I wouldn't worry - they're scammers anyway.  It is illegal to refuse to give you the company name and address of the entity claiming to sue you.  You also can't be arrested for debt, since this is civil, not criminal.  Any legitimate and law abiding business would have no problem giving you the information you asked for, as well as mailing (not emailing or faxing) documentation proving you owe a debt to them.  It is also in violation of federal law (the FDCPA) to threaten consumers with arrest, or the serving of papers.

You've already done the right things by verifying that this is a scam via government agencies.  If these jokers call you again, tell them that you are recording them every single time on the advice of your attorney (even if you don't have one) for your own lawsuit against them for multiple violations of the FDCPA.

I also contacted Legal Action of the state I live in and was told that since I'm only receiving disability, don't have $5,000 in either my husband's or my accounts, and receiving food stamps, these people can take me to court, but that it would be thrown out due to the fact that in my state you can't be sued for check fraud on a payday loan.

Debt Collector
In June and July I received calls from a Stephanie Lopez saying that she wanted to verify my address as she wanted to meet up with me so that she could serve me.  When I asked her what it was in regards to and she responded, "Don't you know?"  and I told her I didn't.  She proceeded to give me a reference number and a phone number to call.  I called the number and talked to a Sarah Price.  I asked her what company she worked for and address, but all she would tell me that she worked for Consolidated and wouldn't give me an address.  She said I was being served for a loan I got in 2011 and demanded payment and wanted my credit/debit card number.  I told her that I don't give out that information over the phone.  She said that I could get a prepaid card and give her that number, and again I told her no.  She said that I would be served for breech of contract and check fraud.  At this point I blocked the calls from Stephanie Lopez and Sarah Price as they were calling daily.  Two weeks after I received a call from a guy who also said he worked for Consolidated and demanded payment or I would be served.  I told him that I refuse to give out any personal information and wanted the company's address.  All he would tell me was that it was in California.  I told him that he could go ahead and serve me.  I filed complaints against these people with the BBB, FTC, FCC and Dept of Financial Institution.  Since then I haven't received anymore calls from these scammers.

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I got a call yesterday and today from an independent processor on behalf of "SW GROUP" telling me he had court summons papers to serve me but if I called 1-888-271-1981 (when you call the number the automated system refers to them as "SouthWest Group")  within 30 minutes they would give me the courtesy of not being served at work IF i would give then a different address. I immediately called my county attorney  and county clerks office and they said there was nothing in their system for my name or social and my best bet was to wait it out and see if the papers get delivered.  Today I got the exact same call from the same guy and told him I had talked to the county attorney and it was fine to deliver them so I could take them to be looked at.  They guy said that's fine papers are on their way.  I have no idea what company they are representing and if it's real or not but it does have me a little bit uneasy.  This sound familiar to anybody?
