So ask your lawyers whether the provision in your contract that gets a debtor to promise not to file for bankruptcy protection "on this loan" is either legal or enforceable. I'd like to know. Really.

This is the voicemail that I got today from this number "Hi this message is intended for (ME) my name is Jessica Brikan giving you a call from the law office of legal mediation. Our office has been appointed to handle a case that has been filed against you. Your name has come up in an active criminal investigation and charges are currently being pursued against you in your county. Now I do need to speak with you about these charges and go over the accusations that have been made and to also get a statement from either yourself or your attorney prior to issues of a warrant that will be issued out for your arrest. Now the direct number here is 972-961-4921. When calling please refer to your case number (123456). So I then called back and the same lady answered the phone. Asked me for my information gave me part of the same social, wrong birthday, then sent me to a lead arbitrator. Who gave me a wrong address wrong information saying there was a warrant out on my social. Said that it was about a wells Fargo loan for $300.00 in 2011, said I don't have wells Fargo, never did she said and filed BK in January of 2013 "ok ma'am we will have someone pick you up, good luck" I then called back again and was told that I was being charged with ?Debt by deception, Malicious intending to fraud and Pass a worthless instrument thought a financial institution? Tried to get them to talk to my boss (who is an attorney) they threw a fit gave me the fax # 800-915-4187 saying they don?t give the address for security purposes. Every time I try to call and get information out of them they hang up on me.

First off the bulk of those provisions in those loan contracts are most likely against public policy and would not be enforced. Secondly it's extremely difficult to prove intent in these cases and I can't think of a single prosecutor, anywhere in the US who would file such charges. In any event, no one would be arrested. The matter would be worked out with the local prosecutor by plea agreement, that's assuming the prosecutor would do anything at all, an unlikely assumption. Every one should pay their debts, but some of these enforcement techniques are over the edge and some downright illegal.

If it is proven that the consumer intended default on the loan by giving a check or debit as collateral that was known to be invalid/ nsf can be prosecuted. Also, if it can be proven that prior to the taking out of the loan they visited a lawyer to consult about bankruptcies they can be prosecuted. Fact, just saying

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.
