They took me to court and the judge read them the riot act as well as let them know that they may not even file a complaint as they are not a legal entity in the United States. Their representative tried to use different corporation names all of which were not legitimate registered corporations. They came after me for something I'd already paid off. They were in violation of California State Law as well as Financial Codes as noted in the order above. Do your homework and show up in court. It will stop these illegal organizations from doing business or harassing people. You can also file a claim with the California Deparment of Corporations. Good luck in winning. My case was dismissed.

This company has been doing business illegally. They place harassing threats to your phone even after paying off the principal and other charges. They have placed fake small claims cases and apparently have been found by the California Department of Corporations to be fraudulent. See the Desist and Refrain order below.  If you have any dealings with them you may want to notify the Califonia Department of Corporations Commissioners Office since they have been notified to desist and refrain.

be organized under the laws of St. Vincent and the Grenadines.  Its principal place of business is 1st
floor Marcole Plaza, Halifax Street, Kingstown, St. Vincent and the Grenadines.  L&M Financial
purportedly does business as 1000cashovernight.com.

2.  International Payment Services is an entity of unknown form.  Its principal place of
business is 9710 Traville Gateway Dr. #374, Rockville, MD 20850.  It maintains a website at
www.1000cashovernight.com.    

3. The website www.1000cashovernight.com states: ?We are committed to providing
overnight payday loans up to $1000 for individuals who are in need.?

4. Beginning in 2009 or earlier, International Payment Services, L&M Financial, and
1000cashovernight.com made payday loans to one or more residents of California.  

5.  Borrowers electronically sign a Loan Contract with L&M Financial Ltd., dba
1000CashOvernight.com.  The contract provides that the lender is L&M Financial Ltd.  

6.  L&M Financial, 1000cashovernight.com, and International Payment Services have
not been issued a license by the Commissioner authorizing them to offer, originate, or make deferred
deposit transactions under California Financial Code section 23005.  

7.  Borrowers are asked to electronically sign a ?Declaration of Wage Assignment? and
?Consent to Wage Assignment.?  This agreement assigns International Payment Services the total
sum owed to L&M Financial, authorizing the borrower?s employer to pay the amount due directly to
International Payment Services.

Based upon the foregoing findings, the California Corporations Commissioner is of the opinion
that L&M Financial, Ltd., doing business as 1000cashovernight.com, and International Payment
Services have engaged in the business of deferred deposit transactions without having first obtained a
license from the Commissioner, in violation of California Financial Code section 23005.  Pursuant to
California Financial Code section 23050, L&M Financial, Ltd., doing business as
1000cashovernight.com, and International Payment Services are hereby ordered to desist and refrain
from engaging in the business of deferred deposit transactions, including but not limited to originating,
or offering to originate, deferred deposit transactions in the State of California without first obtaining a
license from the Commissioner, or otherwise being exempt.  
Further, the California Corporations Commissioner is of the opinion that L&M Financial, Ltd.,
doing business as 1000cashovernight.com, and International Payment Services have engaged in
deferred deposit transactions including an assignment of or order for payment of wages or other
compensation for services in violation of California Financial Code section 23035(h)(3).  Pursuant to

My husband got called to work and was told it was a private investigator trying to collect for cashnet payday out of houston and if we didn't pay 1,200 my husband would go to jail at 2:00. Every time they call it's a different person and they took out 960.00 out of my account. The actuall cashnet said they never even heard of this affidavit proccessing company.I was told they were calling from houston one day and the next day they said no the company was in jacksonville,florida.Watch out for them.

Someone from this # called both my work phone and my cell phone. When they called work they got voicemail but no message but the message they left on my cell was very threatening. The woman stated that I had until close of business today to call them because their office had come to a final conclusion on my "case file" and that it was a serious matter - she "strongly urged" that I did not diregard the message. I don't even have any idea what "bill" they are trying to collect on. No one has told me details. Do they think I am just going to pay them? Uh no! I think that it's a collection from a "supposed" pay day loan that I already paid back! But they are trying to turn it into a larger amount. NOPE! I paid back what I borrowed plus fees -so they can find someone else to harrass!

This company identified themselves as Affidavit Precessing. They said I was going to be arrested for  a loan that originated at 450.00 however when they called that same loan is now over $2000.00. They threatened me of prosecution and arrest, called my work and the guy stated to my boss that he was "detective" Walker! He gave her a "case" number and stated it was from the county I live in and I needed to get an attorney! PLease watch out for these idiots! They sure have some rough scare tactics! I am looking into this further!

