I received a letter from the Bureau of Consumer Protection.  My State's Attorney General forwarded their investigation of my claim to the FTC.  The FTC is now investigating Matthew....AGAIN.  Hopefully they won't let him cut a deal again.

I'm posting the update because Matthew and his gang of idiots are starting to call me again.

It's a collections agency people.. You are getting called cause you SCUM BAGS OWE money. Don't take out loans and not pay em back if you don't want people to call you about it. I've dealt with this company and had no problems. I spoke with a woman named Brittany Daniels and Mathew Jasinski and they both were very polite to me. I knew I had owed money, I was never told I was getting charges pressed me. I know the FDCPA and they did not break any laws when talking to me. Just because you talk to one person and there rude doesn't mean the whole company is. This company is obviously not a scam YOU OWE MONEY PEOPLE TAKE RESPONSIBILITY AND PAY IT BACK. Your just a bunch of scum bag people that need a reason to bi*** cause you don't wanna do the right thing and pay back something you did in the first place.

I made a complaint with my State's Attorney General.  I received a letter today notifying me that they were investigating the company and have received numerous complaints about them.

Central District officers, responding to reports of a burglary-in-progress, spotted two suspects inside a home at 289 Highland Ave. on Friday night.

Police reports indicate the men had burglary tools and were stripping the house. They pried off antique leaded and stained-glass windows and doors.

Officers Edward M. Cotter and Timothy McDonald said they caught two men fleeing from the rear of the property.

Charged with burglary, felony criminal mischief and other counts were Matthew J. Marcucci, 30, of Dingens Street, and ***.

Police said they were alerted to the burglary by a neighbor who lives next door to the unoccupied home where the break-in occurred.

A Buffalo man has admitted bilking a victim of telemarketers in a scam by posing as someone promising to recover her lost money.

Matthew Marcucci, 22, of 51 Dingens St., pleaded guilty to one count of wire fraud before U.S. District Judge William M. Skretny. Sentencing is March 21.

Assistant U.S. Attorney Joseph J. Karaszewski said Marcucci was a participant in a "recovery scam."

He admitted that he telephoned a victim in Pennsylvania who previously had been victimized by telemarketers. Marcucci falsely told the woman that her lost money had been recovered. He then convinced the victim that before she could receive her money, she was required to wire money via Western Union to pay for recovery expenses, which she did.

The case was investigated by the Federal Telemarketing Task Force, which is made up of agents of the U.S. Secret Service, FBI, U.S. Postal Inspection Service, Internal Revenue Service and state police.

The old chestnut of "we already sent the proof; we can't send it again." is designed to put doubt in your mind that perhaps you mislaid or overlooked what they sent.  Saying you can't get the proof of debt till you make a settlement arrangement is also illegal.  Don't fall for it.  The burden of proof is on the caller to show you owe a debt to them.

No one calls you to give you a heads up you'll be served - the process server shows up, unannounced.  Please do report your callers to the FTC, FCC, FBI and your state's Attorney General.  Again, per the FDCPA, you have a right to have proof of debt and proof that the caller has the legal right to collect said debt, mailed to you.  Refusal to do so and excuses of "we already sent that" are illegal and you should not pay them.  And if you are worried you may have some sort of legal action against you, please feel free to call your local courts and ask there - they can tell you if your name is on a court schedule.

They have called my dad a month ago, as well as 2 of my work locations (and our company's labor dept), and my husband's and my cell phones. They don't leave me messages in VM, but they do leave verbal messages with my dad and work stating they are calling about a claim against me, and I have 72hours before I am served, if I don't call back. I researched the return call back number online and find all these scam claims, but I had enough today and answered. All of the calls are coming from ananymous also, and what legit legal company would block their number when they want a call back? Patrick (Wagner I believe) is who the initial calls are said to be from, but once I refused to confirm or deny my SSN, he forwarded me to their "settlement group" so I spoke with Joseph Allen. He claims I was mailed proof Nov 6th (obviously I never received it), and claims that he cannot re-mail as it won't arrive before I am served, and also that he cannot email the proof of debt letter until I agree to make settlement arrangements. At this point I am waiting to be served, at least then I will know this is legitimate.

This co. is a SCAM ran by Matthew Marcucci. He is a prior felon w/ a record, has no connections w/ attorneys and is stealing your $$ to support his drug habit. Our firm has been retained to file a few fraud charges against you in ________________ county. Ok what I'm going to do now is go over the deposition with you....if at any time you have any questions, feel free to stop me. First I want to make sure I have the correct person. You're obviously familiar w our client, correct? Whats being stated in your case is that on ______ you received a loan from this corporation. The legal investigators at our firm have been working in conjunction w local authorities. They placed your case under an investigation. You need to contact the NYS Attorney General's office for illegal practices. You are entitled up to $1,000 per violation of the FDCPA laws that are in play. This Co. is a SCAM and is operating illegally. If you are contacted by them, record the conversation, contact an attorney and get up to $1,000 per violation they commit. That includes misrepresenting themselves as a law office, claiming you have criminal charges against you for a bad check, any type of fraud they state you committed and so forth. Their practice and tactics need to be shut down immediately. You may also file a complaint w/ the NYS Attorney Generals office and Federal Trade Commission for violating state and federal laws (FDCPA). I received a call from a female claiming her name is Haley James from phone number 855-212-7258 and she is stating that this is her 3rd attempt and I have to call back because I have felony and fraud charges against me and she stated that in order to pay this I will need to pay $2150.00. However, she would not provide me with the company name and when she asked for the last four of my social security number I gave her 1234 and she continued one to state that I have charges against me. This is a scam!!!! Do not give any information to them. In fact when they call again tell them you have your attorney present as well as, a police officer and they will hang up. They also call from a blocked number.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.
