Texas Debt Collection Statute

It helps to act quickly. A consumer having difficulty paying a debt can contact the creditor, explain the circumstances, and offer to work out a payment plan. Sometimes the creditor will refinance or otherwise modify the agreement to give you a chance to catch up.

It is to the creditor's advantage to avoid bringing in a debt collection company. However, if it begins to look like you will not be able to pay the debt within a reasonable time, the creditor may sell it to a debt collection company for less than the face value of the debt. Then the debt collector will try to collect the debt, up to the full amount, from you.

In any case, the law does provide you with some protections against creditors or debt collection companies trying to collect money you may owe.

Protections Under the Law
The activities of debt collectors in Texas are regulated by the Texas Debt Collection Act. The Act prohibits the use of fraudulent and abusive collection tactics by individuals or corporations to obtain payment on outstanding debts against a debtor.

It is unlawful for a debt collector to attempt to collect more than the amount originally agreed upon – whether the agreement was in writing or not. However, the debt may be increased by the addition of attorney fees, investigation fees, service fees, collection fees, or other charges if a written contract authorizes the additional charges.

If you dispute an item in the file a debt collector has on you, you must give the debt collector written notice. The debt collector is not required by law to cease collection efforts if you merely call the debt collector about your dispute. Written dispute of the debt is best accomplished by sending your complaint to the debt collector by certified mail return receipt requested. Keep a copy of all correspondence you send to the debt collector. The debt collector has 30 days after receiving your written request to determine whether or not the disputed item is correct.

If it is incorrect, it must be corrected. The debt collector must notify anyone who has already received a report containing the incorrect item. If, at the end of 30 days, the debt collector has not been able to determine whether the item is correct or not, he or she must make the change you requested and notify anyone who received a report containing the incorrect item.

If it is later determined that the item was correct after all, you must be notified and collection efforts may be continued.

Harassment and Fraud are Prohibited
State law prohibits the use of harassment and abusive collection tactics. It is illegal for any debt collector to:

■threaten violence or other criminal acts;
■use profane or obscene language;
■falsely accuse the consumer of fraud or other crimes;
■threaten arrest of the consumer, or repossession or other seizure of property without proper court proceedings;
■use the telephone to harass debtors by calling anonymously or making repeated or continuous calls;
■make collect telephone calls without disclosing the true name of the caller before the charges are accepted.
The use of fraudulent or deceptive practices is also prohibited, including:

■using a false name or identification;
■misrepresenting the amount of the debt or its judicial status;
■sending documents to a debtor that falsely appear to be from a court or other official agency;
■failing to identify who holds the debt;
■misrepresenting the nature of the services rendered by the collection agency or the collector;
■falsely representing that the collector has information or something of value in order to discover information about the consumer.
Your home and wages:
Some collectors will threaten to take your home or wages to pay for a debt. In Texas, if your residence has been declared a homestead, it cannot be taken to pay a debt except for debts taken for the purchase of the home (ie, a mortgage in default), for home improvements, for home equity loans or to pay certain taxes. Wages may be garnished only to pay debts related to court-ordered child support, back taxes, and defaulted student loans. Debt collectors cannot garnish wages for repayment of consumer debt.

Penalties for Violations
Violators of the Texas Debt Collection Act are subject to criminal and civil penalties. Consumers who think they have been harassed or deceived may seek injunctions and damages against debt collectors.

These actions are also violations of the Texas Deceptive Trade Practices/ Consumer Protection Act which gives the Attorney General the authority to take action in the public interest.
Federal Fair Debt Collection Practices Act
Texas statutes cover actions by anyone trying to collect a consumer debt. The federal Fair Debt Collection Practices Act applies only to collectors working for professional debt collection agencies and attorneys hired to collect a debt. It is similar to Texas law, but also prohibits:

■calls at work if the collector has reason to know the employer does not permit such calls;
■calls before 8 a.m. or after 9 p.m. unless the collector knows such times are more convenient for the debtor;
■"unfair or unconscionable means to collect or attempt to collect a debt;"
■any conduct to harass, oppress, or abuse.
If you are being subjected to harassing, abusive, or fraudulent debt collection tactics by professional debt collectors, and you want to stop further contact with you, notify the collector in writing. Keep a copy of your letter and send the original to the debt collector by certified mail.

