I got a call from Upstate Offices 716-312-1689 on 8/29/2012 at 5:32 am  they were asking for someone else when I said are you calling about a collection?  She said no I'm calling them for a last chance to pay this before it goes to court.  I said you are calling me at 5:30 in the morning about a debt collection?  She said "no I am giving them one more chance before it goes to court and I don't know what time it is there I'm in a different time zone." I asked for her name and number and she said why? I told her because it is against the law to call on a debt collection before 8 am in the morning so give me your name and number and she hung up on me.

Recieved a call from Cindy Thomas saying she was a para legal with a law office.  My husband and I and our phone number were listed as a personal contact for a Ms Canalas, never knew anyone with that last name.  Started giving personal info on this person about a criminal charge that she was facing and that she needed me to contact her.  I told her I did not know her , she said I did....told her I was almost 50 yrs old and I was sure i knew who I did and did not know, her smart butt reply was good for you!  and hung up on me.  I called her back....I introduced myself and told her I would contact my attorney general office..she told me to stop making harassing calls to her number...LMAO!!

My husband keeps getting a call from this Cindy Thomas as well.  She has used the scare tactics, that if he does not pay today that someone will be coming to haul him off to jail. She was trying to get his debit or credit card number.  Good thing he told her his wife has them all.   I have told him not to fall for her scare tactics, as you can not be hauled off to jail, if you haven't even been served papers.  I am glad that others have posted this information.  I told him that next time she calls to tell her to not call again and that this number has been given to a legal representative long with the Better Bureau.  These people need to be stopped.

I hada message on my answering machine for my son. They stated they were representing a law firm and he needed to call by the end of the day. Or the would contact the Philadelphia court system. CAN SOMEONE PLEASE HAVE THESE PEOPLE SHUT DOWN. I CAN'T AFFORD THIS WORRY DUE TO HEALTH ISSUES,

they call me to but now they are from the states attorney office or FBI , name Steven Stock and Cindy Thomas 716-312-1689, this is a debt collection company, harassing people over old a** debts, that they either have paid or file a bankruptcy on. They will use anything to collect money which is a scam to be who you are not, consumer report this kind of activity to the FBI.
they can not do anything to you ever, tell them to send you the bill, watch ans see that they do not send it to you,give them a PO Box address.
they have purchased old debt not one told them to buy and lost money cause they did not do there homework, people have file bankruptcy report them to the federal courts with the law of bankruptcy which is a crime to collect after been discharged.

Call me and claim to be an investigator with Florida investigator. She said is in re. to a bank to bank fraud and it is a federal case and that if I don't call before tomorrow they will serve me in my home or place of employment.

These people from this number have been calling all my friends and family member including my ex-husband. They have been threatning to take me to court and filing fraud charges on me.They claim to be from clark county and even threaten friends to take them to court.

These people are the worst kind of people, scam artists! If you don't believe me google their fake law firm Brown Andrews and Scott, that should be enough proof to never send money to them!! Be smart think before you act! They use fear as a tactic to get you to pay quickly without thinking!  This is America! We have no debtor prison/jail. The act of threatening a person with jail time if they don't pay a debt is in fact a crime itself!

Sec. 392.301.  THREATS OR COERCION.  (a)  In debt collection, a debt collector may not use threats, coercion, or attempts to coerce that employ any of the following practices:
(1)  using or threatening to use violence or other criminal means to cause harm to a person or property of a person;
(2)  accusing falsely or threatening to accuse falsely a person of fraud or any other crime;
(3)  representing or threatening to represent to any person other than the consumer that a consumer is wilfully refusing to pay a nondisputed consumer debt when the debt is in dispute and the consumer has notified in writing the debt collector of the dispute;

(4)  threatening to sell or assign to another the obligation of the consumer and falsely representing that the result of the sale or assignment would be that the consumer would lose a defense to the consumer debt or would be subject to illegal collection attempts;
(5)  threatening that the debtor will be arrested for nonpayment of a consumer debt without proper court proceedings;
(6)  threatening to file a charge, complaint, or criminal action against a debtor when the debtor has not violated a criminal law;
(7)  threatening that nonpayment of a consumer debt will result in the seizure, repossession, or sale of the person's property without proper court proceedings;  or
(8)  threatening to take an action prohibited by law.
(b)  Subsection (a) does not prevent a debt collector from:
(1)  informing a debtor that the debtor may be arrested after proper court proceedings if the debtor has violated a criminal law of this state;
(2)  threatening to institute civil lawsuits or other judicial proceedings to collect a consumer debt;  or
(3)  exercising or threatening to exercise a statutory or contractual right of seizure, repossession, or sale that does not require court proceedings.

Not paying a payday loan is not the same as bouncing a check, Most states have stipulation that explain any post dated checks (checks written for a future date) cannot be considered fraudulent under the rule of criminal law because at the time you wrote it you intended on having the money at the date that was written on the check so you had no Mens Rea or criminal mind when you wrote the check (that is needed for every criminal case)- so no they cannot hit you in criminal court only in civil court.
What they are doing  however, is highly illegal and can be punishable up to 20 years for violating federal debt collection laws.

THIS COMPANY CALLED STATING THAT A COMPANY WAS WANTING TO PROSECUTE ME FOR A CHECK  FRAUD OF SOME SORT WHICH WAS UNTRUE.  THIS HAS GOT TO BE A COLLECTION AGENCY AS I SEE THEY HAVE LIED TO OTHERS TOO WITH SIMILAR STORIES

called this morning 06/15/2011...he made referance to being a part of harris county tx fraud division.as in harris county tx sheriff..dept..looking for   someone in  my family...total lie...a collection agency..

Here's some more numbers...they've called me 20-30 times in 1 month, called and harrassed my family who they claim are 'references' from a past payday loan debt...threatened court/lawyers/jailtime/misdemeanor etc...requested (demanded) I pay them with a prepaid debit card or western union...ANYONE else deal with these people?  Brown, andrews and scott llc?
