Not me but my friend got the same call from Texas and telling him he was going to be served some papers the following day.  Same referral to Davis and Associates with the number 714-987-1947.  As Jag stated, who the hell calls someone ahead of time they're going to be served?  Thank God I googled this up.

I got this message today also. Said I was going to be served a summons if I did not call this number back. I sounded like a scam so I googled the company--and found this forum as well as others. They were Davis and Associates. 714-987-1947.
I am not a lawyer and have never been served a summons but who the hell CALLS you to TELL you that you are about to be  served?? answer--a desperate collection agency breaking the law.

We should all report this to the attorney generals office.

I just got a call from these people wanting to speakwith my son. On the same day got a letter from our insurance company's lawyers concerning a car accident my son had in 2004 so I thought they were related. The lawyer representing the other automobile driver maybe. So I called it back and asked what it concerned and she wouldn't say and said she had a lawyer on the other line and had to put me on hold, which again made me think it was a law firm. She was so rude I just hung up. She called back and said my son had to call them about this. I asked if his lawyer should call instead (still thinking it was about the car accident) and she started yelling at me and calling me names. I was so confused and blown away by what was happening. I asked if they were a law firm and she was yelling that she never said she was and if I could throw around the word lawyer and think they would be intimidated I was wrong. I was so confused! Why was this person yelling at me? I asked if it had to do with a car accident and she said no but if I thought I could intimidate her I was wrong and hung up on me. It was the weirdest thing I'd ever had happen! So I google the firms name to find out who they were and found your post above!

Yeah they called me to day wrecked my nerves but I had this happen before. First the guy called...I never even said who I was and he just started saying he couldn't open the documents but gave me a refernce number. "Well They were about to send the sheriff but if you can call this number we will see if we can stop the proceedings" oh boy the more I think about it the dumber they sound. Called under my maiden name as well. For a credit card I defaulted on back in 2000? I think. I told her im a waitress and couldnt pay it and she said well you know what the good news is we will garnish your wages and take your check LOL! Glad most of my check is in cash tips ha!

Recieved a call from this number earlier today. Man left message to call back or be in default of a scheduled court date. When called back ask for Mary Loyd who became very loud and rude almost immediately. Started talking about a debt owed and how bad my credit report is. Denying I had such a loan, she threatened and said it would be taken without my approval. My concern is that she did have my credit information right and ask if it was me by using my last 4 SS #'s. I offered no further information and she hung up on me. I had my wife call the number and see what she got for a response. Must have reconized the number and started yelling not letting any one sentence to be finished and then slamed the phone down.
These people using the name Davis and Associates need to be stopped NOW!!!

A call came from this number.. when I called back, a message said: No mailbox has been set up for this number. Ok, the message was.. I had 48 hrs to contact them, or papers or something was going to the clerks office. If I did not reply in that 49 hrs, it was assumed all was correct. I goggled that number, it's a VOIP phone number. Now no respectful company would use voice over the internet as a phone, and since THEY asked me to contact them, and they have no mail box set up, nor did they answer, I can only assume this is b***s***. I'll try to contact them tomorrow and see what they have to say. Also think it's odd that the lady above me got called like an hour before me. <or at least from the time of the post>

Debt Collector
i recieved a call from a lady who said she was sending legal papers to my attorney about going to court to settle a debit she said I owed. she said I owed a 2600.00 debit on a old credit card.I told her i drew disability,and she said i was 50 yrs old and should be working like most ppl do.She accused me of getting free money and that I should be working instaed of getting free money,that ppl like me are always taking to advantage of the system,That we always say we have something wrong with us and that it is all about not wanting to work.my husband was talking in the back ground,and she said he was probably another one getting free money.my husband took the phone and preceded to tell her she has nothing to say to him that this account was in reference to my wife so she needed to not talk about him...the call escalated to a shouting match until my husband threaten to sue and then he hung up.i called her back to get a settlement arrangement,after giving her my debit card info,my husband looked them up on the web and found out that they where scamming.I called the better business bureau and they said they had no listing for there name which is davis and associates,located in yorba california.when my husband requested her name she refused to give it,so i called back and talked to another lady named jennifer robbins she was kinder and offered an apology for the bi*** who was talking so rude and disrespectful to my husband and me.In any case,after doing a little research on them,i called disability and had my card cancelled,so they won't be getting any money from me after all,hahahaha

