Congress passed the Telephone Consumer Protection Act (?TCPA?), 47 U.S.C. §227, to curtail the use of automated dialers and prerecorded messages to cell phones without the permission of the consumer. Notwithstanding the passage of the TCPA, many businesses have harassed consumers by placing literally dozens and sometimes hundreds of telephone calls to cell phones.
On May 11, 2012, the United States Court of Appeals for the 7th Circuit issued an opinion in the case of Teresa Soppet v. Enhanced Recovery Company, LLC. In the litigation, the Plaintiffs sued a debt collector attempting to collect a telephone bill from a third party. Plaintiffs sued Defendant for Five Hundred Dollars ($500.00) per telephone call and One Thousand Five Hundred Dollars ($1,500.00) per telephone call if willful.
In response to the lawsuit, Enhanced Recovery Company asserted that it was not liable under the TCPA because it had consent from the party the debt collector intended to call ? the actual customer of AT&T. In rejecting the argument of Enhanced Recovery Company, the 7th Circuit recognized that Plaintiffs are entitled to protection under the TCPA as they were the ?called party? under the meaning of the TCPA.

Just listened to a voice mail from this number. It was an electronic voice saying that they are Receivable P________ Management asking if I am __________ (some guy's name). If I am not, I was supposed to hit a certain number to end the call. If I am that guy, I am supposed to wait 3 seconds for a personal message to call 888-357-2131

Surprisingly pretty straight forward. I am still getting calls from other numbers that leave no messages...they just keep calling and calling...when I do answer, there is no one there.

They have been calling me for over 6 years, and never stop for more than a few months, even though I have never heard of this Sherry Terry they are looking for.  They are just too stupid to figure this out.

My mom works for a collection agency in Califronia & Palisades does report to your credit. It just depends on how old the bill is. There is a statue of limitaions in every state as to how many years something can be reported on your credit, usually its 7 to 10 years in some states less.

If you get a call from 8883572131 it is from RPM, a collection agency with offices in the Seattle area and Portland.

If they are calling for a debt owed to PALISADES COLLECTIONS, tell them it isn't your debt, or that it was paid, or anything. They have to dispute it and they won't call again and PALISADES isn't likely to do anything further.

Also, PALISADES does NOT report to the credit bureaus.

PALISADES is RPM's client. They buy old debt. SOme of the debt is from the 1990s and even the 80's. They can't provide you with proof of the debt because it doesn't exist.

Just tell them the debt isn't yours.

Also, if you tell any collector to remove your number and not call again, they MUST do it. You have to identify yourself, you can't just answer and say "remove my number" and hang up.

"Don't let an old debt come back to haunt you.

Some debt collectors are unearthing old debts, debts that are five to 10 years old or more, in the hope of squeezing some money out of unsuspecting consumers.

"I had one guy who got a call on a debt 14 years later," says Gerri Detweiler, author of "The Ultimate Credit Handbook."

A collection call on an old debt can be tricky to handle, and if you handle it wrong it could lead to big trouble down the road.

First, it's important to realize that an old unpaid debt can't hurt you nearly as much as a new unpaid debt.

An unpaid credit account will mar your credit report for seven years. But once your debt passes the seven-year mark, you're in the clear.

You are at risk of being sued for your newer debts anytime up until the last minute of the statute of limitations. With an older debt, any debt collector that threatens to take you to court is breaking the law.

That's quite a difference and it all hinges on whether the debt a collector is haranguing you about is beyond the statute of limitations for delinquent debt in your state.

Once a debt is older than the statute of limitations for debt in your state, a debt collector no longer has the right to sue you for payment. You may still have a moral obligation to pay back the debt, but you can't be sued over it.

"They can still ask you to pay, but they can't threaten to sue. If they do, it's a violation of the Fair Debt Collection Practices Act," says John Ventura, a consumer attorney in Brownsville, Texas, and author of the e-book "Stop Debt Collectors Cold."

Let's say you still owe some money on an old credit card account left over from your college days, 10 years earlier. Since the debt is more than 7 years old, it's no longer listed on your credit report. And let's say the statute of limitations for credit card accounts in your state is five years.

