broke into a computer at your local hospital or these new "ACOs" that are obtaining information illegally, took your information by hacking into the system, or illegally through an "ACO" who lied to the federal government to get your info, the made up some BS about a debt, told your family, neighbor & landlord that they are calling about a debt & never once notified you about it?

I have no outstanding bills, I don't own property or much else b/c my health & was told today that I don't have a whole lot more time left on this body.

I pray you young people start taking lessons from those who fought the capitalists facious SOBs, learn how to stop the oil companies, insurance companies, etc. from price gouging, get back price controls on necessary items & save this country!

Learn the Constitution, the Bill of Rights, take these SOBs to task, write bills, become a public servant, get new, better laws on the market & IF anything is a requirement to life, liberty, and/or is made law that you "must buy" something, such as insurance, that you be sure there are laws to cap what they can charge & ENFORCEABLE laws that shut them down immediately should they step over the line...

If insurance companies aren't paying fairly on their claims, then they need to be shut down  & their representatives, adjusters, etc. need to go to jail. (BTW, it's likely the electronic "break-in" at 2 local hospitals where my info was compromised was VERY likely contracted out by an insurance company, many of which are NOT US controlled & often are controlled by those from the middle east, India & surrounding countries, known to deal with terrorist.)

Americans need to wake the he** up!

If you need money, DO NOT take out those ultra-high interest loans, or payday loans! There are food pantries, places that can help you with rent, food, utilities, etc. & are generally connected to your community's churches, synagogues & so on! (I know, I used to be a volunteer & no one ever went home from us hungry!)

We need to take care of each other!!!

I've been concerned about this younger generation not seeming to care about education, many not even taking advantage of the education that is available to them at community colleges or taking classes that are easy, just to "slide by" to get some money for the short-term, or worse, using it for drugs, the latest designer whatever, etc.

Ppl., PLEASE! If you are taking out ANY loans, be sure it is for an investment in your future! You need an education, yet even then, you can get through a community college some time with grants & such through http://www.fafsa.ed.gov/ , BOGG grants (ANY community college's financial aid office can help you with this!)

PLEASE take your education seriously, learn something YOU love & find a way to make a living doing so, have a plan B, plan C & so on!

Take challenging classes, get off the social networking crap for games & use those venues to expand your horizons, connect with others with similar interests & don't expect anyone to do for you, but find ways to do what is best for you & your fellow man. If you aren't doing your best, then you're part of a problem!

Take difficult classes like biology, chemistry, physics, math, writing composition, a foreign language, turn the darn TV off, which is someone else's vision & turn on your own vision! Go see what is really in the world, NOT what someone tells you is!

Lannie dear, Where did you get the idea that anyone owes these people anything, and even if they did, ask yourself what is the difference between a "Pay Day loan" and a loan shark? IF there was a legitimate contract, then why the illegitimate & illegal ways of collecting them?

IF these were real loans, then they would send a letter demanding payment, give the respondent an opportunity to dispute their claim, etc. & IF these were legitimate, it would go through collections, then be taken to court. I know I helped a relative get off the revolving door of these & paid his debt to get through his wife's illness & ultimately her death.

We ALL need to step in & help those who need our help & keep our family & friends out of those types of things, but getting back to what these calls are all about, they clearly aren't about that, as I've never made a loan with a place such as these, nor do I owe any loans at all at the moment, thankfully not even a medical bill, yet I DID get a couple in error (this seems to be getting more common, yet if you call them, they'll tell you to disregard the notice, if you pay it, you'll never see that money again! -

Someone needs to make change in our country for the betterment of everyone, get rid of the paper-pushing BS jobs that are unnecessary, create laws making mandatory & life-sustaining &/or wellness, job sustaining things in life (price & paperwork) minimal, have price caps on these, such as gasoline, auto & home insurance, food, heating in the winter & cooling in the summer affordable & price capped, just like utilities were in the past.

Corporations have made this necessary for our country's well-being.

The less regulated these things have come, the worse our economy! Everyone should be able to get an education, a well-paying job in a field of our choosing, where we can work hard & enjoy it, have goals of our own that coincide with that of the best for everyone.We DO need persons to discover what is needed for our infrastructure to keep America running well, and at this point, insurance & generally oil companies and the stock market have every interest in keeping Americans ignorant, and children's and adult college curriculua have been "dumbed down", so many countries have far passed this generation up & without Americans getting off their rear-ends and making an effort to educate themselves, we're going to become a 3rd world country.

As for these ppl pulling this scam, they need to go to jail. Clearly there is illegal activity going on here from these people making these calls.

I can say it paled in comparison to the other news I got today - that I'm dying & don't have a lot of time left to live.

I hope I see some young Americans in the little time I have left start getting off their rear-ends & deciding to become the next leaders taking us into space, building better homes, bridges that can withstand earthquakes, hurricanes and tornadoes, take more experiments to space, find cures for viruses, working out every day, breaking records in the Olympics, building things better, finding new things to build, protecting our environment and learning & creating new ways to use our resources responsibly, to take care of each other, but not by "babying" each other, yet by taking on challenges & being supportive of one another by coming up with solutions.

We have to quit babying each other w/ insurance if we drop a cell phone, get into a car accident, etc. and learn to be RESPONSIBLE for each other & do things carefully! We don't need regulations on what we can & can't do, and a herd of lawyers to ask if we can go pee! We need to take charge and stop treating children like babies, guiding them into their aspirations, yet they'll never learn those things if we force them into things we want for them, or buy baby-like chemistry sets. I was appalled that we had to have a law that strollers had to have a tag on them to tell a parent that folding up a baby in a stroller could cause injuries or death! If a parent is THAT stupid, perhaps we should give the kid a Darwin Award or put the child into more competent hands!

