Debt Collector
Since I received a call from these people on Friday, Nov. 1 2013, I have not seen or heard from them. So, I called them back today asking where is the paperwork that they stated I would get on Monday. All they did is give the phone to some "attorney" and he was asking why I was looking for the paperwork and why wasn't I interested in paying the debt. Told him I am asking for verification of debt to prove they do not have anything to go by. Even though he tried to prove he had my personal information, that does not prove anything else what so ever. Told him he better get that paperwork to me and all he said was he was going to send a PDF via. email which is not what they threatened me with on Friday and also is not valid according to debt collection laws. More updates to follow, I will call this company everyday until they have to block my number. I tried to get a physical address from them and they refused to give it to me since I was going to file a complaint with my AG and the FDC, they stated I was "wasting my time". They called me from: 877-861-3758.

Update: I returned the calls with my husband sitting right beside me, and had it on speaker phone. I asked who was filing a judgement, what debt did I owe? The person I was talking to said they were in the first stage of "investigating" and needed to verify my name, address, and ssn. She asked if my last 4 digits of my social were what she read off. I replied "no, they are not" she then said "oh, so your ssn isn't xxx-xx-xxxx?" Hello!!!!! If it wasn't mine, now she has just given me someones social with the same name as me but different middle initial. What ligitimate company would do that? I am the Health Information Coordinator for a medical facility and also the HIPAA complaince officer, and giving out or disclosing SSN's is the number 1 no no and everyone knows that. I also asked why we hadn't received anything in the mail if there was a judgement against me. I was told they were still investigating to make sure they had the right person. Oh, and when we first called, my husband was talking to a guy before we called another number I had been given on my many voicemails, and the guy asked for my husband's name, at which time my husband said  "you don't need that information" and the guy on the phone got rude and we eventually hung up after my husband had a few choice words for him. I will say that many many years ago I did have a loan that I got behind on and I WAS served at work with a summons and they do not ever give you the 24-48 hours notice and ask for 2 forms of ID. That is just another way for them to get more of your information, to give them ID. I explained to the lady I talked to today that since I owe no debt and have nothing in collections, the calls to my home phone, work phone, and cell phone will stop or we are contacting our local district attorney's office to report them.

I too have been getting phone calls recently on both my cell phone and home phone from someone named Aaron Matthews. He states on his message that someone will deliver a summons to me within in the next 24 hrs. and it is imperative that I call another number to clear this up. The other # (s) I have been given are:
855-826-8569, 716-514-4888, and 877-433-0266. When I call these numbers, I get a voice mail also and have left messages twice already. This morning I received yet another voice mail on my cell phone. In my last voice message I left I explained I needed to know who they were calling for, who I owed since I was not aware of anyone I had outstanding debt with. It would appear to me if I had enough outstanding debt owed that I would have gotten something in the mail at some point wouldn' t you think? The only bill (medical) that my husband and I were paying on was for HIM, not me so I don't know what this is in regards to. They will never leave that info on my voicmail, and I have asked them to as I would like very much to know what this is in regards to. I am like others on here and afraid someone will show up at my work with a summons to court for something!

These guys are violating every FDCPA law out there.  I am not sure how they stay in business.  They go by McArthur Allen and Associates, or Legal Carrier Services (and probably a host of other different names).  The new number they are using is 877-861-3758. Write down each call and time.  Keep your VM's (tons of violations on VM's).  Keep track if they give your the mini-maranda (this is an attempt to collect a debt....).  This disclosure has to be given at the front of every call before they disclose to you the information on the debt. Make sure they verify your full name, address before disclosing a debt to you.  Keep a written record of every conversation in detail (this can be used against them in court).  Each FDCPA violation can net you 1,0000.00 and that is written in the FDCPA.  And you can also sue the individual collector per violation per the FDCPA.

