Debt Collector
Legacy Reliance Group kept calling my family and threatened my aunt that she was going to be arrested (I guess the caller assumed my aunt was me). When I called the company I was so worried because I had no clue what they wanted. Walter took my call, he was very nice and professional. He told me that it was a bad debt from 2009. I told him that I wanted to verify that the debt was mine and to send me proof in writing. He said that he had already done so and didn't have the time to send me another letter. I told him that without verifying the account information in writing, I couldn't confirm that it was my account. He got rude, real fast. He said that there is no time to dispute the account and that I would be seeing him in court.

Their ploy is to scare people. First thing he did was verify my information, which was up to date and correct. Then he proceeded to tell me that there currently is no warrant out for my arrest. This kinda freaked me out. Why would there be a warrant out for my arrest?? for not paying a debt?? The way I see it, if I haven't yet received any documentation regarding this  complaint and since they refuse to "resend" documents, I have nothing to be worried about.

I spoke to other collection agencies in the past and asked them to send me documentation to confirm or dispute the info and without hesitation they sent it to me. Based off of this, I think that this is a scam. I will let you know if I ever receive a summons or anything from Legacy Reliance Group.

gave us a case # and said the name of a person that was a really weird name was going to sue us, didn't say why, could tell by the name it was fake.  I told them didn't know that person, she could go ahead and sue.  They knew our full name and address.

They called my HR department and said they needed to get a hold of me.  That is wrong.  When I called back - they put me on hold for way to long.  I have no idea what this about!

Youm are doing everything right here.. It seems like they are a typical scammer. If they can not supply you proof then they have nothing. Also servers do not call you to forewarn you they are going to serve you papers. Did they only offer to take a credit/debit card or have you get a green dot or send it western union?

I always ask them what addres do I send the payment to.. They will either give you a PO BOX or an address like this or UPS Store that has a so called "suite" number. Also check any address they give you out and you will notice the above is the address .

I checked with a UPS store and the owner of the box can have the mail forwarded to another address.. That is how they do it and it is hard for them to be found.

Ok, so Im bored. I figured Id write out all the info I have so far on this "company".

Earlier this week I recieve a message on my work phone from a Mayra Cruz. In this message she left a file number and said it was about a "complaint" being filed against me, and that if I dont call they will "make a decision without my consent". The number she left to call back was 855-318-3937. I didnt call them back since it seemed like one of these payday loan scams to me.

2 days later, Mayra Cruz calls my works receptionist while I wasnt here and said they are trying to serve me paper work. The receptionist transfered her to my HR dept and Mayra told them the same thing about trying to serve me papers. Naturally my HR dept told me about it.

At this point, it prompted me to call them since they were calling my HR dept. So I call back and ask to speak with Mayra Cruz. They answered it "Corporate answering services". They tell me they dont know who that is but transferred me to someone named Joseph.

Joseph proceeds to tell me its for a debt I owe to a credit card company I actually did used to do buisness with (this is when I started to fall for it). He says they sent me two letters telling me they were going to sue if I dont pay (they never sent me anything) and he proceeded to read me my correct address. Joseph did not have an accent, and actually sounded very professional.

I told him that I need proof in writing showing that I owe this debt and then I would look it over. He then tried to offer me a variety of payment plans to "settle out of court". I told him if he can prove in writing that I truly do owe them this debt, then I may consider one of those options. He said he would email me all the documentation but I would only have 24  hours to "virtually sign" these documents and provide them with my debit card number. This was yesterday, and he never emailed me anything. I even called him again to verify he had my correct email address. He simply replied "Oh yeah...it takes a while, youll get it soon".

So I contacted a lawyer to see what they said. They clamied to never have heard of the company, but to send them a debt validation letter. So on thier website (www.legacyreliancegroup.com) I found the address:
155 N. Riverview Drive Suite 100, Anaheim Hills, CA 92808
So I Googled this address and found out that it?s a ?Virtual office? address. In other words, no one physically works at this address. Its an address companies can use to have mail sent to, or to use on a company letter head. Anyone can set up one of these virtual office address for around $50.
So now, Im going to send a debt validation letter simply to see if I get a reply, and contact the original credit card company to see if they do business with this Legacy Reliance Group.
Ill keep this updated as I find more info.

if they have your SSn , sure they could. some just buy old junk debt others the debt is made up .. see the payday scams forum threads.... they will not send you anything because they do not have legit proof. You may get an email stating you owe it but that does not prove it unless they show you your signature for the loan etc..

Thanks, but how would they know about a legitimate credit debit I owe from 5-6 years ago? Can scammers just pull your credit report? Anyway, the guy said he was going to send me some info via email to verify the debt and guess what...he never sent anything. I even called them to to double check and make sure they had my correct email. Hmmmm.

Make sure you get this right.. Theyare real people with fake names, fake company, fake website that gives no info on were they are located or who operates them..
The address on the website goes to a "virtual Office" so maybe these people are not real but virtual people..
They are SCAMMERS PERIOD!!

My DW got several calls on various lines (including her parents) with the same type of demand... it was a message from Brian Foster who stated that he was calling about a "Complaint" which immediately raised concern for DW.  When returning the call, they answer Corporate Answering Service.

I'm going to ignore it for now, but would like to escalate this as this is clearly in violation on so many levels...

Legacy Reliance Group's website is a joke, sighting that they are one step ahead of the legislation governing their actions... clearly NOT.

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.
