Mr. Thomas called my mother in law claiming to be a US marshal, to which he says in untrue. I then get the message and call the number 716-931-9830. A male answered the phone Claims Investigation America. Went through the whole deal, he says I owe 4,400.00 and there is a court case. While on the phone I check local court for case number, guess what NOT THERE. I advised him I knew that was no such case number and he said well yes it has not been filed yet. Said he would speak with the office he is working for to get a settlement for 400.00 but could be as high as 2000.00, told him I would see what I could do and would call back later that day.
He called Monday while I was out. I did not call back.
He called back today Tuesday August 26, 2009 and asked if I could get the money. I could already smell the BS. Advised no, not with my medical bills, He then said you understand that you will be served a court summons and your husband. They are going to pull him off the factory floor take him right to court…strange my husband is not working. He also said my mother in law would be served since she was the co-signer…funny we never speak to her let alone see her. Then he said there would be a warrant for 4,400.00. The check by the way for a payday loan was only 328.00.
There were a few calls back and fourth then, my husband upset at the harassment toward myself. I finally called back and nicely asked for the firm he represented he refused that information.
He is out of New York I can NOT find any information on a company by this name.
The debt he is referring to was sold many years ago to Paragon Way from Advanced America.
At one point he told my husband he owned Advance America which is not true. NO one from Advanced America has ever heard of him at all.
Paragon Way has not yet contacted me back in regards to the debt.
I have a feeling somehow this person has got this information by illegal means and is trying to make a dollar or two. I hope that no one has fallen for his ploy.

Redceived call from this number, notified I am on do not call and have no relation with company.  Will begin tracking and reprot to FTC and FCC who are now actively tracking violations of do not call as well as sueing and shutting down rude collection agencies, now that they are bing publicized by national news.  Don't answer.  Check unknown numbers on the Internet before answering, use the do not call list, and don't answer any number you don't know to stop these idiots from waiting your time and resources.  We Are Watching and Will Report.  By the way, making false claims about being a representative of the police is a felony.

Received calls starting early August,2009 from Lester Kincaid and then later Marshall Thomas.  Numbers 716-931-9830 and 716-931-9829.
Claims to be Investigation America, Buffalo, NY

Lester was the first to call claiming to be invesgator and I had 24hours to respond. Within an eight minute period of the first message to my home, my family members were called telling them papers would be served within 24 hours and leaving last four digits of social security on messages.
When they called Lester back they were rudley treated and sworn at and then hung up on. I reported this to local police, Which called Lester right away.
I haven't from him in awhile.
Tonight, I heard from a Marshall Thomas which left a message claiming to be a
US Marshall. He sounded intoxicated and could not complete the message.

If these were true professional law enforcement, government officials or P.I.. The messages these people leave would be complete and professional. What they write would be correct, not capalized, incorrect spelling and abbreviated as the above from Marshall Thomas dated March 23rd 2009. They would not use the words shut up or any type of slam word, or threaten. They would not Harrass at all.

FYI - Save all recordings and note each call. Request in writing the complete information and the company they represent.

You can stop a debt collector from contacting you by writing a debt dispute letter to the collector telling them to stop. Once the collector receives your letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or the creditor intends to take some specific action. Please note, however, that sending such a letter to a collector does not make the debt go away if you actually owe it. You could still be sued by the debt collector or your original creditor.

Within five days after you are first contacted, the collector must send you a written notice telling you the amount of money you owe; the name of the creditor to whom you owe the money; and what action to take if you believe you do not owe the money.

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact.

For example, debt collectors may not:

•use threats of violence or harm;
•publish a list of consumers who refuse to pay their debts (except to a credit bureau);
•use obscene or profane language; or repeatedly use the telephone to annoy someone.
False statements. Debt collectors may not use any false or misleading statements when collecting a debt. For example, debt collectors may not:

•falsely imply that they are attorneys or government representatives;
•falsely imply that you have committed a crime;
•falsely represent that they operate or work for a credit bureau;
•misrepresent the amount of your debt;
•indicate that papers being sent to you are legal forms when they are not; or
•indicate that papers being sent to you are not legal forms when they are.

Debt collectors also may not state that:
•you will be arrested if you do not pay your debt;
•they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; or
•actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action.

Debt Collector
I had a call from a Marshal Thomas, the details are the same as above. He said he was a detective, gave the last 4 of my social and a previous address I had not lived at for over a year when this suposed loan was taken out. When I talked to him on the phone he said that he was a claimes investigator. I have just filed an identity theft report with local police and a report with the Federal Trade Commission Consumer Responce Center. I have also talked to the Attorney Generals office. I would sugest that anyone else do the same thing.

This has definitly got to be fraud!!! He says his name is martin Thomas and he said he was an investigator on behalf of tendollarpayday.com I had this loan looonnnggg time ago and owed them about 100.00. Anyway, he claimed he has a judgement to take me to court on this matter so i called right away. He gave me information on that account whihc was completely false he said they were suing me for 3500 but we could settle for 2500. I asked him ...how much i borrowed knowing how much i borrowed and he said..it was 1000 which is completely bogus! I played along and led him to believe i was going to send in some "money tomorrow" he has been blowing up my phone since i guess he sensed my sarcasm. He gave me a money gram information for a "peron to person" with the name of Lance Martin. I couldnt believe the extent this guy went to. I said i wont send any money without proof of the debt. and he created a "legal" page stating the amount owed"...lol Hes soo full of it. Ignore this guy he's crz. be cautious!I called tendollarpayday loan and it turns out that thier "files have been stolen a big number of them. and these guys are using it to get money out of people. DO not believe fraud!!!

A Marshall Thomas called on March 18, 2009 to state that Shelby Odle is being charged with fraud but did not give any details, who he was, where he was from or who he represented.

He gave a docket number, but no other references to a case.  Have also had a multitude of similar calls over the last year without incidence.
