I never said you were worgn .... erm, wrong. Triple-B's payola tendency makes it an unreliable barometer. Dufek may have won a lot of official silence about his practices as part of settlements with angered consumers. Could also be that the Dufek name has been flatrated by the real thugs. The bridge to truth is built from many stones at times.

Four fingers and a thumb .... the Dufek complaints online, and their many angry shill rebuttals, all tell a different story, and they've piled up for several years. This agency traffics in a lot of accounts from CACH/CACV, a debt buyer well known for dirty tricks and associating with the worst breed of collector. Possibly it's been part of the CACH attorney franchise or network or whatever you want to call it. Its members have all appeared to use the same extortionist playbook from Scott Lowery, CACH founder.
The job post from September is in the familiar CraigsList format. I took that to be a reproduction for our edification and not an attempt to promote the firm. A little framing note of "lookee what I found" would have been polite, however.

Patty failed to mention the most likely context of her complaint, that she had been on a payment plan for some junk debt. Those things tend to end in tears, as the junk debt collector gets impatient, squirms and/or fudges the truth to ruin the deal, then blames the consumer for being "uncooperative". If I'm reading it right, Dufek took little care in tossing an account to another agency (Weltman, maybe?) with a payment plan in progress. This is another reason I keep harping on one phrase: Never ask ''How do I pay?'' Always demand, ''Prove I owe!''

There is a lawyer by the name of David Sean Dufek Sr., according to the official listings of the State Bar of California. There is no public record of discipline against him, and he has a very good BBB rating with relatively few complaints, all of which seemed to have been answered. And there could be enough information in the post he answered to have replied as he did to Patty.
There is, unfortunately, also reason for Mr. Dufek to be checking back here. It appears that "Way2Go" violated the TOS of this site by posting an unsolicited advertisement for the employment of new bill collectors, as though this were a job placement board. *This* is the part that no one has noticed yet and that *I* find disturbing.

Regarding the Ohio law firm, they must be the law firm that is currently handling your account, I would speak with them about your payment history as well. This company lost our information then gave it to another law firm in Ohio and now this law firm is stating that the original creditor lost all information of us paying anything. Come and get the damn bed, I don't want it....that's what I told Dufek's office one year ago. Now I am going to sue David Dufek and have his nasty a$$$ in the ringer cause they lost all paperwork that I was making payments for 6 months. They even deducted it from our checking account but they still lost our payments we made...David Dufek, you and your associated are going to pay for all my pain and suffering. You're a worthless attorney, just a pile of shi####!!!!! I have reported this company to the Attorney General, filed two complaints with the BBB in San Diego, CA where there office is located. DON'T EVER give them your personal account information. Tell them you will mail in money order's or cashier check for payment. They told us we couldn't do that, they needed to take our checking account information and automatically deduct from there. You freaking liars, it can be done....this attorney is dumb, stupid and a joke for an attorney!!!!!!!!!!!!!!!

This company started calling my place of business and not just once a day but multiple daily calls. They called family members who had listed numbers. When I called them back, before Melissa Olson would even tell me what it was about she tried to verify personal information (which I wouldn't). When I refused to give personal info and asked her what the call was over she got very snippy. She wanted to collect the money today. Not even sure this is my debt and told her as such. She got angry and started yelling at me stating they were going to hire a lawyer in my state to take care of this. I quoted my rights to her and she condescendingly told me I was a good little consumer. Then asked if I was going to pay her today. I said no and she hung up on me. Called back and go a manager who was subdued. He supposedly removed all numbers from the account and is now going to contact via mail only. I told him I would be sending a letter to them this week. Reminded him that if any contact is had via any phone numbers I would be contacting my attorney and the attorney general of CA and my state.

Nobody from a law firm would ever act so unprofessionally. First flag.
She argued with me like a bad roommate and kept calling back.
The claim didn't even make sense.
Do not answer or take this seriously as they seem to be just an illegitimate collections company.

I made the mistake of answering my phone today and I am really upset how the person calling treated me - she was looking for someone named Martha - never heard of her...when the woman questioned me about the number I ref'd to give her the number and she became agressive and rude -she tried to scare me by saying she was calling from a law office....who the f cares???

Started out something like this: Phone rings?. Answer: who is this? Who would you like to talk with? Is this Company Name?
Who are you? Maria.
Then she went into Bi*** Mode. If any of my employees call another company they are instructed to be respectful and courteous. I did not and will not assist this company to locate a former employee, with these types of tactics.
I can?t imagine an Attorney hiring uneducated people or stooping to such diplomacy.

I received a telephone call today on from a DAVID DUFEK ext 303 said he was calling for ATTORNEY XYZ???, wanting to leave a message for my roommate's daughter. Unusual as OUR phone number is unlisted and unpublished. When we called my roommates daughter she said a friend of hers got the same call and asked for them to get message to her at this number. Probably calling people who have hardline phones and cannot get her cell number. WONDER HOW HE GOT MY UNPUBLISHED/UNLISTED NUMBER???

So this character took some of the same abuse as reported all over this thread, and *continued to deal* with this Dufek like nothing happened. I don't think this person was a shill, but he won't win any savvy consumer awards.
How this reads between the lines is that the collector did not sense the proper level of fear from this person, so "negotiated" the debtor into a half price sale they were likely to hand over anyway. Big whooping victory. As is the custom of the junk debt collector, the consumer was subjected to excess pressure and probably FDCPA violations *after* the payment deal was struck.
Eventually such an agency would find a way to welch on the deal, claiming they never got paid or changing the terms with no warning. Absent from this "deal" was any agreement to erase the trade line from credit reports, to not resell the "forgiven" balance, and not issue a 1099-C tax form. Oh, and if the "agreement" is all verbal .... well, lotsa luck, brother.
Maybe "WaMu over" can clap the dust from his hands and think he's done with this one agency, but there remains the chance the debt account is not done with *him*. This is why when strangers call and demand your money you need to dispute them. This is why you never cut a fast deal with a collector known for hostile and illegal tactics.

Agreed, but also get your legal options together, as in the federal and state laws which govern debt collection, and the terms of your lender's contract. Get your evidence of calls and letters and notations together in case you need to use those laws against the collector.

Because it violates federal and state laws to play dirty the way these debt buyer minions do. Because not all debtors are the same and not all debt is created voluntarily. Because people who are grilled and harassed by the debt industry are not babies who need constant punishment.

All you have to do is stress hardship and financial problems and they will help you. Just make sure you don't have anything on your credit report reflecting and showing that you do have assets and money because they have access to that.
