A message was left on my business number by a Deputy Greg Rogers saying that I should call Officer Michael Black at this (202) 239-5284 number.  The caller ID listed a local sheriff's station.  Said that they were going to file a warrant out for the person who used to have this number and to please call back. So I called the number just to say that that individual doesn't have this number any more. Both the "cop" and the "IRS" guy had the same thick Indian accent.  It may have even been the same guy. SO annoying. Lame.

Debt Collector
I have been receiving calls this morning on my cell phone with the caller id stating it was my work calling me. They said they were at my place of employment to arrest me for a federal warrent. However, they stated they were from Illinois State Police (and I work in MO). Obviously, they are not at my place of employment, and I called the local police and they pretty much said there isn't much they can do. The man calling had a very foreign accent stated his name was Detective John Morrison, then John Williams and the arresting officer was going to be Mark Williams. When I called back, Mark Williams was an attorney.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Received a call from what looked like our local sheriff office stating that there was a warrant out for my arrest and I was to call this number - supposedly the dept of justice - and ask for attorney Daniel Obrien.
I was startled to say the least.  I called our local sheriff and asked about this - was transfered to the warrant division - they checked and found no warrant for my arrest.  Told them about the call and they said most likely a scam of some kind.  Upon further thinking about it...if it WAS real - the sheriff would have been at my door to arrest me - not calling to tell me!
I was going to call the number just to see what type of scam they were trying, but after reading some other posts, decided it may be more dangerous that what it would be worth.  Just beware!

got a call from my office, saying that the sheriff was going to come and arrest me, that i should give "Mark Williams" a call, both had thick accents, I kept asking me why I was being "arrested" on what "charges" and what department/office/state they were from. they got really frustrated with me, I was yelling back that they weren't answering my questions, so I hung up and ignored their calls. Can't believe they called my office first with this b***s***. Whatever you do, don't give them any info. I'm glad I didn't lose my cool, but their heavy indian accents is just obvious.

I got a call from phone number 202-239-5284 a man speaking indian accent left a message with this number and ext. 2058, and said his name was John Smith said Cash Advance, Cash America and also Direct Cash USA, and a warrant for my arrest by Louisiana State Police, for the next day.  I call back the number and asked for John Smith at the extension and it was busy. Then another indian speaking came on the line and did not explain nothing clearly who was supposed to be suing me. For money that was never loaned and deposit in my account, so I told him I will be calling Louisiana State Police myself, and will check my bank for suppose deposit money. He said the amount I am to be sued for was $4,800.00, then came up with another alternative to pay it off  in the amount of $651.00.

I just received a phone call that came in "Unknown" and a guy with an Indian accent was trying to tell me that there is a federal complaint against me in the state of Illinois and that I needed to call this number immediately or they were going to issue a warrant on me and have me arrested from my home or place of employment. He gave me this number to call and ask for Mark Williams. Well...I called it and "Mark Williams" with an Indian accent was trying to tell me there was a federal complaint (not sure what about because his accent was very hard to understand). He asked for my name and I gave him my first name only. He asked for my last and I said if there is a federal complaint against me, you should already have all of this information. I proceeded to argue with him and asked him, "Since when does a "Mark Williams" have an Indian accent?! I am very familiar with the "State of Illinois" and NONE of them have an accent like yours!  When you can get an ENGLISH speaking person on the phone, go ahead and give me a call."  and I hung up.  First of all, a FEDERAL COMPLAINT or WARRANT does NOT come from the State of Illinois. Idiots...

Just an FYI on another scam call. This # just called my husband accusing him of taking out a loan back in April, May or June (how would you not know which one) and said that since he hasn't repaid it (a whole $500) that he was going to be taken to court and would need to pay $18000. He also said that he was going to be served papers ant his place of employment which he had the information to and that he was going to be arrested, just so that my husband would be and example. Also told him that he was going to flag my husbands ss# so that he could never get a good job or buy anything. This guy had almost all of my husbands personal information. WATCH OUT!!!