We used many chemicals, read the books & knew that yes! we could, if not careful blow off or burn a hand, or worse with our chemistry sets when we were kids! We went shooting, we built very sound tree houses from an engineering standpoint, and before those some not so great, yet we learned from them! We did experiments from recipes in the kitchen to making our own fireworks for the 4th of July, yet laws that are supposed to "protect the public" have only served to make us all FAR less brighter than those in other countries & than previous generations here in the US.

Young people, it is up to you to put a stop to the automated, computerized society. Computers were meant to make things easier, yet if we lost our power grid & all power, had no truck deliveries, trains, no computers in our cars & so on, could you survive?

If your cell phone or computer had a hardware failure & you needed to fix it without replacing it, could you do that? Could you find good food in your area? In a forest? In the ocean?

Would you know how much fish, stones of certain types used for steel, aluminum, etc. could be used without depleting a natural resource? (OK, use your computers for that one! Perhaps some SCUBA gear & a geology degree as well for the aluminum question - Hint: bauxite )

We've made a country full of ppl who are babied by technology, yet have little to no idea, for the most part, how to use that technology, other than to abuse & use others, lie about environmental impact reports, etc. & all from an armchair, yet they could do FAR better being out in the REAL world seeing the REAL impact of things!

Please don't follow the TV & computer game filled world of becoming an idiot! Technology CAN BE wonderful & an occasional game isn't going to rot your brain, yet day in, day out being on the computer & reading crap online, a LOT of which isn't true, Although much is & is helpful in some cases to understand things or give a fresh perspective, yet without living outside of other people's visions via TV, the Internet, DVDs, radio, etc. is really not living at all.

I hope we reward people for doing real-world things so we can get our country back!

Dump the TVs, computers, and even the radio & learn to listen to our REAL world & come up with things original! Be a human being, not a "bot" like these people who are calling clearly are!

Discovering I'll be gone soon gave me a whole different perspective than most I'm sure! I'll never buy another car or house, I'll do what I can, when I can, enjoy the little time I have left here & when ppl like this try to make things so serious, simply laugh in their faces, as they deserve. They don't have a life at all, and clearly nothing good can come from selling of other people's information, stalking & the like. I'll start the stalker/exploitation lawsuit, yet my family will likely have to finish it, I suppose it will depend on how long it takes to get through it all.

I'd suggest everyone who gets a call like I did to leave it the hands of a lawyer... I know I'm not going to spend what little time I have left on this peon that is trying to extort money, or information for money out of people.

It's sad, yet there are many who feel this is a way to make money & money has become their "God", or they're criminals that can't make a living any other way. A VERY sad way to live a life! I'm glad I really lived, and I will as much as I can until I'm gone!

These ppl need to be sued... I have no outstanding debts, even credit is all paid up 100%, although there are these new ACOs, or "accountable care organizations"

Always RECORD calls from them. Sue them for every violation of the FDCPA. Report them to the FTC, your attorney general and their attorney general. There is a great video about their scams from a person they attempted to victimize. Google Shlegdaddy vs Mullins and Kane. Demand validation of any debt from them. Record their calls, log their calls. File complaints. Sue. Even if they are calling for the wrong person, don't let them harass you. Sue 'em.

That 214 number keeps calling me too.  The guy even called my job, sent a fax to my HR department trying to get information and threatening to take me to court.  What a joke.  I told him I don't have a pay loan, but he keeps insisting and wanting my information.  Wow!

Got a  phone call on my cell number from a Candice Beckman  972-674-8301.   Said she was with a Law Firm that was going to file charges against me if I did not make payment arrangements immediatly.  Also said she was investigating a loan from 2007.  When I asked for there address, she said her computer was frozen and put me on hold.   I hung up.    
I have filed a complaint with the FTC.

They called and left a v/m for me saying I was 'the subject of an ongoing investigation, please call me immediately on 972-674-8301.... this is Investigator "x" and you have been notified'. When I called back, she wouldn't say what the company was or what they were investigating.  When I asked her if they were a collection agency and for her job title she told me she was a secretary and was trying to find my file.  When I told her I thought this sounded extremely suspect and to either tell me what the company does or I was hanging up, she hung up.

My husband got the same call today, with this "law firm" looking for me for a loan that was covered under my bankruptcy last year.  Told my husband that they filed two civil suits and a criminal suit against me and that he was a deputy with the Maricopa County Sheriff's office.  My husband called me all panicked.  I called both numbers that was left and the Mullins/Kane dirt bag thought he could scare me.  At first I told him who I was and he started yelling saying I was being rude and he wasnt going to put up with me, then hung up.  I called back and told him I was not being rude, just told him my name.  I tried to get the court case numbers(which I knew was scam) so I could go to the court myself and take care of it now. He started to yell again, then offered me the 50% off the total debt which I refused to pay.  He threaten me and so on.  I am sending them a cease letter on phone call communications and forwarding this to my US Bankruptcy court along to my trustee's office since he is breaking Federal Law.  Now for the guy who called saying he was a deputy with the sheriff's office, my husband filed a report with our local police department since its against any law to pose as law enforcement.  I looked the number and as with the lady above, it was a number for some company in Dallas TX, not a cell and certainly not a officer with AZ. you should look further into this a file a complaint.

I just had to start dealing with these people. All of my impressions are horrible of this place. They have yet to provide any sort of facts or truth to this debt. I have had to deal with other past debt collectors and nothing has been like this harassment. I filled a complaint against Mullins & Kane with the BBB. I hope people fight this company and can get something  done about it. I would be happy to join any sort of movement or class action suit against them.
