Actually- statute of limitations is an affirmative defense, meaning that the individual may acknowledge that a debt was owed, but the SOL bars the company from recovery.   The company can still sue, but the SOL bars them from recovering.  The debt may not go away but the SOL bars recovery. It's a subtle but important difference.

Source RM appears to be a bottom feeder dealing at least to some degree in junk debt.  

They are aggressive callers and use Broadvoice communications.  They are unswayed by the truth in caller id act, and your caller id will normally have either a city name, or "Broadvoice", the name of their phone carrier.  

If you try to call them back, you may appear not to get through, although it is more likely that they are just creating the appearance of a failed call. Your call may be logged by their computer. If you get a person, it is difficult to get any information from the collectors, but the info you need is posted below.

I got a call from this company telling me that 4 yrs ago, I was in Best buy, returned and item and got a refund and then supposedly i picked up the item and walked out with it. They say I owe $128.00 for this. For one, even if I did return something to Best Buy, I would not have walked off with the merchandise. Two: wouldn't Best buy have contact local Law Enforcement to at least file a report for the "theft". Also, again, if I returned something using my card, why would I then proceed to "walk off" with it when they have my card info and know who I am? What a scam!

This is a collection company that is less than forthcoming.  They appear to enjoy harrassing others but unwilling to give identifiacation upon request I have legal representation sending a letter to them. Very rude people.

Bogus debt collection agencies, online dating chat robots, and an "Energy Department refund": Internet ScamBusters™ #263

Before we tell you about today's three Snippets, we wanted to draw your attention to Snippet #2, because it is part of a whole new class of scams that we think will grow exponentially over the next year.

Although this scam will most likely not hit countries other than Russia until February, be sure you check it out -- even if you never visit online dating sites. That's because although this scam is starting via online dating, it will soon move to other venues.

Beware Fake Debt Collection Agencies

Aside from vampires, werewolves and zombies, debt collectors are among the scariest creatures ever conjured by the human mind. Just kidding -- sort of.

We say "sort of" because some scammers are using people's fear of being labeled "deadbeats" to extort money from honest, creditworthy consumers.

Posing as a collection agency representative, the con artist will contact a victim by mail, email or telephone, claiming the person owes a specific dollar amount to a particular company.

To convince victims to wire money to pay the "delinquent accounts," scammers will threaten to report "overdue bills" to credit bureaus, take some form of legal action or even drain money from victims' bank accounts without their consent.

Ironically, real "deadbeats" probably wouldn't fall for this scam, since they have no intention of repaying their creditors. But upright citizens may doubt themselves, thinking they've forgotten to pay a bill.

And, because the sums involved tend to be fairly small, some people may be tempted to just pay the "bill" and "get it over with."

These scams often come to light only when the debtor contacts the creditor and asks to re-establish a relationship and is told the debt must be repaid before any consideration will be given to re-establishing a business relationship. When the debtor tells the creditor the debt has been paid, things start to get interesting.
Typically, the creditor contacts the agency and:

   * The agency denies receiving payment
   * The agency is out of business or has moved, or

The agency admits receiving the money but due to a clerical error, they were unable to determine which of their clients was owed the money.

In any of these scenarios, if your collection agency does not immediately disgorge the payments it has received then the creditor must pursue payment as they would with any other delinquent debtor.

Ironically, the credit manager may never learn that the debt has been repaid, and without this information there is no reason to question the collection agency about the status of payment.

One final note: A collection agency can also defraud creditors by failing to remit collected payments promptly - this earning interest on your company's money. Your contract with the collection agency should always specify the maximum amount of time the agency may hold onto your money before issuing payment - as well as the penalties for failing to send payments on time.

I just got a call from 336-558-4900. They left no message this time. The call before this they left a message with a reference number telling me that this is not a sales call. They don't say who they are or where they are calling from. What can be done about this??

This # has been calling a lot.  I finally stayed on the line and it said a rep is not avialble please call again.  I just got a phone call call back from a strange man Mr. Duffell (sp?) and he wouldn't identify where he is from.
