Attn: Barbara A. Burke: Statutory Agent / Executor to do business in Ohio

How do you get this info? Simple Call the number back and find out the name of the business as the guy stated above (which is really good advice!). Or Google the number and/or check message boards like this one. Once you have the name look up the Secretarty of State. In this case we know the business has an Ohio location or address. So we go to the Ohio Secretary of State. You then want look up UCC filings or do a name search of the business. If they are located within that state, all of their business filings will show up. Just click on the link to view the pages (actual documents) and you will be surprised at what you find out!

In this case. Allied Interstate Inc, is based out of Minnesota and the CT Corporate Systems is just an executor that is an ohio based company that merges with out of state companies so they can do business in Ohio. If you look up a lot of collection agencies that are based elsewhere but do business in Ohio, you will see thier name. Don't write to them or call them regarding any account disputes as they won't be able to help you. But they can give you the parent company name, the state they are located in, and various locations. In this case Allied Interstate Inc., is again based in Minnesota but operates in Ohio.

Debt Collector
I got some unwanted calls today and I Googled the number of 877-642-1263 got  Allied Interstate Inc, 3000 Corporate Exchange Drive, Columbus, Ohio, 43231, 1-877-642-1263. Now unlike most here who are afraid to call back, I called them. I love it! I know the law and have a standard procedure. First get the full name of the person(s) with whom you are speaking to. Next I get the name of the company and a contact address. (They are required by federal law to supply this) next we go into why they are calling. A male voice with a heavy foriegn accent asked me to confirm my name and I did. Now what that does is prevents them from calling your employer, family, friends, etc under discovery... which they have the legal right to do... but only once. Next we get the name of the original creditor as well as the original account number. (This is highly important!) Next you ask them if the account was charged off and/or the date the account went to collections. This is also very highly important!!! This t**** head c**** jockey told me the original creditor is Sprint and there was an outstanding balance of $200. Furthermore the charge off date was 1996!  Oh this is good and this is where I have a hay day with them. So already knowing the contact address of Allied Interstate Inc., I asked this foriegner if he was native born in the U.S. or an immigrant. Of course it is a bit off topic but stay with me here! I then asked him how long he has been employed with this Allied Interstate Inc., Of course they are going to want to argue and demand when and how you are going to pay the debt. Okay this place it actually like a 1/4 mile around the corner from me and now I will get to the hear of why I'm asking if he is native born, how long he has worked at this company or within the collection industry and lhow long he has been a resident of Ohio. He stated about 10 years. Good enough for me!

If you get what I am telling you then you get that they are normally reading from a computer screen and I have taken control of the conversation in a calm cool manner. When you are calm it frustrates people.  Now in Ohio the statue of limitations is 6 years on credit cards and such. It is 15 years for contractual debts and agreements. Lets do the math. 2012 - 1996 is 16 years. Bingo!!! Way over!  So I asked him if he was fully aware of the Fair Credit Billing Act, the Fair Credit Reporting Act, and the Fair Debt Collection Practice Act. (FDCPA). You can google these and if you are getting a lot of calls it would be helpful. But you might need to have a good understanding of the legal jargon.

You also want to be aware of the ...Telephone Consumer Protection Act of 1991. This Federal law, which became effective in December of 1992, places a number of restrictions on telemarketing calls to consumers' residential phone numbers. Under this law, a telemarketer must:

1. Limit its telephone calls to between the hours of 8 a.m. and 9 p.m.

2. Identify itself during telemarketing calls and provide consumers with
a telephone number or address at which the telemarketer can be
contacted.

3. Establish "do-not-call lists" for consumers who advise the telemarketer
they do not want to be contacted in the future.

A consumer who requests to be placed on a telemarketer's do-not-call list may file a private legal action against the telemarketer if the telemarketer makes two or more calls to the consumer within the span of a twelve month period. In a legal action by the consumer, the consumer may recover between $500 and $1,500 for each improper contact. You may wish to consult a private attorney regarding these options.

