dont ever make arrangement with these people. dont give out any info like your card number or bank number. they will clean you out. they cant come after you for no more than what you owe. and if you paid the loan ask them for their address so you can send them proof that you paid it off. i suggestion you let your bank know what going on and get a new card. and when the call again and you just so happen to ask. blow a whistle in their ear or slam the phone down. i bet they wont call again. or you can get their info and turn them into the BBB. but if you got the payloan in 2009 i bet the statue of limitations is already up. check for your state. but dont give fools nothing. they continued to call me saying i was guilt and i in turn told them if i am guilt why are you calling me. and then he hung up. i hear from these people one more time. i have heard from them since and plus my statue will be up soon. dont give in to these people. SCAM!!!

scam scam! dont let these people miss with your health. live your life and dont worry. you cant get blood out of a turnip. the statue of limitation is probably up. these people buy old debts and then try to collect on them by scaring people into paying them. when they call dont answer let them talk to the voicemail, which they probably wont leave a message anyway. if it was a legit business it would but its not so dont worry.ok

Ahaaa!  and the serpent rears its evil head.....

What a debt collector CANNOT do:

?Use deceptive practices. For example, threaten you with arrest or  trick you into paying for collection calls.
?Use obscene language.
?Call you at work after you tell them that your boss does not approve these calls.
?Deny you the right to receive a written notice (within five days after your first phone conversation) that would tell you how much you owe and the name of the creditor that says you owe the money. If you do not receive the notice within five days, call the collection agency and ask for its address and fax number. Then, send a letter to the collector noting its failure to send you the required notice. As a minimum, make a note in your file.
?Refuse to give its name and the name of the collection company when asked.
?Put a debt on your credit report if you file a dispute. It must validate the debt by obtaining a verification of the debt or a copy of a judgment from the creditor before continuing their collection efforts. The results of the investigation must be mailed to you.

This company called and left a message on my wife's phone that she was going to be served papers in a week and that she needs to call her back, so I called to find out who they were and just what she was going to have papers served on. Had to do with a payday loan but could not tell me when it occured. I asked what county this was being filled in and she could not tell me. She did say that if we paid it off today that she would stop the processing of the papers, I told her I think we will get our attorney involved and she said I had no right to an attorney that my wife was guilty, I told if we are going to court we have a right to be represented and she said no we do not that we were guilty. I said that is up to a judge to decide and that is when she hung-up on me.  Needless to say I have turned it over to my attorney. Bunch of knuckle heads.

All SHILLS never get past 6th grade. Great grammar and sentence structure, SHILL. Please inform me what the point is of paying a debt to someone who is just going to buy crack with it and WOW, the debt remains on your credit report because OMG! these a-holes STOLE the information from another agency or hacked into a Payday Loan site, etc.
And please please please tell me how paying 98% interest on $200 is considered a "luxury"? And, aren't a "borrower" and a "consumer" one and the same? You just received an "F" on your Social Studies test. The U.S. Government is surely not too concerned about off-shore payday loan companies being ripped off by "deadbeats" (by the way, ONE word). There are already many states that don't allow these bottom feeder payday loan companies to lend money to their residents. About Midland? I just Googled "Midland" and the first article to appear was regarding their executives admitting to suing less than 2% of the consumer accounts they purchase. If you believe that is suing to "prove a point", you don't know math either, my dear SHILL. You are aware that the internet is available to everybody, correct? From a financial standpoint, a company would be out of business quite quickly if they sued on principle. Give your 6th grade educated brain a rest, go take another hit off your crack pipe and think about getting a REAL job besides that of "extortionist".

Debt is a civil matter and there is NO GUILTY PLEA TO BE GIVEN IN A CIVIL MATTER. What the hell is wrong with everybody? Did you all skip Social Studies in High School? It's truly sad to see the lack of knowledge of the Judiciary system of the United States of America. And all these posts about filing complaints? How do you file a complaint against a company that DOES NOT LEGALLY EXIST? As far as telling you they'll enter a "guilty" plea for you? As stated above, there is no plea involved in a civil suit, and the judge is the only one who could enter a "guilty" plea for you if you fail to show up to court. And, how is an illegal "debt collector" going to bring you to court anyway? I'm pretty sure that would be like your drug dealer suing you for unpaid cocaine debt.
Ignorance of the law and gullibility is the reason these jerks are still in full swing all over the place. Pretty much 9 out of 10 debt collectors are probably scams by now. And, every time one of these fools buys into their threats, they grow stronger and get bolder. I've been posting on here ever since my information was stolen off a payday loan site someone hacked into 7 years ago and no one seems to be "getting" it. You see people posting "What do I do? Is this call for real?" when there are two pages of posts prior to their post saying its a scam! Read the thread first! Everyone wants their work done for them, but then they're still too lazy to read what's been done already!
Get lost,

Oh, gee, "someone", if they're legitimate, why don't you post the information about this "company"? Like their NAME AND ADDRESS? HAHA! LOSER! SHILL! Get lost!
You're a "no one", really! Is it worth $5-10 bucks to cheat people out of their hard earned money so you can get a bowlful of crack? Do you sleep at night?

Please be aware that "someone" is a SHILL, and is probably given $5-$10 for crack to write posts in here to proclaim the legitimacy of the "company" you believe (and, btw, are CORRECT ABOUT) to be a scam.

I've been getting calls from Stillman, Weiss and Associates, the call comes in as Western Recovery 716-718-8975 also private number. They call 2-4 times a day. Today the call was a real person telling me the call was for James Henn. Also said they were going to come a arrest me, if I didn't respond that was a plea of guilty. I called back at the 855-628-7731 used the case number they gave and told them this isn't James Hen. I feel if someone really had something on me they would use my name. I've never used a payday loan so I'm not sure how they got my number. Wonder if this James Hen put down a fake number it it is mine.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I appreciate the opportunity to pay off a bill, if I owe it. I also appreciate the common decency of receiving an email confirmation of the arrangements. I paid on an old debt the same day this company told me they could not verify my card information. I have taken enough paralegal courses to know I have rights also. Any other company can give me the information on my application and is more than willing to send me confirmation on the arrangements and provide how long it will take to reflect with the credit bureau.

I have received the same calls from 3 different number from Spielman and Weiss on a pay day loan from 2009. I am confident I paid this loan. They were threatening to take me to court. I made payment arrangements. Now they are saying my card is not vaid. I pay all bills from the card my pay check is deposited on. Now they are calling me 3 times a day DEMANDING I send the money by Money Gram
