I have received 2 voicemail calls from a Mr. Bernstein, in one message he says that he is with the Attorney Network and then mumbles another firm name.  He also states that there is a pending matter against my social security number (then proceeds to tell me the last 4 digits of my ss#) and that he has been trying to reach me for the past 30 days (not that I'm aware of) and that if we don't touch base soon he will be forced to file suit against me for "theft of services".  After he leaves both of these lengthy messages he then rambles off a toll free number to call back and speak with someone regarding this matter.  It is all very strange and after reading some of the posts on this website I think I will look further into the matter before I consider returning a call or even picking up the phone with a caller id area code of 716.

This is a typical Buffalo, NY criminal debt collection group operated by notorious debt collectors Greg & Doug Mackinnon. Doug & Greg are known, as ?Great Closers? because they close almost every debt collection and attorney office them become involved with and this one is no exception. Currently in bankruptcy for their failed Unistates Credit, while trying to explain to investors what happened to their $20 million investment. Here is an email that explains what many viewed on a recent Dateline, NBC story featuring Buffalo, NY debt collectors.

I doubt he will last much longer. A check of federal court cases shows that Nicolia and his collection operations have already had 31 lawsuits filed against them. We can reasonably expect that number to rise as they grow more desperate to steal money they are not entitled to.

Stay far away from this group of scam artists, contact us for assistance, do not give them access to your bank or credit cards.

The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.

What types of debts are covered?

Can a debt collector contact me any time or any place?

How can I stop a debt collector from contacting me?

If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:

Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.


What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:

you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:

give false credit information about you to anyone, including a credit reporting company;
send you anything that looks like an official document from a court or government agency if it isn?t; or
use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.

Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:

But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

If you look up any collection agency or attorneys office, even tele-marketers you will find bad news on all of them just due to the business they are in. Some I will admit are bottom feeders, but all the information seems to check out.

I am in debt myself but any attorney, I pay. I do not need anymore judgments on my credit.

Well, the never stated where they were from when they called me.  And when I look up the information on "John Nicola" this is what I found:

EASTERN ASSET MANAGEMENT AKA ETHICAL ASSET MANAGEMENT is a bottom feeder Collection Agency, Extracting money by giving false threats and using intimidation tactics.

Nicolia John Law Office is a bogus front for their Collection Agency operations. They say they are a "Law firm". They have no lawyers but say they are a law firm (scam, scam, scam). They call people's families and say they are trying to keep their loved ones out of court and jail so they should make a payment right away. Once they get your money they vanish or change their number. There are many people that work in the "office" and they keep giving fake names. Avoid.

Do not return the call, nor give ANY information.  Report false threats to the Attorney General.

They do state they are a law office. At least on the message I got. The message I recd. said, "This is Bob Mckelvin calling from the law office of John Nicola (sp?) re:a complaint they recvd. and to have myself or my attorney contact them due to pending litigation.

I did look up this attorney and found he has a NYS bar #...

The company Name is the LAW OFFICE OF JOHN NICOLIA.... they aren't hiding. It even says that on your caller ID. If you were called its because your family member used you as a reference on something that went bad and the creditor is seeking legal action.

Then why don't they state what law office they are with so that the person they are trying to contact can verify they are legitimate.  There are just too many scam artist out there using whatever it takes to scare people into making mistakes and giving information to the wrong people.  
Due to my situation, I have been contacted by a lawyer before and they were up front with all of this information, not so vague as to who they represent.  Also, when I was contacted by a law office before, they not only called but sent a registered letter so that I had concrete proof as to who they are.  And I find it strange that this 888 number cannot be traced.  Yes, they have to provide a toll free number for you to call, but the other law office I dealt with... the number was easily traced right back to them.
As I said, I have been slowly getting back on my feet and have been in contact with my creditors and I am taking care of things.  I am not a deadbeat and have been greatly relieved to finally see the light at the end of the tunnel.

You were contacted by a law office. They obviously are either trying to collect or sue you. They also are required by law to have a toll free # for you to contact them on. Check your credit report, they are most likely listed on there with that same #.

I just received a call from this number too.  A Shannon Hunter-Lowe?  Same thing about a case number #181256
They told me or my lawyer to contact them or they would refer it to a lawyer in my area for further action.

This sounds fishy to me.  I have had some finacial problems since someone hacked my checking account in 2006, then I faced a serious illness in 2007 that had me off work for more than 6 months, but I have been slowly taking care of all the bills that became delinquent.  Since I have been in contact with my creiditors, this one just doesn't sound right.  I was just hoping that one of my debts hadn't fallen thru the cracks, but I would have thought I would have been contacted from the court, not some 888 number.

Got a message on my brothers phone, which immediately sent up red flags for me, since I am listed, and I'm not hiding!
It was from Julia Hargrave, saying there was a Complaint against me in xxxxxxxxx county.  
They left a Docket number and said to call them at this (888) number and I better contact my attorney.
Why would I have to call a 1(888) number for my local County Office?
Also, I KNOW I have no complaints against me for any reason.  When I looked up this number, another person was saying the exact same thing, except they were in another county and state!

Yup, something fishy here.

just got a call from my sister who lives across the country about the same issue, same phone number, same person julia hargrave. I believe it's a scam since they refused to give the company name they were calling from.

I didn't answer.  I got a voice mail saying they were looking for one of my family members which they called by name and wanted them to call 888-937-7937. (How did they get my number?)  Anyway, it seemed suspicious because they said they are from the county court system and left a complaint number.  When I went online and looked up that complaint number in the county's database, there was no such complaint.  Furthermore, the complaint number was in the wrong format for this county.  She left her name, Julia Hargrave, and phone number and the complaint number and stated that my family member or the family member's lawyer could contact her and if they failed to do so they would face litigation.  This just doesn't feel right to me.  1) Why would they call me instead of my family member 2) the complaint number is weird 3) why call from an 888 number instead of sending a letter like most court systems do?
