I received a call last year telling me that I had an outstanding payday loan to the tune of 500.00. My wife and I have never taken out a payday loan for anything because we know it's a trap. I tried explaining that to the woman on the other end of the phone and she told me that if I didn't pay the money I would be arrested on the spot and taken to jail for fraud. We paid that loan off but now about the same time as the phone call I got last year I get another call about another payday loan that was for 200.00. Again I try to reason with the woman and tell her that we never took out a payday loan and that we had already paid the company for the payday loan last year. Yes believe it or not it was the same company calling me about another loan that we allegedly took out. Now I am sorry but if you give someone a loan and they don't pay it back I don't see how they would give another loan to that person. I am just tired of getting phone calls and getting threatened. If you get calls from this number try to find out who the company is that is calling you and talk to an attorney so that way you can get the phone calls to stop.

Dorsey Thornton & Associates, LLC, a Georgia debt collections company, and its principal officers Wyteria Dorsey and Michael Thornton, have entered into an Assurance of Voluntary Compliance with the Governor?s Office of Consumer Protection (OCP), resolving charges that the company committed multiple violations of the federal Fair Debt Collection Practices Act and the Georgia Fair Business Practices Act. OCP?s investigation stemmed from a series of reports from consumers that Dorsey Thornton & Associates harassed and deceived consumers by:
Threatening consumers with arrest or imprisonment if they did not pay the debt;
Refusing to send consumers written proof of the debt owed;
Identifying themselves as ?Investigators? rather than disclosing that they were debt collectors attempting to collect a debt;
Contacting third parties and divulging information about the debtor?s account;
Calling consumers before 8:00am or after 9:00pm
Continuing to contact consumers even after they told the company to stop calling them;
Under the Assurance, Dorsey Thornton & Associates has agreed to forego collection of 31,433 accounts, representing a total of $15,491,899.36 in consumer debt. The Assurance also requires the company to pay a civil penalty and to reimburse OCP for investigative and legal expenses.
?Debt collectors who engage in this kind of harassment, deception and other illegal behavior in the state of Georgia must and will pay a steep price,? said John Sours, Administrator of the Governor?s Office of Consumer Protection.

some collection agency for PDO Financial, his name was Adrian Wolf and mentioned a payday loan in his awful information and Dorsey and Thornton - that I should've gotten court papers (which I have not). He mentioned court fees and attorney fees and a total of $567.66 that I owed. I do NOT remember Any payday loan that I defaulted on. I'm so mad they contacted me at work - NOT OK!!

This is all scammer/debt collector propaganda. No one goes to jail for civil torts. Failing to show up for a small claims civil hearing is not contempt. At best, failing to show up and defend one's self guarantees default judgments.
Nor, do scammers/debt collectors have any decision making capabilities as to whether or not someone goes to jail.
This spam post is filled with so many legal inaccuracies that it is just best to ignore it.

This guy is lying! They are simply a scam collection agency located here in Atlanta, GA. I'm currently working with law enforcement to get these scam artist closed down. They are not PI's but merely a scam collection agency that claim to have an arrest warrant out for a PDL. Listen people, report them to your local law enforcement if you've received a call from them. DO NOT pay them anything.

Question 1. What state is this supposed check fraud court in? Can you show us a picture of the building with a sign clearly demarcating "Check Fraud Court" or some such thing? If you're doing research and presenting it in academic settings like colleges. . .or even at a high school, it behooves you to get building titles right.
Question 2. Most states that allow payday lending do not allow business to pursue a defaulted payday loan with the usual "bad check" laws? What sort of checks were resulting in these imprisonments?
Question 3. ckfraud.gov doesn't exist. What say you?
Question 4. Why does it matter that the company was in business since 1992? You segue from school research to having had a payday loan yourself. . . care to comment?
Question 5. How much did your collection agency pay you to write your post?

I am doing a school project in my finance class about debt. Pay day loans is part of my search and I just posted this statement on another site and now I'm commenting on this one...First of all through my research when you google loanpayday.com they do exist. The company has been in business since 1992. By the paperwork of the payday loan that I had previously it stated that if I do not pay back the loan I will be held responsible for court fee, legal fee and collection fees due to the company that trusted me to loan me the money. That is the factor to the matter in this situation. YOU OWE PEOPLE MONEY!!!!!! PERIOD!!!! As for FDCPA they do not have to accommodate you on these laws because they are not collecting the money like a loan they are going based on your state laws as if you would search www.ckfraud.gov and it shows that YOU BROKE THE LAW WHEN THAT CHECK WAS KNOWINGLY RETURNED FROM THE BANK UNPAID. My mother is a paralegal and she really schooled me on this situation. After she had to pay the payday loan back for me she asked a judge friend of the family to allow me to sit in check fraud court hearings. Most people was able to get off on a fine and others went to jail because it was a repeat act. I'm currently doing a report in my financial class and this topic is part of my search. After reading your blogs I had to educate the stupid. You guys are stupid to think that you would allow someone to borrow money from you and the person you gave the money to did not give it back. Better yet howabout if you sold a car to someone and they gave you either a cashiers check or a check for the car. You go to the bank and they came back as a stop payment. How would you feel? People like you are partial of the reasons this economy is in bad shape. People do not pay there debts. Hide under Bankruptcy and think all is good.

So this Ameriloan company does have to follow FDCPA laws & regulations? I was just curious, because I work for a collection agency and I know that you have certain times during the day that your allowed to call and these people go way outside the limit of that time. I know what it's like to have collection callers, being one myself but I am not like some of the rude ones, I'm actually nice to the people I talk to. Someone at this company asked me "Do you understand English" ??? Oh boy was I mad, seeing that I was born & raised in the US and do not even know how to speak any other language but English. I wanted to sue so bad, but knew that if it wasn't FDCPA I couldn't do anything so I'm trying to find more info on the company.

Don't get scared, get angry.
If they use tactics like threats, refuse to accept checks, etc, then they aren't legitimate. Report them to your Attorney General, and don't cooperate with them in any way until you get written verification of the debt sent through the US Postal Service. If they cannot manage that, then they aren't operating in a legal manner. You do not have to give anything to people that break the law as regularly as they do. Demand they obey the law.
Don't take the threats seriously. That's all they are. Threats. No legal authority whatsoever to do what they say.
Don't give them ANY information.
Only respond to legal, written communications sent through the mail. Refuse to discuss any debts over the phone. Then HANG UP.
Don't deal with "collectors" who break the law. They don't deserve a cent.
