Kevin Madison said a friend of mine took out a loan, and did not pay it back, and they were going to come after me since I knew this person.  I informed them that I did not sign anything, and they said that did not matter.  There is some new US law that will allow them to show up on my door step with a lawyer and take me to court.

Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are ?spoofed? numbers, so that the number appearing on a consumer?s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer?s social security number, home address, e-mail address, names of family members and the consumer?s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as ?We?re filing an affidavit against you? or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General?s Office was repeatedly called both on her cell phone and at work.  Despite the employee?s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an ?officer?.

?I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ?If that?s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming?,? stated the employee.

?It is important for consumers to know their rights under the law,? Attorney General Six said. ?If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.?

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer?s arrest, or using the threat of violence.

number called me a million times from this number 052-797-721 they said I owed them mony for a loan that I took out in May of 2009 . I have no idea what the heck he is talking about and I told them that I would have my lawyer call them, he just kept calling my job over and over . Then he calle dmy cell phone. I told him if he needs to get in contact with me he may do so after 6pm. he still keeps calling.

I checked a miseed call this morning, and the # was 052-797-721.  Who ever it was, did not leave a voice mail.  Since I did not know who this might be or even what country, there was no way I was going to call back.  My rule of thumb is real simple...if you are not in my contact list, I have no desire to talk to you.  It can be a solicitor, a scam etc, so not answering or returning these types of calls out of curiosity, is not advised.

I rec. a call from 052-797-721.  Actually I got 13 before I stopped counting.  the caller, Patrick, with a heavy middle eastern accent finally started telling me that I am a stupid, stupid stupid man.  I am contacting the FTC and BBB now.

I too received a call from this number 052-797-721 from a gentleman with a VERY heavy middle eastern accent.  He transferred me to his supervisor and then proceeded to threaten me that I was being sued.  He even provided me a case number and demanded to speak to my attorney.  I happen to be an attorney so I told him that and that I would be glad to talk to him but that I needed verification of the debt pursuant to the FDCPA.  He started demanding my bar number.  When I refused to give it he got very rude and started threatening more then hung up when I told him he was going to let me talk.  I called the only company I am delinquent too (not hapy about it but hey I admit I owe them the money) and they confirmed that it was a fraudulent call and a scam and NOT to pay them anything to set up arrangements through them only.  This was CashNetUSA

First time they called and I did not answer, called ID showed up as (052)797-721.  The guy left a message saying he was from the "legal department", but did not leave a company name.  I called them back and told me that there was a case or judgement being filed against me. Then they called my brother's cell phone, how on earth they got that I do not know.  I googled that (052) number and got They told him that this was a legal matter and that I was in "big trouble".  I called them back and tried talking to them.  They kept dancing around what I owed them, and kept saying that I was going to be sued and I was out of options.  I asked for proof of what I owed them, they said that was "not an option at this point."  I finally asked for the name of the company that I had supposedly taken a loan out from.  They said the company name was AmeriLoan, and they gave me AmeriLoan's number.  When I called it sounded like someone at the same "office" that I had just talked too.  He too was very fague and kept throwing out empty threats about going to jail and $5,0000 fines.  The funny thing is that when i googled AmeriLoan and found the website, the numbers were different and sounded nothing like when I called the number that they had given me.  Im pretty sure this is a  scam, sounds like this is happening to a lot of people.  Scariest thing is, they had my social security number, yikes.  Filing a complaint with the FTC and Attorney General, and local police.

Got a call from these people. Obviously, I ignored the unknown number and went online and verified its a scam.

Don't be scared by the EMPTY IP tracing threat.

Post all your complaints on various boards to get the word out.

Moderators should remove the scammer's posts with a notice indicating users should ignore similar posts.

