I got a call at work today from PDL Recovery and the man on the phone told me that he was an attorney representing Check-n-go. He told me that he was going to file a judgement against me and a hot check writing charge for a pay day loan.  I called my bank and told them that I gave them my account information and the bank told me to cancel my debit card. These guys threatened me and wanted to talk to my supervisor.  Such idiots!!

If they're threatening you or not pay your bill scum bag. You borrowed the money and now it's "Wahh Wahh Wahh I have to pay back what I borrowed plus the interest I agreed to!?!?! Boo-hoo, whoa is me!" Quit being a B***H and man up and take care of your responsibilities. I hope to god you don't have kids, cause you're setting a horrible example to them. You and every other piece of s*** out there that wants to run and cry and hide under the FDCPA laws when it comes time to pay back the money they borrowed. Regardless if it's from Chase Bank or a Pay Day Loan lender quit being a bum and do right by what you agreed to in the beginning.

I received a call from PDL Recovery today regarding a supposed "Payday Loan" that I took out.  The message stated that the complaint was attached to my name and Social Security number and they even named the county I lived in as the Plantiff.  I did some digging and found this website and some other sites regarding these phone calls.  My father-in-law is an attorney and the first call I made was to him.  He informed me that he has been approached by several individuals regarding calls they received from PDL Recovery.  This company is operating outside of the FCC and FDCPA regulations and they are a.....wait for it.....SCAM!  The best advice that he gave me was that if you enter the number they called you from or the number they leave on your voicemail onto Google and the first finding is not a viable company profile, it's a scam.   My father-in-law and I are working together to file a complaint with the FCC and FDCPA against this company.

I got a phone call from this number at work looking for someone that I've never even heard of (and I've worked at my company for 13 years!).  I called them back and the above number and told them what I knew (that the person they were looking for had never been an employee at the phone number they called), and they said they'd take the number off the file.  The only personal information I gave them was that the phone number they called was a governmental agency.

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

A company by the name of PDL called and said I owed a cash advance company by the name of check n go with the number 716-242-8362. I have made maybe 3 0r 4 payments but I got suspicious because I have not received any paper work showing my remainding balance or anything. I made a phone call to them and the lady answered the phone by saying hello, that was also strange, not professional at all! Just wondering if this company is legit?

The partial BBB Alert for PDL Recovery reads: This collection agency has not responded to our requests. BBB advises consumers to be aware of their rights in regard to collections. This includes New York States law prohibiting any collection agency from collecting on Payday loans in the State of New York. The Fair Debt Collection Practices Act (FDCPA) outlines prohibited behavior when attempting to collect a debt, and outlines specific rights for consumers. There are penalties for agencies found in violation of the Act. Is there ANY WAY to stop these people from harassment?  They keep calling my husband at work, which is against the rules at his employer, and claiming there is a civil suit against him.  I called them back one time and told them they need to send something in writing.  The lady claimed he had committed fraud by taking out a loan and not paying it back.  It was supposedly done online BUT she had a copy of his driver's license.  I asked her how she had a copy of his license if it was done totally online and she hung up on me.  They stop calling for a while and then start back up again.  VERY FRUSTRATING!!!
