Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

They are scammers for certain. I had a payday loan but it was paid. They are crazy and what they are doing is illegal. They had the date if the loan and my bank info wrong. They also change the numbers and phone messages. Don't believe them. Even if you had a debt from 2007 it would be hard to prove in 2013. They are just ripping people off. They told me I could get a per-paid card.

I also received a call from Preston Perice saying he's working with Pre Litigation Resolutions Inc and I almost paid it until I decided to research this company and make sure I paid the pay day loan with my bank information. but here is there Company information i think we should all end there information into the Attorney General.

Thanks all for your info this has been helpful..I do agree, this is somebody trying to get me to pay them back, yes, I did get a payday loan a couple of years ago and didnt pay back...circumstances prevented me from paying them back. But, I've been in a situation with writting a hot chk many years ago, the constable doesnt call you to inform you he will serve papers....he just shows up on your door step. The folks saying this is real probably are the people from the 877# cos they are able to read all these comments....they can kiss my natural black hind parts.

This company has called my phone and left messages for my husband. The messages state according to investigator Aaron Michaels and  Alisha Arnold my husband has a criminal matter pending in the county we live in; if that is true shouldn't the court system be contacting us instead of a debt collector? They are going to be sued for harassment. These people are scamming; the court system does not hire outside companies to harass people.

All the messages from these people claiming they were served are fake and probably done by the low life people at this company.   This is a scam.  I wouldn't pay these people anything.   They are not a legitimate company and I believe the people are making the law by impersonating investigators and threatening Rio serve people at work.   I used to work for a bank I'm collections and they are not following federal guidelines.

You don't need to even respond to these people.  If you were supposed to go to court, you would be mailed or served by a Deputy from your county.  They are scammers and have bilked thousands of dollars from innocent people.  I have had payday loans in the past, and I can say from experience, do not accept anything from these people, if they call, hang up on them and tell them you are calling the Attorney General to report them.

The address you have list is a bogus address.  Just call the local USPS and they can tell you if the address is a legit residence or business.  the address listed sits in a wooded area with no building on the property.

This lady called me last week saying her name was Korreta Clayton from the investigators office.                           She said i needed to call her @ this 877 number or she be forced to serve me @ my job or home for a civil complaint against me. My relatives got a call from Aaron Michaels  877-711-7318 x408   I called him and spoke w him. He states that he is a Private Investigator with a firm named Pre-Litigation Resolutions,  900 N Main, Lancaster, SC 29720,   This is real and not a scam.  We had a defaulted loan w a well known payday loan company.  He does not work for the payday loan company but rather w the bank that funds the payday loan company.  Our choices were to make payment arrangements or be taken to court for defalt of a contract and fraud.  In the long run it was to our advantage to settle out of court.

An Aaron Michaels 877-711-7318  x408  called my sister-in-law and cousin, telling them stuff like he's a district attorney, an investigator, an agent etc and warning them of litigation and that they are looking for us.  First I called the local District Attorney's office.  They told me that they would never call and want to confirm an address or any other info, if there is a warrant or to serve papers for summons to court that they would never call they would just come out and present/talk/p/u etc the said person.  Ok, so I called the number, it first comes on and says this is FreeLitigationResolutions and to input the extension number.
I noticed others talk about paydayloans.   In our case it may well be real.  A lot of people wonder how they get relatives phone #s.  Well, when you apply for a payday loan they ask you to list friends/family with addresses/phone #s, and they want your employer address and p# too.  That's one place to get the stuff. Plus, if you have the money you people can pay for a service that will give you all kinds of info, all they need is name/address/p#/social security #  (which you fill out on the application for a loan)  you can find out a lot of things like, possible relatives, liens, property info, utility info on and on and on.  It is all too real and chills me to the bone to know just how easy it is to get info on anyone.

Call allegedly came from Investigator Pearce or Pierce claiming that a summons might be issued for some unknown criminal matter if I didn't contact him immediately at extension 103. No organization or firm name given. An alleged case number was also given, and I was informed I must contact him immediately or further action could be taken. I have no idea what this is about.
