You never get a heads up that you'll be served. If a legitimate company was going to sue you, you would have received dunning letters for some time - which would be your cue to demand a debt validation letter showing original creditor, amount owed, date of loan and date of last payment. This DVL would also show if the caller has the legal right to collect said debt. Only after sending all these letters, calling you, and the situation not being resolved, would the caller then move forward with legal action.
Bottom line - NEVER pay anyone who refuses to MAIL - not email or fax - proof that you owe a debt and proof that they can legally collect said debt. Per the FDCPA (Fair Debt Collection Practices Act), any caller who refuses to mail this legally mandated documentation is owed nothing. Report the caller to the FTC, FBI, Dept of Justice and your state's Attorney General.

do not pay them one red cent they will try to do everything in their power to scare you they did the same thing to me I talked to a bankruptcy attorney and they told me that if it was real they would actually send out paperwork or some one would really show up with legal paper work.most likely a scam.don't fall for it.

I just received the same call today scared me I called a guy answered he said that if i paid 800.00 they will drop the law suit against me to give him a credit card. I am scared and I dont know what to do is this real or fake. They said something about a Paywiz I have no clue what or who that is.. help.. I am a single mom and I can't afford anything like this should I contact my union lawye?

What court (type & location) and what was the docket number? How was your summons issued? You can not be taken to court without some sort of summons.

I GOT SUED BY THIS OFFICE TOO AND IT WAS FOR THE SAME THING, AN OLD LOAN THAT I COMPLETE FORGOT ABOUT, I WOULD HAVE TAKEN CARE OF IT IF SOMEONE HAD CALLED ME INSTEAD OF JUST TAKING ME TO COURT

I received a restricted call but they left a message from Brian Reed working as a serving processor from Los Angeles County and needed to serve me court documents today at home, between 5-6 and have a witness and ID. And that if he missed me at home he would see me at my work tomorrow. I could cal this info on the documents if I wanted to find out whats going on: Martin and Associates 954-417-3633.
I called but line just rings & hangs up. . .Bogus!