These people have been calling me since may of this year saying they put $300.00 in my account for a loan, I've never rec'd a loan, and I told them that, so the next time they called I told them to prove to me that they have put money in my account, they said they will send me proof, I haven't rec'd anything as of yet. The next time a lady name Irene call (you can?t barely understand any of them they have a very strong accent) called I told them to take me to court. They told me ok and that they was going to send someone out to my job the following Monday to serve me the court papers. Never rec'd anything and that was over 3 months ago. But they are still calling me at least 3 times a week, 6 to 11 calls back to back. Now their calling my coworkers leaving messages that it's urgent and they need to speak to me asap due to legal matters. My boss has even rec'd calls from them and told them to quit calling here. We have got the first number "052797721" blocked so they couldn?t call now there calling from a "0000" number, this is crazy. I just called them back again, and still got no where told them I had a attorney and let?s go to court. This is harassment, and need s to stop! These people are a bunch of crooks trying to scam people out of money!

This scam has been going on for well over a year, now and has been recognized as such by the BBB:

Chicago, IL ? August 5, 2009 ? The Better Business Bureau is issuing an alert about phony debt collectors that are calling consumers nationwide and claiming that they have defaulted on a payday loan and will be arrested if they don?t pay immediately. Claiming to be lawyers, the scammers say they are with the ?Financial Accountability Association? or the ?Federal Legislation of Unsecured Loans? and are equipped with a disconcerting amount of personal information about their potential victims.

?Because the scammers have so much information about potential victims, the BBB is concerned that this may be the result of a data breach,? said Steve J. Bernas, president & CEO of the Better Business Bureau serving Chicago and Northern Illinois. ?Thousands of people may have had their personal information compromised, and given the scammers? tactics, it appears that those who have previously used payday loan services could be particularly at risk.?

According to reports received by the BBB and posted online, the scammers accuse the victim of defaulting on a payday loan and claim they are being sued. The phony debt collector threatens that, if the victim doesn?t pay as much as $1,000 immediately via wire or by providing bank account or credit card numbers, he or she will be arrested and extradited to California within the hour to stand trial. The scammers often may have the victim?s Social Security, old bank account numbers or driver?s license numbers as well as home addresses, employer information and even the names of personal friends and professional references.

The BBB offers the following advice to consumers if they receive a suspicious telephone call about an outstanding debt:
* Ask the debt collector to provide official documentation in writing which substantiates the debt.
* Do not provide or confirm any bank account, credit card or other personal information over the phone until you have confirmed the legitimacy of the call.
* Review recent copies of your credit reports to ensure that the alleged debt is not affecting your credit. Consumers can do this for free once every 12 months, and can find more information here: http://www.ftc.gov/freereports
* Under the Federal Trade Commission's Fair Debt Collection Practices Act, debt collectors may not harass, oppress, or abuse any person while attempting to collect a debt.

This is a very active group of scammers, many of whom are calling from India (and probably other countries) and are in cahoots with a group of American pay day loan scammers. They attempt to extort money from consumers with a myriad of false and illegal threats, and alternately pose as debt collectors, federal and state law enforcement officers, lawyers and bankers. Their trademark is to use meaningless legalese gobblygook phrases like "We are downloading warrants against you" or "We are filing an affidavit against you." Another trademark phrase is to threaten the consumer with something like this ridiculous phrase: "If you don't pay then only God can help you."

Typical of many financial scams of this variety, they usually demand payment via Western Union or MoneyGram or credit card. They use any number of phony names such as US National Bank, Federal Investigation Bureau, US Legal Investigation Bureau, Hopkins Law Office, United Legal Processing, Morgan Associates, United Pay Services, National Processing, White Collar Crime Unit and many more.  These criminals also use many phone numbers from many area codes; they're probably using caller-id spoofing software and/or VoIP to disguise their real location.

The main thing to remember is that anytime someone calls you demanding money to prevent your arrest, or demanding your lawyer's name so they can sue you, it is ALWAYS a scam. No debt collector (let alone criminals posing as debt collectors) has the authority to have anyone arrested for anything. (And it's illegal to them to threaten such a thing.) And since these foreign dirtbags routinely impersonate law enforcement, it's also important to remember that American law enforcement officers aren't in the business of debt collection.  (Debt is a civil, not a criminal, matter.)

The bottom line is, these are criminals trying to steal your money.