A debt collector may call you and ask you for payment for this forgotten account, but he can't take you to court or threaten to sue you over it. If he does, he's violating the Fair Debt Collection Practices Act.
What a debt collector cannot do:
•     Call before 8 a.m. or after 9 p.m.
•     Talk to anyone but you (or your attorney, if you have one) about the debt.
•     Threaten to garnish wages or seize property unless they actually intend to do so. Garnishment is illegal in some states, and in others requires a court order. In many cases, property seizure is not permitted. Check with your state attorney general's office or state consumer protection office to find out what is legal in your state.
•     Threaten to sue unless they are actually taking legal action. In some states, third-party collection agencies may not sue.
•     Threaten you with arrest or jail.
•     Use obscene language.
•     Annoy or harass you with repeated calls.
•     Call at work if you have asked them to stop.
•     Falsely claim to be an attorney, a representative from a credit bureau or a member of law enforcement.

Watch your step
Even though a debt collector won't ever admit it, you're the one with the advantage here. But one little misstep could change all that.

In some states, making a partial payment to a debt collector or even acknowledging that you owe the money is enough to make an old debt new again.

If this happens, the five-year statute of limitations on your debt starts all over again. A debt collector has five more years in which to sue you for payment. And a non-payment on your new-again debt could be reported on your credit report. Then the advantage transfers to debt collectors.

The best way to handle a collection call for an old debt is to say as little as possible. Don't agree to pay. Don't acknowledge the debt.

This has to be a scam.  They called my phone number looking for my mother-in-law (whom does not even live here), and when I asked them how they got my number they said she gave it to them, which is a lie.  We have NEVER given our land line number out, not even to family!  We only use our land line in case of emergency and use our cells for all of our telephone calls. They must have done some research and pulled up the same last name, and assumed this was her home.  First off, they answered the phone saying "Hello *insert mother-in-laws name*"... I thought my number was given to them by my mother in law in case of "emergency", they were all over the place and couldn't get their story straight.   When I finally said there is no possible way she could give this number out because she doesn't even have it, the operater got frustrated and told me that our conversation has gone too far, and then hung up on me... Ummm okay, most certainly a scam!

Repeated calls from several unidentified numbers asking for unbelieveble names.  they either hang up when the recording begins or leave a monotone message implying that it is a legitimate call.  They are creatively sneaky.  We simply never answer unless we recognize the caller ID name.  No message left means a less than legitimate call.  Do they really think that owning a phone gives them harrassment rights?

Called and left message.  Message was addressed to my wife concerning a debt.  Talked to the wife about this, and she denies not paying her bills and says they must have the wrong number.  Hmmm....well this is why we still have separate accounts.  Hope they can't come after me.

I just got a new phone from t-mobile yesterday and have received three calls from RPM, including one at 10:41pm.  I think I'll ask t-mobile for a new number because when I called RPM they did not sound professional, the customer service rep. wouldn't spell their name or give me their employee number.  I couldn't understand them and asked for a supervisor but they refused.  I just want them to stop calling me because I don't know the person they're looking for.

All my bills are paid on time. All the TIme.  All my Credit Cards are paid on time.  All the time.  I picked up the phone just for the heck of it and a recording told me to wait on the line and I did.  It told me to call this number and when I did ...it was in Spanish.  I pressed 0 for "operador" and nobody answered..it just repeated the menu in Spanish.  Don't pay any bill that you don't see in writing and never give any information on the phone.  So RPM, I definitely know I don't owe anyone any money.  Stop calling me..send me the alleged bill so that I can dispute it and prove you wrong.

I got two calls from this company. I got this girl Lisa and a man that is very rude, it is a scam!!!! This phone number is  really a UPS tracking number. I asked for there address and they hung up on me both times!!!

If they cannot supply a copy of the bill or proof of the debt, have the credit bureau verify this is a valid debt.  If they cannot do it within 30 days they must delete the item from your file.

And yes...Big Billy D. is an a**.  Just wait buddy...just because you told them you are not that person doesn't mean you have proven your not to these folks...You'll get another call, probably several;.  LMAO

Received daily calls from this number (on my cell phone) I finally called them back.  They said they were looking for someone (other then me) I told them that wasn't me, wrong #.  The guy responded "sure" and hung up on me.

If I'm reading this right, she said her husband asked the company to read back his social security number to determine if they were calling the right person. If my assumption is correct, neither her nor her husband are idiots. Regardless of the situation, no one deserves to be harassed by anyone. Normally a legitimate credit agency never asks or reveals a person's social security number.

This number has, also, called my husband several times a week at his work. I believe I have even spoken with the same person every time too. He is constantly rude, will not even give me his name or tell me where he is calling from, and it is like pulling teeth trying to get a phone number from the guy. He just tells me that my husband needs to call him and hangs up. (I believe he, finally, said he was with RPM.) If anyone else is receiving calls from this number, it's best to just ignore them or try to block their number.
