Assets Acceptance leaves me a message in my cell phone about some legal documents. A woman who said she is the manager of this office with name or last name Yelder, harass me with a rude tactic when she call my house phone with a private name and number and suggest she is going to process my case in court, and report me to the Social Security.

These people call me and threaten me and I have no idea who they are.  They tell me they bought one of my credit cards and are wanting me to settle it or they will process it through the courts.  They can't tell me what card it is or anything about the charges only that they want me to pay the bill.

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.

2. Save the calls captured by your voice mail or answering machine.

3. Contact a consumer lawyer.

It is not unlikely that you may receive calls from debt collectors even when you are not a debtor.  More and more frequently, debt collectors are using automated dialer and recorded message players (ADRMPs).  The increased use of ADRMPs means that folks who get a new phone number, formerly  held by a person with debts, may be subjected to hundreds of automated collection calls. For more information on this emerging collection practice, check out Jessica M. Gulash's Note "The Use of Auto-Dialers and Pre-Recorded Messages by Debt Collectors" in the Journal of Technology Law & Policy.

Even if you are a debtor, you may be able to sue a debt collector under the FDCPA for using an ADRMP. As detailed by Ms. Gulash, many courts are recognizing that use of ADRMPs can violate the FDCPA.

It is a debt collection agency called AACC.  I saw them on the caller ID, since I pay everything on time, whenever I get a call from a debt collection agency, I call to get them to remove the phone number from their database.  Our number is associated with a dead beat (he must have had the number before we did), so I call anyone who is called to collect a debt to get our number out of their system.  I did that with AACC and they took care of it right away.  You should not ignore debt collection phone calls, even if they are not yours as phone numbers are used by check approval places so you may find your checks will not be approved if you continue to ignore calls like this, even if they aren't your debt.

Keep receiving a call from this number on cell phone. They never leave a message. Looked up number via internet and got to this site. As with others, have no debt. A nuisance that needs to stop!

I have been receiving calls sporadically from this agency also "looking for" Nicole - Although they stopped for about 1 year, they have started up again.  I have also received similar calls from someone looking for Linda Spanglish (or something like that).  I once was able to speak to someone at that agency and the calls stopped for a while.

I am sure this is a call from a collection agency that I have no business with.  I do not have outstanding debts at this time.  I am sure they are looking for someone else.  When I tried to call the number it tells me the call can't be completed as dialed!!!!

Continue to call my 14 year old son's cell phone and now calling my home.
I called them back and they said my son has a bad account with Sprint (which he does not).  I spoke with Tracy Bennet at ext 3822 and asked for her supervisor as she would not comply with my continued request to remove my number from their phone list.  She asked for my son's SSN which I refused to give her.  She could not get a supervisor on the phone but said they would call back later.

Keeps calling my number.  I let my answering machine take this call and  before my complete message has finished speaking, an automated voice comes on saying "By answering this call, it proves you are Nicole" {the name of the person they are trying to locate).  Well, there is no Nicole that lives here and no Nicole has ever lived here.  So I hang up.  I receive this call a couple times a which I consider harassment.