"heather" left me a ugly message i called to tell them not to call my phone because the person they are asking for does not own this phone......the men were really rude, hung up on me twice.....i threatend to file a complaint with the attouney general in which they hung up on me again.....they are ruthless....if you have a debt settle it with the company you have the debt with, because the low life losers dont know which way is up and which way is down.

this company wont stop calling my job. i have been "wrote-up" once already and my employer said she would fire me if i didnt get the calls stopped. this "tony martin"- calls several times a day and just leaves a # to call. he has called so often that my employer now knows his voice and just hangs up. she has even threatened this "martin" guy that if he continues to calls to harass her employee, -she- will file suit against them. still the calls come in - several time a day and all week. they would call my house # all hours of the day and night until we were forced to change the number. this isnt trying to collect a debt- it's stalking!!!!

I continuously get a call from this number on my cell phone.  So when someone from this company decided to be "courteous" and leave me a message, I called them back.  From the moment  the woman who answered, she was rude, mean, and obnoxious.  I told her that I didn't have any information on the person they were trying to reach.  I also told her to stop calling my phone.  It did stop... for about two weeks... and has recently started up again.  And because the caller ID only states "630" and the person calling immediately hangs up when I do answer, I researched through my old cell phone records to find the phone number.  I called them again, the man who answered was rude, mean, and told me he couldn't take my number off their records because I was "withholding information" for the person they were trying to reach.  I told him I was contacting the NM Attorney General and he hung up.

I am proceeding with an official complaint to the NM Attorney General.

They called my husband at work, caller was very rude and said that they were going to freeze his assets and garnish his wages. Now I have done the research and in the state of Texas they cannot do this. I have contacted a lawyer who is taking the case. If any of you can get recordings of them harassing and threatening  you they would be very helpful to put them out of business and end the calls for everybody. keep calling me at work.  
Will only give that they are with AAM and give an ID# and phone number to call back.  
Refuse to say what it's regarding.
I do not return calls w/o knowing what it is in regards to and from looking on here at the purpose of the company, I don't have any idea why they'd be calling me?
They do tend to be very rude though; when I get the messages, the receptionist always emphasizes that they are not polite in the least.

Allied Asset Management Jose Sanchez, very strange and to the poit rude. Handling a matter that concerns you.In order to give your input on this matter.....Same speech they all use who calls from here.Unknown caller pops up and they don't say thank you at the end of there speech. Just very Freakin' rude.What are they afraid to identify themselves. Maybe they would get there money if people calling wouldn't be rude.

Most recently I have been getting calls from this number for a Jasmaine Bell, there is no one at this number by that name.  Upon returning the call to explain this information there was one of your employee's who was very rude and my 1st call he ask if I had just hung up on him, I said excuse me and he slam the phone down it took me six attempt to get him to answer the phone so I could explain my reason for calling.  He said his name was Jamie.  The caller that has been calling my number leaves the name of Michelle.  I do understand the kind of business your in however you should screen your employee's and maybe you'll get better results as to collecting.  Please discontinue call my number or I will be forced to take this matter a step further I have recorded each call for any further problems that may result into a court matter.

I have been receiving calls from this number as well, looking for someone I don't know.  As stated above it's Alliance Asset Management, a debt collector.  I called the number back just now and spoke with someone, told them that I was not the person they were calling for, not had I ever heard of him.  The guy was nice enough, verified my phone number and asked how long I had had the number.  He told me they would remove the number from their system- I hope this to be the case.

this number is from a payday loan provider.  the person or persons calling from this number are representatives of a pay day loan company.  if you have an outstanding loan, or have ever used a payday loan company, then this is why they are calling you
