Have had multiple calls from this number with the same threatening message. Just calm down, folks, and do your research. Many scam "companies" will buy what are known as ghost debts for pennies on the dollar. They are called ghost debts when they are beyond your state's statute of limitations for collection, 5 years in most cases. They cannot arrest you, or file criminal charges. A debt is a civil matter, not a criminal one. They rely on fear tactics to get people to pay them money they don't legally have to pay anymore. Just do as I did, turn them in to your state attorney generals office, and ignore their threats.

I just got a call from this # 7pm left message saying that they recived 2 cival complaints that were being filed against me and that they could serve me at work or at home then left # to call. then end of message said you have been served! I called #  2 times and it just rang then said sorry the person on ex9101 is on the phone!  what the heck!!!!!!!! I just filed chapt 7 in jan. Tring to build my credit up. so far so good. what the heck is this?

I had a message from this number yesterday and it was very detailed about a summons and complaint being sent to me at work or at home and that I needed to call the legal department at the same number. They mentioned in the recording that charges were being filed against me for fraud. I called the number back and spoke with a man who was extremely rude to me and refused to tell me the name of the company or anything until I verified the case number left on the recording and the last 4 of my social. I did this and then he told me 2 charges were being filed against me, one for fraud and one for breach of contract over a payday loan from 2006. I had some financial problems back then for a little while and apparently missed paying one of them back. But really they can't sue me for this since it is from so long ago. The statute of limitations in Idaho, where I live, is 5 years for a written contract. I filed a complaint with the Consumer Financial Protection Bureau @ www.consumerfinance.gov. I did include the voicemail message that they left me. They said that in order to process my complaint I needed the name of the company that was calling me. I attempted to call them again and was treated very rudely by a "Mr. Riley". I don't believe that was really his name. He said the company is called Pre Trial Processing out of San Diego, CA. He refused to give me a mailing address for me to send a letter. He said all they do is take payments and send summons and complaints. I asked him how he is planning to have me sued for something that is out of statute? He said he never said sue. I told him that's what it means when you get a summons and complaint. He said since I know his job better than him then I have no need to talk to him, and I will get sued and hung up on me. I reported the information I had to the Consumer Financial Protection Bureau and the very nice woman I spoke to there said my complaint would be filed. I recommend that everyone going through this with this company file a complaint there also. It's not right for them to be violating the FDCPA and being abusive and scaring people into paying something. You catch more flies with honey, you know.

I received a message from this number yesterday. Same thing. I knew it was fraud because I know I do not have any outstanding debts. The people can't tell me what charges I supposedly have without me giving them my social security number. Yeah, good luck buddy.... I filed a complaint with consumer finance and the FTC.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. I tried to file a report with the FCC and the FTC but none of the forms seemed to apply to this situation. I also just called one of my credit card companies and they said that the info I gave them wasn't enough for them to open any accounts but I'd like to report them anyway just to be safe.

Read the posts on page one from Alfalfa and my own post. Report them, then, your entitled to a once a year free credit report. If these losers have any of your personal information such as your social security number, date of birth or drivers license make sure you register with identity protection notify the credit agencies as well as your banks!!

I received a call from this number today. I called back because the voice mail freaked me out. I spoke to a woman named "Mary", she asked for my case number, the last four digits of my SS number and what number I was calling from. Then she hung up on me. I called he right back and she said it was a case of mistaken ID and that they were looking for someone else. Now I'm really concerned as they have my phone number and the last four digits of my SS number. I don't know if they can do anything with that info but it worries me and I feel really stupid for falling for it. Not sure what to do now.

Ok!........tried earlier to return this call, with no answer....reported the number to the FTC.....just called the number to inform them of my actions and not to call me again....wouldn't ya know a woman answered and when asked what company she was representing, she "mumbled" she was a debt collection summons processing division liaison....I informed her that I've reported their number to the FTC, and via the net they were a scam.....she sarcastically retorted "THATS GOOD, NEX t time you take out a LoAN,  PAY IT!"......I said ur full of $@!+, and to call my attorney.

A woman from this number (385) 232-7068 contacted me indicating I was going to be served at my home or place of employment.  I contacted the number back wanting to find out what it was regarding because it seemed odd.  The woman that answered was reluctant to tell me her name, but she eventually said her name was Ms. Philips.  She claimed I had a defaulted payday loan which I told her I had no knowledge of and she insisted I was the individual living in Virginia with this debt.  After politely telling her she was full of crap, she laughed and the call was disconnected.  THIS IS A FRAUD!  BEWARE AND DON'T GIVE OUT ANY INFORMATION.  I WOULDN'T EVEN BOTHER CALLING THE NUMBER BACK.

Just received this call, said the name Mischa Clark in the recording,and so informed me of the two fraudulent charges being filed against me.  Then referred my case number and the return number to call.....wtf is absolutely the best remark!!!

I got a voicemail from this number saying the same thing, called back they asked for the case number (left it on my voicemail) I gave it to them and she was like 'hollddddd on let me see, have you ever heard of such and such?' I said 'No I have not idea what you are talking about' she said 'hold on let me go get the file', she put me on hold and then I was hung up on! I called back 6 times and someone would pick up the phone and immediately hang up! WTF!!

A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.

If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers.

I just got a call from this number. No message was left. I get a lot of calls from Payday loan collectors so I assumed it was something like that. What gets me is there's nothing on my credit reports. I'm getting sick of dealing with these guys.