I wonder why the Attorney General from their state has not issued an order for Christian Nicholas to stop his illegal collection practices.  Now today they call my wife at work, and sorry but she was not even on this debt.  Guess we need to contact Obama of course he promised all kinds of Messiah stuff.   Lady was very abusive and threatning me to be prosecuted.  Thought loans fell under civil process. They called me and asked me for $2200 on a $500 loan dated back in 2005. This is 2010! They would not give me information on how they got my phone number but they did have my social security number and email address. They said the same thing that everyone else said. They called at 09:30 and said it need to be paid by 11:00 today. When I asked for a copy of the forms that they were looking at,they denied it to me. I informed them that I could have my attourney give them a call and they said that they would not disclose this information to them either. They said that they would go ahead and process the information and an order for my arrest would be entered by tomorrow. There were going to be three felony charges against me. I believe that this is fraud so I am not paying them one cent!!! I will check tomorrow to see if they were telling the truth or not and let you know. Their names, this time, are Makala Kern (receptionist), Michael Thomas (representative/assistant), and Robert James (supervisor/manager). Mr. Burnsteen is the so-called head of the bank he had to speak with to allow payment. But when I asked to speak with Mr. Burnsteen, he denied me. The receptionist took a  very long time to tell me the name of the company when Mr. thomas told me immediately. I believe that she had to ask him what he said the name was. They are horrible.County Tech support (yeah right), no such thing.

I returned a call from this firm today to extension 2106. The caller was very polite and stated he was representing an online loan company who was trying to collect on a bad loan taken out in  my name almost two years ago. I told him I was aware of the situation and that it was a case of identity theft. I told him I would be happy to provide him with my detective's name, my case number and a letter from my bank stating that this case has already been investigated. He then said that he would just make a  note in my file and take it off his desk....basically, he didn't want anything more to do with me. I don't know if I beat him at his own game, scared him off with my use of the word "detective", or if he was just legitimately trying to collect on this old debt. In any case, sometimes these companies are the first to alert you that your identity has been used without your knowledge to get loans, etc.- my advice is to get as much info as you can and then contact your bank. This is how I found out about my case of i.d. theft- which was  a nightmare, but had I just hung up on the first debt collector who called me, I never would have gotten the case resolved. Certainly NO FUN at all. People who steal identities should be publicly flogged!

My ex-husband of 7 years called me and said he received a phone call about me owing Chase Bank for a fraudulent check written in 2005 and if I did not pay, then they would turn it over to the Texas Attorney General.  Well, I called Chase to find out exactly what was going on and they gave me the number to their collection agency and the collection agency did not have me in their system at all and they referred me back to Chase.  I have not called back this 888-378-7575 number, but when I do, I will let them know that I know they are fraudulent and I will be reporting them.

I took out a pay day loan a year ago and paid it.  I received a call from Mr. Benjamin Cox, so called investigator, who states that I still owed for interest and penalties because i paid it late.  He threatened warrants, etc and had a Mr. Marshall Walker get on the line to some what threaten me so I paid $300.  I was stupid because i assumed that since i did have a pay day loan in the past that maybe they were right.  Loosk like I was taken for a fool!!!! They still want money from me but will get nothing.  I will file a complaint somehow.  Signed.....The Biggest fool!

I received a call from a friend of mine today that said they received a call from a man named Ben Cockes claiming to be a FBI agent and that she was listed as a witness on a case of mine that he was working on.  He wanted my cell number and some other information about me from her.  She took his information down and gave no information out to him. She then called me to let me know that he was calling to get information about me.  I am reporting them again to the FTC and Attorney General's office.  I have had the same call at my job in the last month and wish someone would do something with these people.  This is the biggest scammers ever and they are breaking all kinds of federal laws by just representing themselves as government officials.

I first received a voicemaiil from a guy named Benjamin Cox, who's states I need to have my attorney contact him.
Then second call, from Investigator Jennings (lady) that states I owe over a thousand dollars from a online loan I received back in 2008. (which is correct-but was paid off)  She states that she wants to get me on record by recording our conversation that I agree to pay this debt or I will be arrested at my place of employment.  At first, I was almost going to commit to paying, but before doing so I needed some kind of supporting document from her agency in which she said she'd give me time to contact a lawyer.  I went to three police precincts in my town, all said the same, "THEY CAN NOT ARREST YOU FOR A SIGNATURE LOAN, even if it is a million dollars."  I also contacted the local district attorney who confirmed what the police had said.  I never called Ms. Jennings back,and it was a few days before she called again.  Just to see if they were using caller ID, I asked her to verify my work number on the account, and she repeated what was on caller ID, that is when I realized it was a scam, our phone system shows a different ID # when dialing out. I was fortunate not to submit my account information to them.  She could not verify the last 4 digits of my bank acct in which the money was deposited.

The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.

Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.


How can I stop a debt collector from contacting me?

If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.


What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:

you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:

give false credit information about you to anyone, including a credit reporting company;
send you anything that looks like an official document from a court or government agency if it isn?t; or
use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.

Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.
