I have been getting calls from a Howard Colvin for my girlfriend. She has a debt with Providian from years back but she did pay something on it in 2006 so the 10 (In my state) year statute of limitation may have reset. Does anyone else have information on this Howard Colvin? I can't seem to verify who he works for. He claims he's from an attorneys office but he doesn't say Eastern or Ethical Assets Management. My girlfriend spoke to him the first time he called. She explained to him that she lives paycheck to paycheck, and does not have any savings. This is true. She works a seasonal job and right now she is working about 1 day a week if that. Howard woke me up at 8 am asking for her and I told him she wasn't here. This is the one day this week she got to go in to work. One hour later he called again. I again told him she wasn't here and that he would have to call back later. He told me he would call back every hour on the hour so I turned the ringer off. How dare he harass me when I already told him my girlfriend was not home!

Also can anyone tell me if it's true he has to contact you in writing or he is breaking a federal law? Can anyone tell me if the statute of limitations is not up how would a guy like Howie get to be the guy collecting the debt? isn't it true that if the account was still open and the debt is good why wouldn't Providian contact my girlfriend instead?

This message board has conflicting view points. Some people say they were sued successfully and wished they paid the debt and some like the ex employee says they really cant do anything to you.  Whats the real story?

I have not learned why they are calling me yet, but the message I received today said I signed some contract and I either need to make good on it or they will have my driver's license suspended!  Now, if I owe someone money on an old debt, fine...but, unless it is my state toll or some unpaid ticket, I can't imagine they really have this power.  Good grief.  Hope I am right.  ha ha ha

A Mr. Coagler in the summons and processing department of Attorney John Nicolia"s Office left a message on my machine.  When I did the reverse directory check for (716) 312-0822, it showed no such number existing.  The New York Bar Association shows a John Paul Nicolia of Williamsville, NY having admitted to the NY Bar in 1991. It gave his Bar Registration Number as 2375566.  His field is general practice.  Williamsville, NY gives his address and phone number as: John Paul Nicolia...300 International Drive...Williamsville, NY 14221...(716)842-6033.  When I *67 and phoned back, I got a recording for Eastern Assests Magagement.  I received no legal documentation in the mail to date and doubt I will.

Just received a call from a Mr. St. Claire. He initally stated that he was with the Attorney General's Office for Oneida County. He went onto say that I had an unpaid debt with Clout Credit Cards and if I did not pay it a subpeona would be delivered to me at work. I explained that the debt was paid and that I needed proof the debt wasn't paid. He continued to pressure me and told me pay now or they would sue me and I would pay even more for court costs and lawyer's fees.

My dad called Mr. St. Claire back and it turned out to be Eastern Asset Management and Mr. St. Claire denied ever saying he worked for the AG's Office and explained he worked with Attorney John Nicolia from Eire County. I first I thought Attorney General could be mistaken for Attorney John Nicolia and I mis-heard it, but Erie is a bit different Oneida - then I checked the voice mail he left before my dad called and low and behold he said Attorney General's Office.

Surprise surprise.

I received a voicemail from Angela Bonaduci from "Dana Coley, a law firm" that asks me to call back in reference to some documentation they're trying to obtain for a Chad Bayler. Since I have no earthly clue who this Chad person is I have to assume that the posts here have more to do with what these people are trying to do than anything else. Admittedly I'm having credit issues like I think many other Americans are but I've already begun a credit counseling program designed to help me rebuild my credit score and pay back what I owe without killing me. I called them back and left a message with the best time to reach me next week and needless to say I'll have this website bookmarked as a reference for that phone call. My story sounds very close if not the same as all the rest of these....I recieved a phone call Thursday mornining from a Mr St.Clair stating that he was an Attorney General for my county and after further review with this investigation i found out that what he was tell me was a script...Every word he stated was on a piece of paper he read off... He told me that if i did not pay a certain amount of money by a certain date i would be sued and placed in court..I knew I payed this debt from Clout but they stated that the collection agency took my money and ran and never paid Clout and that Clout is now comming after me. I could not believe this was happening, I told Mr St Clair I paid the debt he told me he would cut the amount in half if i payed by the end of the month.. I was so scared and nervious and have never gone through this before that I thought I was doing the right thing by saying ok i'll pay the debt. I gave him my acct and routing #. I then after sometime and speaking with people that this was not right. I called the actual Attorney General's office in my state and the BBB.I also contacted the orignal creditor as well. They all stated this is a SCAM. I could not belive these people did this not only to me but to all the people that are on this site doing the same thing as me. Warning People. I cancelled my bank acct all together. and I am in the process of taking legal action my self.. I dont want these guys to just be sued and be told dont do it again. My cousin called me yesterday, giving him this 716-312-0822 number and said a lawyer had called and told him that they had a civil suit against me (giving my maiden name, and I've been married for 10 years) in a county I formerly lived in.  My cousin told him that he had lost touch with me over the years and he would attempt to track me down, which he did.  When I googled this number to see where it was coming from, I was led to this site, which reminded me of this same thing happening about this time last year.  