By these federal laws they have 30 days to provide you "More Definate Statement" which is a legal term for validation of debt. You need the name of the company, the address, the original creditor's name along with the account number to send them a "Cease & Desist" letter. You can Google that and get a whole host of templates. It pretty simple just needs to say the above info and you do not owe the debt! This is important too! Even if you owe the debt never admit to it or state that you are going to pay anything. By doing so you will restart the clock on the statue of limitations per your state.

I know, I know, blah, blah, blah. Just remember that if they decide to file a civil suit against you then it is on THEM to provide or prove the burned of proof. Now let me explain that. Lets say you have an account with Amazon and you default or just don't pay it. It will take at least 90 days to charge off the account and for them to do anything. Normally most companies will send it off to collection or sell your account to a debt buyer for pennies on the dollar. Do they have the legal right to come after you? You bet! I know it is a pretty crappy system! Yet they will attempt to seek the face value of the debt and not what they paid for it. Normally they buy a portfolio which maybe like 100 defualted (bad debt) accounts and yours will be among them.

If that happens, do not blow these collection agencies or debt buyers off. That is where they get you! If they sell your account to a collection agency then they have to prove the "Chain of Assignment", which means that have to show the accounting back to zero, along with an agreement, and your signature. Plus they have to notify you any time there is a transfer of assignment. This is done with a standard affidavit of a Bill of Sale, which has the account numbers, former owner of the account and the new one, aggreement, statements, etc. They need all that to prove in court the debt. Most don't have that but thet love scaring sooo many people in paying debts that are not theirs (as in my case) or that are past the statue of limitations... as we see here. In this case I say in a tactful manner.. "Screw you, I'm not paying your debt and I'll see your c**** jockey a** in court!" I'm a bit more professional than that, but you get the point!

When you know the laws as I do, you just recite them to the person you are talking to. Tell them to remove your number from their call lists and you will send them a cease and desist letter. If they call back you can sue them up to $1000 per call, plug with thing like punitive damages, etc.

In my case I told this c**** jockey who gave me a name of Jahar Preet to call me back and see what happens. I gave him the riot act with I love doing and he appologied saying he would remove my number and list the account as a mistake and/or a dispute. I printed off one of my cease and desist letters, hopped in my suv and around the corner I went. LOL I met the front deck person and demanded I speak with this Mr. Jahar Preet and meanwhile I had this lady sign & date my cease and desist letter. Obvious you can't do this if you're states away, but I had the chance and yeah... what the hell. Lets have some fun! LOL

I then had this lady copy my cease and desist letter and I asked her if she had a stapler and she offered one to me. On her copy I stapled my attorney's business card to it and wrote Mr. Jahar Preet a note. "Surprise Mr. Preet! Call me again and I will personally hand deliver you your court papers!" Out the door I went.

Getting back to a realistic approach... After you call them back and tell them the debt is NOT yours and you WILL NOT pay anything and remove you from your call list, there is one more step. I know you can all spend the time bitching and complaining here but that does not do anyone much good. You need to file a complaint with the Better Business Bureau (BBB), Federal Trade Commission (FTC), Federal Communication Commission (FCC) as they are calling you... Then a complaint to your state's Attorney General's office. Getting the address you now know the state the collection agency is in, so you file a complaint in the the company is operating in. Here is one you may never thought of. File a complaint with the IRS and tell them the company is trying to collect on a bogus account to offset their taxes! You tell them the alleged account has been charged off so the company is already show the account as a "bad debt" write off on their taxes and still trying to collect on the debt! There are many more comsumer bureaus and comsumer protection agencies. FILE THE COMPLAINTS to all of them. Then should they call you back or threaten to sue you in court, now you have a ton of documentation.

