Recorded message said that we had a bad check. We've never written a bad check, ever. I chose to be transferred. The person asked for my wife and I said she wasn't in. He said he couldn't hear me so I repeated it. He again said he couldn't hear me so I repeated it. He again said he couldn't hear me so I adjusted the phone and said, "can you hear me now", and he said, "maybe if you get that s*** out of your mouth". It escalated from there with sexual comments about my wife. I returned his insults with my own expletives and hung up. He called back and apologized. He went on to say he was contracted by Capital One to collect on a credit card debt from over a decade ago. I refused to pay them because they gave me a card, I used it, they added on a annual membership fee that brought me over my limit and then added a fee for going over my limit. When I called them to have them remove the over limit fee because their membership fee is what caused it, they refused. I paid them what I say I owed them and they continued to send me bills for the over limit fee and late fees. My credit sucks anyway so I refused to pay it. It went away and now came back.
I check it out. If you go to this website: http://www.creditcards.com/credit-card-news/c ... ations-1282.php - it says:
The statute of limitations in NC on written contracts or open-ended, revolving credit accounts such as credit card agreements is 3-years. Most state laws and codes do not refer specifically to "credit cards" or "credit card agreements." Instead, the statutes may use the general terms "written contracts" or "open accounts." State laws are subject to change. Court decisions regarding limitations on the right to file suit may alter state laws; those rulings may then be overturned. The chart is current as of March 22, 2013. Write to Editors@CreditCards.com to report updates or corrections.
