I know Mr. Broughton, very well and he would have never said what the person who called themself "pissed" said.  This man is an upstanding and a model citizen.  He would never cross the line in the way that this person fabricated on this site.  You can always tell when a person owes a debt they start hollering and cackling like the loudest hen in the house.  If you pay your bills and stop stealing money from everyone else you would not be in these situations and you would have no reason to lie on good people.  I feel sorry for you dead beats that don't pay your bills and sadly your parents seemingly did a poor job of bringing you up and teaching you the diffrence between right and wrong,  Shame on you for disgracing your parents like that.  My advice to you deadbeats is to PAY YOUR BILLS AND SHUT THE HELL UP!!!!!!!!   I AM SICK OF LISTENING TO YOU!!!!!

I had set-up a payment plan and was 6 months into the plan, when I noticed a change in the name on my bank statement.  That's the only reason...I know anything about what is going on with Nelson, Hirsch & Associates

After I found this out, I contacted the original business and found out that NH&A wasn't even the collection agency that had been given the debt.  It appears the National Credit Adjusters (NCA) was given the collection but somehow NH&A got my information...I am unable to reach NCA via phone, it just rings, puts me through voice prompts, puts me on hold and eventually drops the call.

The company name on my bank statement was Aaron, Everett & Meyers and come to find out was established in 7/2011 by Gordon M Berger, an attorney with:

The press release as of November 8, 2011 in the comment above, pretty much says she is out of business but it appears to me that the business has been sold...so what does that mean to me? Only time will tell!

ATLANTA, GA ? Nelson, Hirsch & Associates, Inc., a Georgia debt collections company, and its owner, Tanya Santiago, have entered into an Assurance of Voluntary Compliance with the Governor?s Office of Consumer Protection (OCP), resolving charges that the company committed multiple violations of the federal Fair Debt Collection Practices Act and the Georgia Fair Business Practices Act. OCP?s investigation stemmed from a series of reports from consumers that Nelson, Hirsch & Associates harassed and deceived them by:
?Failing to disclose that it was a debt collector attempting to collect a debt;
?Threatening consumers with arrest, imprisonment or charges of fraud if they did not pay the debt;
?Refusing to send consumers written proof of the debt owed;
?Collecting more than the amount owed or authorized;
?Threatening to call the consumer?s employer and have the consumer?s wages garnished;
?Falsely representing to consumers that it was affiliated with a law firm and/or that the caller was a fraud investigator;
?Continuing to contact consumers even after they told the company to stop calling them;
?Calling consumers at unusual hours (e.g. before 8:00am or after 9:00pm);
?Calling consumers at work when they knew their employers prohibited such contact;
?Speaking to consumers in a harassing and abusive manner;
?Threatening consumers? family members;
?Calling repeatedly (sometimes as much as 50 times a day)

Under the Assurance, Nelson, Hirsch & Associates and Ms. Santiago are required to cease business operations. Further, Ms. Santiago must refrain from engaging in any aspect of debt collection activities in Georgia or in connection with Georgia consumers for a period of at least five years. In addition, the company and Ms. Santiago will forego collection of 5,809 consumer accounts that they had purchased from creditors who had previously written off the debts. These accounts total $4,307,658. The company must also pay a $26,000 civil penalty and reimburse OCP for investigative and legal expenses in the amount of $24,000.

?We are sending a strong and clear message that this kind of abuse and harassment of consumers, and the egregious disregard for the law that these practices typify will not be tolerated,? says John Sours, Administrator of the Governor?s Office of Consumer Protection.

Read the pay day loan laws of your respective state. Google them then you can make an informed decission and comment.
The company discussed, are good at intimidation, if not, I'm sure I would have been sued back in 2009. The account was settled for a lot less and not with that company. Check the pay loan laws, read them, that is the only way to protect yourself. Things will get better, they are. But don't let anyone intimidate you.

If u receive a call from this company,just hang up or tell them not to call you anymore.fdcpa states that if you tell them not to call you anymore,then they should stop.if it continue,then call the consumer debt collection and filed suit,don't pay them a penny.past this message on to someone else!they can't do anything to you,so stop being a victim,this loan will not go on your credit,just pull your credit report.

couldn't tell me from who, how much the loan was for, or when was it deposited.  I asked
them to send me this information have not heard from them since.  They said it would show

At best, it would be small claims. They tried the fraud crap with me and I was dumb enough to start paying. This was in my ex husband's name but they were hounding me. They even called my grandmother and we don't have the same last name. I was paying through a credit card, and all of a sudden, they stopped collecting. Then 8 months later, they started calling again giving me grief because I was no longer paying. I told them to shove it. They have started calling again from an in state number, actually a few different ones, even though they are in Georgia. They also claim to be an other company called Eastern Legal or something similar.

I received a call from Rosenthal, Stein & Assoc. a few days ago. They also called my father. Funny thing is that the number is not published and he has only had it a few months.  I called the number back a was connected to an "Agent Yolanda" She claimed to be a criminal investigator on behalf of some processing company that apparently believes I took out two payday loans in 2007. They provided me with little information of the claim they were making but get ramping up threats of having me prosecuted and sued civilly.  I asked them directly if they were a police agency or some type of law enforcement and she just began to talk over me. I asked for a supervisor and she put on an "Agent Baxter" who was a bigger a***ole than she was because I had the audacity to ask for them.  Long story short is that they do not know who they were messing with. I work in the criminal justice field. I told them over the phone while I knew they were recording me of the numerous felony violations that they were committing and the violations of the FDCPA of 1997. I explained to them that repeated violations would result in an $11000 fine for each time they attempted to contact me by phone.  The main issue here is that this so called company's bully and scare tactics are well documented on the internet, attorney's general offices,and with local police depts.  To even insinuate that you are a police investigator is a felony in my state. I am preparing a formal criminal complaint with my local D.A.  I also know most of the prosecutors and they will pursue this for me. I ultimately told them to mail the information that they claimed to have a warned them again to not pretend to be police officers. This company is in a lot of trouble. I just found that in my state there are already 34 complaints with the attorney general and a formal criminal inquiry is under way.