It only takes a few minutes to file these complaint and I love it. The company then get hammered by all these consumer protection agencies. It may seem like it is worthless, but trust me I work for a state agency. These palce will investigate and if there is enough complaints, the government agencies will step in.

Lastly 2012 is an election year. Hammer your state Senators for reform or you will not vote for them! Just avioding the calls do nothing except keep them coming. Stand up learn about your rights and show these pricks up!

And if you wonder how I know all of this, well, I battle this pricks daily! In fact I have taken a number to court and currently have a legalsuit against one now. I have $600 invested in legal fees and the first case I won. But in Ohio the collection agencies has two attempts and there are taking the bait! We have court records of the first case where the collection agency knowing instructed the court to send the complaint to a former address in hope of a default judgment. That didn't work so now they are praying for a summary judgment. I filed a complaint with the Ohio Bar Association and if I win, which I will, the bar is likely to jerk this debt attorney's license. I'm making money, supplying my lawyer plenty of work and compensation for every case we win and I can't complain! In fact I am looking to start a business because the money is so easy and good... if you stand up to these a***ole collection agencies. STOP paying them! Make them follow the law and prove you owe a debt!

Good luck eveyone!

The problem with the SOL issue though is that under some circumstances you can revive the debt by acknowledging you owe it.  And unfortunately, even if the time for them to initiate collection procedures has passed and it's even off your credit report, while they cannot legally collect it, they can continue harassing you over it attempting to collect it.  The harsh reality is that just because they no longer have a legal avenue for collection, the debt is still owed and they can try until the end of time to collect.

This number is associated with Total Card as well.  Total Card is a collection agency.  What happened to me was, I get calls from 8776421263 twice a day.  I don't answer.  Then sometimes, I immediately get a call following that from any of various cell numbers.  They leave a computer generated message on my voicemail, saying my name, saying its not a marketing call, saying its about business I am conducting, and saying to call 605-610-0358.  The 605 number is for an agency called Total card.  Look up the number on here and it is for a shady collection agency.

Get a phone call from this phone number once or twice per day.

Got a phone call from them today and they asked for my husband, although the accent they used it was almost unintelligible.

When I asked them to identify themselves, they gave me some name that I couldn't even understand. I asked them where they were calling from and they said, "a place of business." my response was, "no s*** sherlock! You want to try that again this time with a name for your company?" She refused to give me the name of the company.

She then proceeded to ask me if I knew anyone by the name of (insert husband's name here). And I told her I refused to answer any of her questions until she identified the company she was calling from.

I also proceeded to tell her that she was not going to get past me until she provided further information of where she was calling from and why.

She then started to get very rude and I basically said, "well, until you decide to identify yourself, you will not get past me because I LEGALLY own the phone number that you are calling. Therefore, I do not have to tell you anything further until you identify yourself and your place of business."

I've had the pleasure of being awaken at midnight by this company. i heard the phone ringing and freaked out thinking it was an emergency from a family member. no, it was an over sea's call. they asked for a person and i advised them that person didn't live here. i also had to inform them of what time it was, and all i got was "oh, it shows you're in California." Phone calls are ok at 9pm? He quickly stammered and advised me he would take the number off of the calling list, and hung up on me.

It's against the law for debt collectors to call on Sunday.  Easy lawsuit.  And yes they are trying to collect on Zombie debts.  And yes they do have various toll free numbers.  I don't pick up the phone when it's someone I haven't given my number to.  They come in on the ID as unavailable, toll free and private caller.  I have kept a log so if and when it's on. Will  contact the phone company to see if I can get a list of incoming or get my calls monitored.  Keep your answering devices on.

Picked up the phone.  The caller could barely speak English.  The accent made me think India, Pakistan, etc...

The fellow mispronounced my name so badly, that it was no longer my name.  So I told him "you must have the wrong number", and hung up.

If someone calls me thinking they are going to collect on a 10 year old debt that has changed hands 5 times and was wrongly attributed to me in the first place, then they definitely have the wrong number.