Got a call from these people as well on January 10th, 2013. Number came up on my phone as blocked and a male voice left a msg stating no more than they were issuing a legal summons for a past debt (didn't say what the debt was or the amount) and left a case number and call back number. I called and spoke with this lady, Mary Lloyd, mentioned in a previous post by Tony. Apparently it was regarding an old credit card account that I don't deny having let go into default back in the year 2001. I just sort of laughed about it and told them to go ahead and take it to court because i was aware it was on my credit report as a charge off. She told me I would be receiving a summons then at my place of business, of which I couldn't help by responding "good luck with that" and immediately after she became very rude. She goes on a rant and tells me that at 33 years of age (which is also true) I should know how to pay my bills by now and some other comments i didn't really catch before she hung up on me, not letting me get in a word of response.

To be honest, I found her so-called insult to be hysterical but decided to call back. (while recording the call, although i didn't tell her i was which i THINK means i couldn't use it in a court case but we'll see) Immediately I asked to speak to a manager or supervisor. Same girl answered and as soon as I asked, she turned hostile, telling me she was the supervisor and again proceeded to barrage me with the same insults as before. Basically about me being 33 and that i should know how to pay my bills. Apparently to her, a person can't become more responsible in the 12 years that had passed since that had taken place. lol She also couldn't manage to get my name right. She would get my first name correct but continuously called me by some other last name (Sarino or something similar) even when I offered a correction. She again pretty much wouldn't let me get in any of my own comments though and once again ended up hanging up on me.

Also when I called them the first time, she answered giving some other company name. When I asked if I had the right number and was attempting to get a hold of Davis & Associates, she immediately stated I had the right number and that I had reached Davis & Associates.

This is definitely a scam people so don't fret. And even if by some miracle it isn't, many rules were broken under FDCPA and I personally will be attempting to have my attorney look into it. However, the more actions taken against these people the better as it will prove to the courts that more needs to be done than just the usual slap on the hand.

It happened to me too yesterday ,January 14th,2013 .They called my home and said that tomorrow some one is coming to my house to serve me court documents and this is a "courtesy call " .I investigated the matter with my lawyer and we found out that they pulled hard inquiry on my credit report. It showed up as Platinum Partners but they also do business as Davis & Associates .THIS IS A SCAM . I THINK ITS TIME FOR US TO STOP THEM BY FILLING CASES AND COMPLAINTS AGAINST THEM THROUGH THE LEGAL CHANNELS.

As I said on another thread complaining about this company, I don't have any outstanding debts and have great credit.However, they managed to get a hold of my SS# and did a hard pull on my credit report. It showed up as Platinum Partners but they also do business as Davis & Associates.

Thankfully, I have a credit monitoring service that alerted me to this inquiry, and they are deleting it from my credit report. I always thought these services were a waste of money until now!  I would also suggest reporting them to your state Attorney General's office.

My husband and both received phone calls from phone number 1-714-485-6693 stating we owed a debt - wouldn't tell us from who only that we could request change of venue if we wanted and that they would be contacting the IRS about us... When we tried to call back, the lady that answered the phone would not disclose her name, started screaming and yelling at me when I asked a question and then hung up on me when I called back. Would not give me any information about the amount of money owed, no balance owed, no name of a creditor or anything!! Se actually called our home/business number and both of our cell phone numbers that are both not published. Very frustrating!!!

I got a call from this number today 1/2/2013, it was a private, no caller ID but they left that number in the message and said that I was in a law suit from Davis & associates and said they needed to serve me some papers. What tipped me off to it being a SCAM was that they used my married name from 12 years ago. I always get Scam and junk mail from places using my old married name. I am also glad I read these reports. I can sleep tonight!! :)

I hung up on her, she called back and told me they were going to send out a summons and that she heard my husband in the background and told me to tell him he was rude she had it all on tape and she hung up.  (Mind you we were in the middle of Downtown Pittsburgh in traffic)

Hi Melissa, I got a voicemail from them, but they called themselves "Davis and Associates" and told me they have "documents that will be forwarded to the proper authority" if they don't hear back from me in 48 hours. I thought it was sneaky that they didn't say "authorities" as if to avoid confusion with the police. I'm not calling any one back. I won't respond unless I get something in writing. If I owe money, then there should be no problem with sending me a proper notification.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>