A consumer posting a complaint about these same scammers at http://800notes.com/Phone.aspx/1-718-831-7157 notes that 718-831-7157 is associated with an India-based "outsourcing" telephone bank.  Though a reverse search on WhitePages.com shows that 718-831-7157 is an unlisted land line in New York City, information on Debtbuyers.Com shows that that number is used by India-based Intellisourze. This is another piece of the puzzle that fits in perfectly with other information about this scam. There are some reports on 800Notes that have suggested that the crooks behind this offshore scam are also the crooks behind the notorious Bass/Ellis Crosby & Assoc./States Predisposition scams in Florida and Georgia. The interesting thing is that the number of complaints on here about the US National Bank/US Legal Investigation/Federal Investigation scam skyrocketed *after* April 7, 2008 when Florida obtained a $1.3 million judgment against Ted Ellis Crosby, shutdown his operations and barred him from ever conducting debt collections in Florida (Read http://myfloridalegal.com/newsrel.nsf/newsrel ... 5257424005858A6 ) There's certainly a good chance that the crooks placing these calls from India are doing so on behalf of the American crooks behind the Crosby/Bass/States Predisposition scams.

Though scam calls from these crooks have been going on long before May 8, the frequency of complaints about these calls increased considerably after Crosby was shut down in early April.

This is conjecture, but appearances suggest that Crosby and company were originally running a two-pronged payday loan scam operation -- with some calls being made from Jacksonville, Florida and other calls being made from a phone bank in India (and possibly other countries); then, after the Florida Attorney General shut down the Crosby scams in Florida, the Crosby crooks transferred most of their scam efforts to the India phone bank.

If you are targeted by these criminals, be sure to report them to all the following federal and state law enforcement agencies (most of which you can do online or over the phone):

1) Alert the FBI at https://tips.fbi.gov  Be sure to tell the FBI that you are being targeted by extortionists over the phone. And if the crooks claim to be law enforcement, lawyers, officers of the court or bankers, or if they threatened you with arrest, be sure to include that information in your report.

2) File a complaint online with The Federal Trade Commission at https://www.ftccomplaintassistant.gov/FTC_Wizard.aspx?Lang=en

3) File a complaint with your local police. Most police departments will take a report over the phone.  Be sure to tell them that you're being targeted by an extortionist and give them all the details.

4) The caller placed the call under a Texas area code. Even though the caller ID was probably spoofed or they're using VoIP technology to hide the fact that they're really calling from overseas, you should also file a complaint with the Texas Attorney General at http://www.oag.state.tx.us/consumer/complain.shtml

5) File a complaint your state's attorney general, the contact information for whom is at www.naag.org

6) The U.S. Secret Service is responsible for protecting the country's financial infrastructure and payment systems from international and domestic threats. Call or write your local Secret Service field office to alert them to the details of this attempted extortion. The addresses and phone numbers for the local Secret Service field offices are listed at http://www.secretservice.gov/field_offices.shtml or in your phone book.

If these crooks call back, promise them nothing, pay them nothing and tell them nothing other than that you know they're a scam and that you've reported them to law enforcement. (And be sure to report them to all the agencies above each time they call you.)

They left me a message stating they were a collecting agengy, and they will make it a legal matter. I called and they said I owed money for a payday loan with United Cash. The thing is, I have never had a payday loan. I tried to get one 2 weeks ago, but the fees were to high, so I never did. I asked them to send me documents stating what I owe, and they said they could not do that, that it would go through court if I did not pay. I told them to sue me and hung up.

This is a collection agency calling themselves Federal Legislative.  They contacted me at work regarding a payday loan and they are using unscrupulous practices.  The first gentleman Malcolm Christian (with a heavily Indian accented voice) asked to speak to me then said he had to place his supervisor on the phone.  The alleged supervisor got on the line his name being David Scott (another Indian accent) was yelling at the top of his lungs.  I truly hope he popped a blood vessel.  He then asked to speak to my supervisor and when I asked him for what he said it was none of my business, go figure.  After getting nowhere with me and me telling them to stop calling my job he called back 8 more times and I just hung up the phone.  Finally, I placed my supervisor on the phone and David Scott illegally told him my information and threaten to sue the company of course my supervisor told him not to call back here again and how illegal it was for him to do what he was doing.  These guys are a bunch of Bozos.  I will be filing a complaint with the FTC for unfair business practices.  I wish I knew there legal name but they are a collection agency for CashNet payday loans.  I did get that much out of them.
