Debt Collector
This company has called with threatening messages, stating that I am going to be served and could possibly be in trouble with the law.  In fact the very first phone call I got from them stated that there was a bench warrant out for me. When I called them back I was sent to three different people who stated that I owed money for an old credit card that has been closed out for years. When I tried to research the company I came up with nothing valid. They will not stop harassing me. My second red flag was when they called me and when I dialed the number back it was a magic jack phone number. Is there something that can be done to stop this scam???

I also received a call from this company "Leigh & Associates".  They had all of the my personal info.  They threatened to take me to court for "Malicious Intent" to defraud a credit card company.   He stated that the district attorney would not go easy on me for that.  He wanted me to settle for over $572.  He also called from 1-855-432-6887 and gave me Fax# 915-266-3422.  Leigh & Associates 12672 Limonite Ave. #3E-541  Eastvale, CA   92880. I spoke with two different people one was Joseph Evans and the other Connor Morgan.  I will be filing on this company with the BBB.
I have been scammed before by another company 3 years ago stating they were "Direct Litigation Group" 27475 Ynez, Rd Temecula, Ca 92592.  Ph#888-311-5934, Fax#866-686-1287. They also threatened to file charges in court. One person's name was Darby Grant and the other Nina Roth. I paid them over $500 before I realized they were frauds!  They were supposedly collecting for the same debt as the above company.
I turned them into the BBB. I was told by BBB if the company cannot give you the attorney's bar number they are not a LEGIT company!

This company is a scam.  Do not talk to them.  They will call your family members and threaten legal action if they do not give out your personal address (which they don't have because they are a fake scam company).

Ignore them and they'll move on.  If you call them they are unprofessional and will give you fake information to try and scare you.

No one gets a heads up they'll be served - the process server just shows up.  Besides this, if you really did owe a debt and it had gone to collections, you would have received multiple dunning letters first - if you ignored these, then the account might go to litigation - meaning, you'd get sued.  Debt collection is a process.  You don't just suddenly get a call saying that "you'd better pay x amount of dollars by x time today/tomorrow, or you'll be served in the next couple of days!"

Per the FDCPA, you should not pay any caller who refuses to MAIL a debt validation letter - do not accept fax or email - which shows that (1) you do owe a debt and that (2) your caller has the legal right to collect said debt.  Refusal to mail this DV within five days of the first call to you is a violation of federal law.

I've linked an article (written by an attorney) about these fake process server calls:

This person called my mother's house looking for me, saying they were issuing a summons for me to appear in court, and I needed to contact them right away. When I returned the call, the guy on the other end seemed puzzled, and wasn't sure what to say. When I told him about the call to my mother, he said "Oh, let me check on that... oh, yes, here it is... where do you work? The summons' are usually delivered to your workplace." I informed him that I wasn't employed, and asked what I was being summoned for. He said he was calling regarding an outstanding debt that I owed my bank, and gave the correct bank's name. I asked a couple more questions, like where was he calling from, the company name, his name, etc., but he avoided answering, by changing the subject, saying I owed over $1000 dollars, and they were attempting to collect it for my bank, but that they would accept a smaller payment if I paid them right now, and the debt would be closed. I had him on speaker phone, and my husband heard the conversation. He told me to call my bank before giving them any money, (they asked for my debit card number), to see if this was a legit call. Since he had me on hold, I called my bank, to verify the information. They confirmed that I had no outstanding debt, and told me to contact the bank's fraud dept., which I've now done. As for the guy who called, when he came back to the phone, my nusband told him I was calling my bank to verify that he wasn't calling fraudulently, and the guy just hung up. My husband did an online lookup for the phone number I was asked to call, and this website came up. So, here it is: scam phone number - 855-432-6887

I got a call from this phone number and I was out to lunch so they called all around the company. When I returned their phone call some young guy just answered Hello and I asked him where he was calling from or company and he laughed. He first told me that they were coming to my company to serve me and when I asked again where he was calling from, he laughed and hung up.

Caller ID said it was a private number but they left a voice mail. Caller did not identify the firm she was calling from and it all sounded very official. I did not recognize the person she was trying to contact the name sounded phony to me. Maybe a scam

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