I have received several from the same company.  I asked them to send proof of the debt and all they emailed me was a letter stating the settlement they will accept to avoid a judgement.  I asked for proof where the debt came from - they only had the account number and the Credit Card Company name.  His name was the Michael Kirpatrick that everyone speaks of.  I threatened me if I didn't pay something he would have me served within 24 hours at my home or my work.  It has scared me.  I don't feel comfortable giving him a credit card number that he has requested.  I am scared still and don't know what to do.

They don't have any of that because unless you are served by The Sheriffs Department with a summons then they are violating the Fair Debt Collections Act and can be fined and in some cases sued.

I have received a call from the same law firm claiming the same issues. However they say by tomorrow my case will be handed over to our local DA office in my county if I don't comply with them immediately. The number they gave this time is 972-638-8400.

KW reported this about six weeks ago: "The man identified himself as Dan Gallante and said he had several complants of bank fraud ..."

Therefore, and not surprisingly, equating debt with crime is part of your toolbag at the extortion office.

Settlement for "wholesale price" is no bargain on a debt you refuse to prove exists.

Lemme' guess. The boss chewed your a** and so now you're gonna' try the "soft-sell" approach. Ain't gonna' work. You've been exposed for what you are and there's no going back. Take a bit of advice. Scrap this number and hire smarter people, yourself included. Now go away. We've all had our laugh at you. We've got better shills to fry.

} you alone are responsible for the consequences

Spare us the mock indignation, Mary-John. "Harassing phone calls" to alleged debtors are not a justified "consequence". They are illegal tools of extortion. Ditto for posing as lawyers, making false legal threats, and implying that consumer debt is a criminal offense.

Here are pointers to other facts you missed in your shop's twenty minute FDCPA compliance orientation:

Well, that answers that folks! Shill, go take a long walk on a short pier. You'll fool no one on here.
There's just nothing quite so pitiful as a shilling, fraudulent collector. Your Mother must be so proud.
What a sad joke you are. And by the way, I don't owe any debt. So think of something more original than your usual line of trash.

Well, if you were "served" and have a "judgement" on your cbr, you are certainly no friends of these people..right?
So why don't you be so kind as to supply us with their address, valid phone number, the Attys. name that handled their case and whatever various pieces of information you can think of that might help others in dealing with these "oh so legitimate" people. You want to be of help....right?
Somehow, I don't think you'll be back. Prove me wrong!

I recently dealt with the company mentioned in regards to several debts my son owed. They were very professional and were very courteous. At first i was curious so i did some research and looked further into his credit history. The debts were valid and i payed them. I am 57 years old and i have never ever received a call for a bill in my name that i did not owe. The reality is that part of being a responsible productive member of society is paying your bills in a timely fashion. If you take out loans and credit cards without the financial stability to pay when you owe them, its as simple as you should have never taken them in the first place and you and you alone are responsible for the consequences. Whether that be harassing phone calls, bad credit, etc. I made that very clear to my son as well. I also advised him that i will not be helping him any further.

We can always tell when things aren't going so well in the boiler room. Sites like this make it tough to extort money over the phone, don't they? We know, but it nice to get confirmation directly from you crooks.

I'd say nice try, but there's nothing especially nice about fraud and extortion. Does you mom know you're a career criminal or did you threaten to "serve" her too?

They have already violated the law in accordance with the FDCPA .  Upon your request,  they have 5 days to provide written validatin of the debt and their right to claim and collect.
When they refuse,  that means that they have nothing to validate it except threats.  Don't just ask for something in the mail,  Demand written validation.   If they can't or won't prove  the debt is owed,  then you don't owe it.
That would be like me calling you and saying your owed me money for something.  Unless I can prove it, no one expects you to hand over money to a stranger for no apparent just cause.

They have called me 3 or 4 times.  Have spoken with Dan Gallente and Michael Kirpatrick.  Both have been rude and told me I was being sued over an outstanding debt, which I never had.  When I ask them to send me something in the mail, they refuse.  They threaten to serve papers, to which I have told them to please do and stop calling.

I have filed a complaint with the FTC which i suggest you do too.  Let the feds shut these guys down.  https://www.ftccomplaintassistant.gov/

They are clearly scammers.  Be careful!!