My mother in law received a call saying the person was with the law offices of John Nicolia and they would be filing charges against me in that within 3 days and they were calling to give me notice.  First of all, they knew that she was my mother in law, and yet they don't know my legal name?  So I called the number that she gave me and asked for Mr. St. Clair as per the instructions, but he was out of the office and I would have to talk to his paralegal.  The "paralegal" was rude and offensive, informing me that I had defaulted on a Clout Visa which had a credit limit of $1000 and my balance on the account was $1200.  I informed him that I never had a Clout Visa and the only credit card I ever had in my maiden name was a Mastercard with a $200 limit and it had been paid off for over 8 yeasrs. He finally told me that the only person authorized to handle my account was a Ms. Broadway, and put me on hold, after which another person answered the line and told me Ms. Broadway was on vacation or something like that and I'd have to talk to her secretary, and transferred me back to the same person.  Hmm, so he's a paralegal for Mr. St. Clair or he's a secretary for Ms. Broadway????  Maybe both? What a multitasker!

I finally ended the call by telling him once again that I never had the card in question, and the dates and addresses they were giving me in regards to the account were inconsistent with any actual details of my life.  I gave him my mailing address and told him to direct any further communication to that address and I would need documentation from his company regarding the debt so that I could have my attorney research the source of the discrepancy.  He responded "good people pay their debts and obviously you are not a good person and a liar as well."  I hung up and of course, have not heard another word about a suit or received any written communication through the mail.

Which brings me back to yesterday's call to my cousin.  The caller told him that they had been trying to contact me for several years and couldn't find me and that they were being forced to finally file suit.  So the fact that I called them personally one year ago and willingly provided my physical home address to them has apparently been forgotten.  

I am taking the advice in some of the above posts, am going to call and record the conversation, fax a cease and desist letter and alert my family members to not get alarmed about a phone call like this.  If I don't get positive results from that, I will file suit on them, or as that first guy told me last year "we're gonna sue you for everything you've got and more"

I have been receiving phone calls from this company for the past year and a half. I decided to do an investigation on my clout visa account to make sure these people really had my account. After several phone calls I couldn't fine anyone who said that they bought my account and I had this debt removed from my credit report. I even told this to them and they said that they were looking at my credit report and that the bad debt is still on there. I have decided to just stop answering their calls. They have been threatening to sue me for about a year now...I am still waiting...

I, once again, got a call from these people.  Now this man is saying he's an investigator.  Investigator Howard Colvin.  He's looking for someone that is not me.  He also says he's going to file a lawsuit in my county and the papers are leaving his office on Friday.  Well, good luck with that.  My county is small and no one seems to know who this "so called" Investigator is looking for.  I have the same last name and believe me, the person is not from my family.  Google Howard Colvin.  Don't these idiots watch Dateline?  I was told to call him back at 888-346-3978 x 136 IMMEDIATELY   Yeah...I'll get right on that. The lady left a message saying that she was calling from John Nicola and Eastern Asset Management in reference to a legal action that was about to be taken on my social security number and that I or my lawyer should return their call to determine what my legal rights are and the choices that I have.  I GOOGLED "Eastern Asset Management" and it appears to be a company that buys old debts from companies and attempts to scare people in to paying debt that they are no longer legally required to pay.  I do not intend to return the call

i had received calls from them for 2 weeks and looked into who they were. saw a bunch of shady stuff but when my parents loaned me the money to settle the debt i turned out getting my paid in full letter from them and it was off my credit report a couple months later. i looked further into who this company is and found out they are totally legit aside from a few complaints. but id imagine those were from people who didnt pay there bills and got sued. and besides besides that its a multi million dollar business i doubt you could find any business that size that hasnt been complained about. i did the same websearch on the bank i work for and they had thousands of complaints filed against them in florida alone. bottom line i guess is pay your debts and you dont have to worry about it..............

