I am working through a Debt Consolidation company who is handling all of my debts. I have spoke with them and they said that this company is not a fraud. They are able to collect and monies for the payday company they are working through and for any account they close they get paid on. You do not have to work through them or close any account with them. Once you say do not call me again they are legally not allowed to do so. They will also say that there are charges pending on your social security number and that is false as well. I have come to realize that the best way to handle these people is to say that you have a lawyer, they are aware of the situation and to send whatever paperwork they have to. I have been saying that to these people and other companies similar to this one for a year not and have not seen any paperwork or been served.

You're correct; a lot of these scammers attempt to sound scary because they don't want you asking questions, they just want to steal your money. Do NOT give in to them!

What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:

you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

They have calle and tied o get us to "verify" our information. Then when we wouldnt comply they tried to say I had a payday loan debt, but I dont work, and never had one of those. They then tried to threaten us with legal action if we didnt "settle" with them for $600 that day and what account number would we give them....lol
These crooks are not to bright. We tried to explain to them that there is nothing in my name, but he said well we have documentation to blah blah blah. My hubby said "we will see you in court sir, bring it on". So they call back today lol different spiel...... I laughed and hung up.
