Charles Baker said that I owed on a loan that I did not even know the company he was taking about.
I would like to know how he got my information. He threatened to have me served at my place of employment. When I mentioned an attorney he replied that I didn't read the fine print. What fine print???

They called my phone leaving threats they'd have me served and arrested if I didn't respond within 48 hours. I never called because I knew it didn't sound right so they called my uncles and grandma harassing them even telling them if I didn't contact them by the next day they were filing charges against me and I'd go to jail. They left names like Tim Baker, Charles Baker and Andrew. When called I asked for address to give to my lawyer he said I don't have any rights and got furious and wouldn't give it to me nor tell me why they were harassing my family.  Sad thing the family members they called were never used as reference at all. They did people search and it gave people that may be relatives. Why did they get upset when I asked for their address?

Agree with all of you. This "Company" is definitely a scam. My son is an attorney and he tells me that a collections firm cannot sue anyone. They must refer the case to an attorney. Play them along a little then tell them to go to H- - - !! You will never hear from them again.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

sounds like you work for them...they are third party collectors that try and collect on old debts.  In my case, this was paid to the original creditor years ago during a refi and numerous companies have been sent the paperwork, and the original creditor is out of business. This Company even tried to send an ACH withdrawal through an old account, inactive for years, and BOA called to inform me. I would necessarily ignore them but handle the issues through the original creditor, you always have the right to do that....

Sean Jones has called and harassed me a work. He has threatened to serve me with papers and I told him that I paid off my loan. I asked for his email or fax number to send a copy of my bank statement proving the payments almost a year ago. But after reading this site, I'm not sending anything. He call my husbands cell and I'm not sure if he is calling anyone else. Since I have his email address should I email a letter formally request that he cease any additional calls to my contacts and mail me documents?

These people are nothing but a scam.  I actually did talk to my attorney about the callers and company.  He suggested to have them send him something in writing.  When I requested it from Adam Southern, he was very furious and refused.  Don't fall for this scam people.  Send them nothing or request it in writing.

and in response to the so called attorney, of course they will settle, you don't owe them any money so they take what they can get.

I actually did not receive any calls from this company, but 'Brad Sutton", from RJA Capital has managed to leave messages about me with just about all my friends and family, not sure how he got their phone numbers, but he did. I called him this morning to find out who he was, and why he was looking for me, the call back number he left is: 607-231-8060...He has got to be the most unprofessional person I have ever came across, screaming at me, threatening me..I explained to him that I honestly had no idea about any of the information he was trying to give me, and to please send me some information by mail, and mentioned my rights under the FDCPA, I think that is what set him off, he proceeded to scream over me, not letting me speak at all, and basically told me that the sheriff would be contacting me, and good luck. If "Brad", and "RJA Capital" was legitimate, they would not need to use threats to intimidate people into paying them, and they would have absolutely no problem sending the information by mail. I am 100% sure that I don't owe any outstanding debt, and I have not written any "bad checks" as he tried to claim.
Is this guy for real?? I'm sure he "scares" a lot of people to paying him, but seriously?? How could anyone really think this guy, and this company is for real??

@Monica, um NO, they are NOT legit.  They just think they are.  Google it, they have already been shut down numerous times.  These people are SCAMMERS.  Don't pay them anything, they can't and won't serve you and you CANNOT go to jail.  This has nothing to do with bad checks, they collect on payday loans that were defaulted on.

Ask for DV.  Trust me, they won't give it.  My response "sue me".......it will never happen and if it does I will win as they threaten to sue for check fraud which is NOT legal when it is a payday loan.

Any attorney will tell you that.

Funny how these have only *just* started showing up this summer. I have gotten two calls now within the past week from different people claiming to be from "RCA Capital" as well, and I know good and well that no checks that I have written lately have bounced; and then also the county that the person has claimed to say that there is a complaint with a certain person is a county in which I *have* BEEN THROUGH BRIEFLY lately, but had no interactions with any people, there. Only thing I bought was gas.

It's a legitimate company called RJA Capital. They are an arbitration firm. If you bounced a check through your bank, the creditor can come after you and if they cannot resolve the matter, they will in turn go to a law firm such as RAJ Capital to have you served at work or home. If your served, you have to go to court regarding the debt. If your not served, b/c you have called them back within 48 hours, they will work with you to get the debt paid off at a lesser amount than what you would be sued for in court. I wouldn't disregard their call.

I just received a phone call from this number. He left a msg stating that his name was Mr. Brock(no first name was given)and a complaint was reported using the last four of my ssn. I needed to call him back within 48hrs or it would be reported to my local count courthouse. He gave no first name nor his employer and his voicemail is the same way. If he legit a full name, employers name,and explanation of complaint would be given. His number is now on call block!

Who ever it is just called me. Left voicemail saying they hve recieved a complaint in their office about me. If they don't hear back from me within 48 hours then... Something about taking action with my current employer or something like that. Strange thing was that he did not leave a name for himself, nor who he worked for. But had my name, last 4 of my SSN, and a county that I haven't lived in-in almost 3 years.  I'm not calling back lol. No ID of the person, no call back from me.