clout visa called me saying i took out a credit card in college. wouldn't send me any bill or anything on paper jus said i had to pay. now eastern asset management calling saying they jus bought the account. they thereatened to sue me and when i asked if i could have something on paper they hung up on me. They couldnt even tell me what my billing address was jus claimed they did a background check on me but they didnt know i lived in another state the past ten years and couldnt tell me what kind of charges were made or anything. they jus keep hanging up on me. when i told them i was gonna file identity theft and needed something on paper they told me stop calling there number.

I have had several different people call me from this number and agency since March regarding an account they say I owe money on.  Of which, I do not, the account was paid in full and I have a letter to show that, but they continue to harrass me.

Second call to me about my former husband.  (Divorced 16 years ago) Said they are filing papers against him in Maui County.  They tried to convince my daughter to "pay" this bill(?)so that papers wouldn't be filed.  Fortunately, she is on deployment somewhere in the Pacific or SE Asia, so they can't bug her.  My ex went off to the Philippines recently when his sister died.  I guess they can't do much internationally.  I can see they aren't ethical from all that I have read so far.

My ex slept with this guy travis casey in the public bathroom at the office where thay work. Trust me dont pay them its a big time scam. The same thing just happened to me. A guy by the name of "Mr. Carter" called saying he was attorney from the offices of John Nicolia and wanted to speak to my dad about a so-called debt which my father never had. After my mother explained that it wasn't him, Mr. Carter said it was and that the matter had to be settled immediately or that they would file a civil law suit against him and that a "chief officer" would come to take my dad away!!! At one point he transferred the call to someone else by the name of Howard something who was very rude and wouldn't even let my mother talk! We know for a fact that my dad doesn't even owe this money! Mr. Carter even went as far as saying that this was a courtesy call and he wasn't even SUPPOSED to be warning people. If he's NOT even supposed to be calling people, then HOW ON EARTH would my dad even be able to pay this debt (which again, isn't his) since they havent' sent anything in writing telling us where to send the money. Mr.Carter definitely contradicted himself when he made that statement! It seemed he had wanted to collect this "debt" right over the phone...through a phone call he wasn't even entitled to make....it makes NO sense! I hope no one actually falls for this...and I hope this company stops calling!!

The guy called himself Howard Colvin tried to scare my sister into giving out my personal info by saying a summons was trying to be served on me so she contacted me with the info he gave her and after a short and I mean short conversation with him I realized the debt he was attempting to collect on was paid. I told him it was paid and he threatened to have papers served , I then perceived to tell him I was on disability and his entire tone changed , he became very hard to deal with and then was basically acting like a total inmature goofball then hung up after he spouted out a nice set of foul insults towards me and my family. It is my take he was trying to collect on a something that was paid, definately a scam.

Well, First they do call the wrong #. They kept calling my parents house, even though my number is not private and I have not been hiding from them. I do however have to commend them for not giving out any information about me or my legal issue except for a msg to call them and an acct #. I called back after my mother finally got the phone # off machine and spoke to Gary, he was extremely nice and very willing to work with me in paying off my debt. I have dealt with other agencies and have found out just like I did with this one, that if you are willing to try they will help you. I knew I had owed the bill in the past, but had stopped getting bills (i had payed some of it, but just forgot about it) so I just forgot about it. These guys arent out to get anyone, they have a job to do. I have been insulted in very demeaning ways by another company and Gary was very helpful and respectful.

Save you messages that are left on your machnine's and voice mails and bring them to your local attorney or play them for your attorney generals office.

the number is from eastern asset management..they might try to say that that john nicolia is a collection agency but i called him and he is NOT.  EAM is one of his clients and they should be sued for saying that they are with his office!  Sue the jerks!

I have called this company all day for the past three days, just wanting to know an address so I can send them a certified letter, to get the information they're supposed to send me in the mail. Nothing get accomplished. Now they have called the police department on me and lied to them saying that I make threats to them, which isn't true. If the debt is true, why haven't I received anything by mail, and why are they so rude when I request the infomation.