President signs bankruptcy bill
What you should know about a new law that will make it tougher for consumers to clear their debts.So, experts say, if you were thinking about filing for bankruptcy, you might think twice -- or act twice as quickly, since major provisions of the law will go into effect six months from the day the law is signed. Under the new law, fewer people will be allowed to file under Chapter 7; more will be forced to file under Chapter 13. Lawmakers who favor the legislation argue that it will prevent consumers from abusing the bankruptcy laws using them to clear debts that they can afford to pay.

I think this is great start to try and bring our country out of this ridiculous  deficit. It also gives the consumer the opportunity to settle the claim for less than the actual amount owed if the claim remains with an agency. Let's face it no one wants to be forced on a payment plan for years on end. Food for Thought

Ok I think we all know by now that this is not a fraudulent company by any stretch of the matter. It may have some unscrupulous characters but by no means is it fraudulent.  Those taking the loans know you owe and those calling are doing their job. Here's a little something to think about: In the office, calls come in from frantic people who wonder why their pay checks are being garnished. A wage garnishment is an order from the court (called a 'writ') that orders the employer to withhold a portion of the employee's paycheck. The employer is then ordered to send that withholding to the creditor. In Washington state and many other states, creditors are allowed to garnish up to 25% of the debtor's net pay (after taxes). To someone who makes $45,000/year (gross pay), it could mean $800/month is garnished.

How does this happen?

The collection process is pretty standard. When you stop making payments toward your debt:

  1. You'll get calls and letters from the bank/creditor telling you that you're delinquent.
  2. After 2-3 months without success, the debt is sold to a collection agency (aka "third-party creditor").
  3. Depending on how aggressive the collection agency is, the debt can either be sold to another collection agency or simply assigned to a local attorney to enforce the contract.
  4. If the attorney takes the case, he/she will file a lawsuit against the debtor.
  5. In most cases, the debtor has no legal grounds to fight the lawsuit. If so, the court will grant a judgment against the debtor.
  6. The creditor then takes the judgment and ask the court for a 'writ of garnishment'. The writ is served to the employer and garnishment begins.
  7. The creditor may also ask the court for a 'writ to levy' (or 'writ of attachment'), these terms varies depending on the state. This writ essentially allows the creditor to seize assets to satisfy the debt. To a certain extent, creditors can levy automobiles, jewelry, cash, gold, etc. In Washington, creditors can clean out a debtor's bank account, as long as the creditor leaves the debtor with at least $200.

A writ of garnishment/levy/attachment are all considered valid court orders. They are issued by a state court, and therefore, can only be defeated by a federal court order.

As the economy takes the turn for the better so will your situations. Everyone should try to be honest with themselves and do what is morally and ethically right. If everyone just did their part it would all work itself out.

Now for team Tidwell: Keep your head up. All is good. I hear most of everything and all is going as planned. Let team P and P know that we held it for the longest (invicto) and they are only getting a small portion of the pie.  Remember a creative man is motivated by the desire to achieve, not by the desire to beat others. No bitterness here toward anyone and I wish all of you well.  Next month is "D" day. Long hours, fast pace, and focused on doing what I enjoy doing.

got a call from this number stating that I received a quick payday loan in 2003.  the job that they said i worked at was in new york never worked or lived in new york.  went to the bank that they said it was deposited in but they had no info on any deposit.  then she called me back and wanted to make hardship arrangement payments wanted my credit card number and i told her seen me so documentation of who i am taking to in the mail not just a email because you are telling me that u okayed a  payday through email and u  only needed my ss# and email address and you sent out money with any id.  I am stilln  waiting for documentation.

You are obviously a very untelligent person. You are in the right job for you....with a bunch of other idiots!! Sometimes people have financial problems that cause them to fall behind on payments. Payday loans are supose to help in a time of need, but unfortunately they are not helpful at all. Most people take them out because they are desperate at the time, without considering payback is a bi***!! I owe for a payday loan and Nelson Hirsch has called me at work but I just don't answer. If you have caller ID you should just ignore it. I got that from a lawyer. They can't take you to jail, there is no debtors prision. Don't listen to their threats, that's how they force some poor people who are scared to death of going to jail, to pay. Of course these poor people go out and borrow again to pay the debt or they don't pay their rent or utilities and end up in a worse situation. Some states may have different laws regarding payday loans but here in the state of Texas, we consider them bottom feeders!! Good luck everyone in dealing with these scum bags. Please don't let them scare you. That is the tactics they use. Don't talk to them at all. Send them a "cease and desist" letter and hopefully that will stop them, if not, just ignore.

This number called me and said her name was Julie Smith and said my mother has to call them or her lawyer today.  My mother is totally in incapactated. She is disable and not working... She wouldn't identify her reason for calling.   We gave her the name and number of my mothers lawyer.
