No, I did not.  My job was cut due to budget cuts.  There are many out of work in my area and most of the companies here closed up so there are few if any jobs open to apply too.  Unemployment ran out one year ago.  My husband is forced to take lack of work days so we have been trying to live on 24 to 32 hour weeks for four years.  The bills for utilities, gasoline, insurance, food, continue to go up but our income continues to go down. Until this economic mess, I always paid my payments on time. I raised four kids and helped them while they went to college.  the credit card co. has continued to raise the minimum, more than tripled what i actually owe them, and they refuse to work with me.  I can't give them what I do not have.

Got the irritating call this morning... called 'em back after a couple hours... Yes, they are CardServices, and they were looking for someone who owed them money. I told him that I had had this phone number about a month, and he removed it from their system...

Make a call and find out what's going on. If they got it wrong, they are happy to help you out...

WOW...I know we cannot pay this credit and I've sent a certified letter of "Cease and Desist" and they STILL call. They called last night at 9pm awakening my husband that previously had a heart attack and stroke. Ticked me off.

To the people who attempt to pay, even just a little, listen up!  Do not pay them ANYTHING!!  What they are doing is buying old debts that are about to exceed the 7-year limit (in which it is then removed from your credit).  The original debtor wrote this debt off years ago (which helps them greatly at tax time).  

After these scumbags purchase the nearly expired debt, they begin their game of serious harassment to try and get you to pay them (and they bought your debt for mere pennies on the dollar, mind you).  Once you pay them, you now owe them said debt and the debt will remain on your credit, once again, for 7 years from the date of last payment.  

Don't give in to these bottom feeders - either ignore them or deny the debt, but do not pay them a penny!!!!

I personally do not use credit, as I went bankrupt nearly 15 years ago when I was younger and never, ever bothered with credit again (even saved and bought our car with cash).  These creditors love to shove their credit cards in peoples' hands (and yeah, I realize no one held a gun to anyone's head and made them use the card, but people are human), charge them outrageous rates and late fees, and then even after you have paid them for years on time, when something bad happens to you (like losing your job) and you have to decide between feeding the family or paying your credit card bill, they have a complete s***-fit when you decide to feed the family.  Well tough crap!  The way I see it now, if someone wants a credit card, they should go looking for one, not have one shoved down their throats!  So eat that, you POS creditors!!!

I have almost the same exact scenario as you do with these people, except I only spent $200 on the card, paid it off, and then they tacked on an annual fee (After saying there would never be one!), then late charges for the PAID-OFF $200...although my payment was NOT late!  I wasn't going to pay it twice, so I quit paying them, and it shows as charged off on my credit statement as well. They have been calling for years, and when you do get a person on the line, they are very nasty!  They need to be investigated!

This phone number belongs to a scam collection agency. If you live in Texas they have no recourse. Just ignore them and don't answer the call. That is what answering machines were invented for. After 4 years in Texas they can't do anything past the statue if limitations. Most of them are all talk and have no written proof of the debt they are calling about any how. If you can just ignore them they will finally go away. They can't do anything but bug you by all the phone calls.

Do not pay them anything! The moment that you do, you are by your actions legally implying that you owe them something and that they have a right to collect! If the company you are paying is not the original lender of said credit, then they have no legal grounds of recourse unless you comply. You never made an agreement with them for extension of credit, so you don't have to pay them and then once it is over 4 years in California, you have even more rights to ignore it. Maybe that's not the whole legalities of the matter, but that's what Suze Orman says.

NO don't send them anything. It will only make worst. If they are collectors and in a diffrent state then you, they can't do anything. If you pay anything they will really come after you. They will sell the debt to someone else and so on and so on till there's nothing left. You want some help go to getoutofdebtfree and check them out. I did and they saved my sanity.

They call and if try to check our answering machine. I wish when I answered they would talk to me so I can tell them we filed chapter 7 bankruptcy. If I can prove these sperm donors are checking our answering machine, I wouldn't have to file bankruptcy..I would own Merrick bank. Bunch of Jackholes!! Guess I will have a cease and desist sent along with copy of Chapter 7 BK!

I see you work for a CA. Could you give me some advice on this ?

We have been getting old debt calls for my wife's ex-boyfriend, from almost 10-years ago recently.
I had been giving his contact info to them in the past, however, latest we heard, he's living
in a tent in someones backyard down south. (He's a drunk and lost the place where he lived)

I have passed this info on to them, and they have said they would remove our number
from their calling list. The last guy I spoke to, I could tell, really felt for my situation.
Even saying something like, 'sorry to bring up a sore subject' - meaning my wife's ex.
The calls stop for about a month, then someone else starts calling.
(They sell off the debt - to another CA, would be my guess )

Is there anyway to stop this repeated chain of events from happening, over and over?
The guy doesn't live in the state where we live. Lives in a tent down south, somewhere,
and are just tired of the calls.

Just seems like, this CA finds out he's not here, attempts to find him down south, can't locate him
and then gives up. Next, they must be selling his debt to another CA and then it starts all over again.

Any ideas WJN ? ? ?

You can yell at them till your blue in the face, but they keep tellin you, what your name is and that is not my name. I keep telling them, dont call me and that I'm reporting them as soon as we hang up. What they tell me, " I dont have the guts to report them" Well, guess what. I did report them, and  I do have the guts. I'm on the do not call list. Thanks for all the info everyone.

If you filed bk like you indicated, call all of your creditors and notify  them of that.  Be prepared to give the name of your attorney, the chapter, the attorney's number, andif you have it, the address of the attorney, the name of the law firm, and date of tghe bankruptcy.

When you did the bankruptcy, you trusted that the attorney, the courts, and the post office have done thier job (ie, providing written notification of your bk status). It, like anything else in this world, does not always work the way it should.  

The creditor has probably not gotten notification, especially since your bk is so recent.  Don't get angry, just be proactive, at the minimum, have your bk information handy so that when the debt collection associate calls again, you can confidently apprise him and the debt collection firm of the bk and give specifics.  

Once you have done that, if they are professional, they will forward the information to thier legal professionals and the matter will be resolved.

If they call again, take notice, and let your attorney have the specifics of the call, he will know how to proceed.
