First off these people violate so many laws, they can not represent their selves as anyone other than there own company, by law they can not threaten legal action....if they call record the phone call (let them know you are recording for legal purposes on you behalf), they will change there whole tone, and offer you payment option, tell them that's to much and offer like 30 bucks a month (by law if your trying to pay they can't turn it down) they'll say no, then say I'm sorry and let them know that's all you can do and your covered

In 2007, I had a "to the point, very polite" talk with an operator from a collection agency. I told him that the phone number he had for me had belonged to someone before Hurricane Katrina in 2005. This person had defaulted on her debts. The local phone company then assigned the number to me! There were no more phone calls from the collection agency.

That I was able to conduct this discussion over the phone is surprising, because I read now that these collection agencies MUST provide you with written documentation. So, this guy did not have a real address on this bimbo, only her name and phone number. As I have read in the postings here, these people who phoned me were in effect behaving in a criminal manner as well! In other words, I was lucky to get away with "the skin of my teeth" against them! Don't play games against these people!

If you are expecting the DNC to block all of your unwanted calls,  then it's not going to happen.  It  is a list that legitimate businesses use to honor those who wish not to be Called by Telemarketers.  Scammers and the unlawful will call regardless and there is nothing anyone can do except get a Call blocker...

TexasT, they are not a collection agency OR a law firm OR a law enforcement agency. They are criminals. They are attempting to frighten people who don't owe money into paying up. This is basically extortion. Anyway, being criminals they don't much worry about what's against the law, especially as Internet phone and SMS (text) technology makes them virtually untraceable.

It IS AGAINST THE LAW for any collection agency to represent themselves as a law firm, or law enforcement agency if they are not!!!!

There was a message on my answering machine from Kayden Asset Group.  It was for someone not at my residence and indicated that it was in this person's best interest to contact them and that a response was expected.  For the last 3 days I have called 1-855-848-1092 to advise them that it is in their best interest not to call my number again, ever.  There is a message that states that this number is not currently set up to receive calls and to try my call later.
What kind of a two bit outfit is this?  Have the authorities finally caught up with them?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

These people have been calling not only myself but all of my family members and even friends.  They've threatened to sue me and once even said arrested.  They constantly say this is my last warning and they are going to serve me at every location the following day but of course they NEVER do and I have NEVER received anything in writing.

I called back once and spoke to someone name DAVID WILSON who sounded like he was calling from India.  He gave me a social security number that wasn't even mine and then hung up on me.  Yet they still keep calling... I feel like I need to sue these people for harassment!!  Now someone named BILL HOFFMAN at x 117 is calling.... Last week it was a male black named CHRIS MARKEE (Sp?)

I just got a call from them on my work phone line, but I let it go to voicemail. They claimed to be from the "Kaden Asset Group, LLC". They had a file number and said there was a returned item from my bank. Complete BS, as I haven't had a returned item from my bank. Not calling them back, since I know they are scammers.

The FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf treats the INITIAL CONTACT between collector and debtor (first call, first letter, first whatever) as a special event. Legit collectors per section 809 of the FDCPA *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it (coercion) is illegal.
If they say the FDCPA does not apply to them because they own your debt, the debt-owner exemption only applies to the original owner. A 3rd party who buys the debt for the purpose of collecting debt is treated as a debt collector and not an owner and must obey the FDCPA as explained in this FTC Staff Opinion letter here http://www.ftc.gov/os/statutes/fdcpa/letters/arbuckle.htm
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint with your state AG.

Dee,  the Do Not Call Registry is powerless against the scammers and the scum who will call any number they want regardless.  The DNC is a simply a list of numbers that don't want to be called by telemarketers (telephone Sales) .  It is based strickly on the honor system because anyone can call anyone that they want to call.

I received a call from Anthony as well.  He said he had some papers to deliver to me that needed my signature and to have an ID and a witness.  He had a thick southern accent and he talked very fast like he was trying to hurry up and get off the phone.  He also said he was from PCS Delivery Service.  I have never received a call from a delivery service trying to deliver something to you. Very suspicious. He left the same number to call back on 855-848-1092.

Hi Everyone,

The Company that is calling you from 716-568-7006 OR 855-848-1092 is Audubon Financial Bureau.

Their address is P.O. Box 283, Getzville, NY  14068  also  P.O. Box 901, Getzville, NY  14068.  They also call from other numbers such as 855-373-1821; 855-893-2466; 716-218-2152; 855-676-2518.

Please note that they are in direct violation of the FDCPA guidelines.  However, until enough people report them they will continue to get away with it.  They use P.O. Box addresses because they probably change them frequently.  However, they are located in New York, and their company is Audubon Financial Bureau.  I reported them and they have not called me again.  I did not owe them money.

But even if you do owe money, a collection company is not suppose to use harrassment tactics to collect.  But you MUST REPORT THEM TO SEE CHANGE.  Good Luck!

Exactly dont ANY ONE OF YOU give these people money, they can ONLY threaten you with words, IF indeed you owed the money they would have sent you letters in the mail giving you a reasonable time to dispute the debt, then time to act upon it. Whether you feel that you owe the money or not DO NOT send it to THESE people. I had paid on a past due debt with payment arrangements, and I requested a paid in full receipt on multiple occasions and I havent ever received one, well guess what I still get calls like these. So now I dont know who I paid or who got my money or if I paid the correct people or not. You can just simply ignore these calls, they can call til their blue in the face and for years to come, thats their problem. Change your cell number and change your bank account ASAP. I have had these idiots call my employer and they told a coworker all about it. If they do this to you dont give in, just explain your situation to your coworkers, and they will completely understand. YOU are NOT the scum of the earth because you owe on a past due debt, you are just like the other million americans struggling to keep on top. Then you get idiots like this trying to threaten you, I assure you they cannot press charges, nor will they show up at your work/and or home serving you with papers, they throw the fact that you need a witness in there simply to have you think that you would be embarrassed to have someone have to be there with you, so they think you will call them and give in. One told me I had to have my boss with me when they served papers to my work/and or home, .... (and/or home) this tells me they are just reading from script,

I just got another call from this number so I decided to mess with the guy - I was like, "Yes, why thank you for returning my call, it's seems you owe my client a substantial amount of money - would you be willing to pay me now over the phone" The guy told me "We are trying to collect a debt you owe." I told him,"I understand that, but it's only fair if you are going to try and scam me, that I try to scam you back" and I hung up on him.

I know the call is fraud because my wife and I don't owe money to these types of places. We only have a mortgage and a car loan and they would never contact us like this. We've been threatened with litigation in the past and I tell them plain and simple,"If you truly believe we owe you money and you claim to have my address, then serve me papers and I will see you in court, but until then you won't see a dime from me, please stop calling me"

We have yet to be served or receive any formal letter in writing of this supposed debt.
