Anyone have an update on the March 2010 lawsuit filed against Timeshares Only and how those of us who've sent them money can get in on the lawsuit?

"Linda Martin" called to say it was "Extremely Important that you call me immediately at 206-260-1122 regarding your time share". I'm on the do not call list. When I returned the call, just got a beep and silence.

my elderly mother received a call from 1122 and they told her they would take her time share off of her hands for $2900.00.  (Not sell it - just take it off of her hands and trade it back to the original company)  What does she get for her time share?  Less $2900.00.  They told her she could put it on her credit card and pay interest.

I'm also Worldmark/Wyndham and have been plagued by these resellers over the past 2 months, sometimes receiving up to 4 calls in a day. I keep asking them to remove my name from the list. I'm quite unhappy about this. I've never listed my points. If it's not Wyndham calling, it's the resellers. No regard for DNC registry. =(

Is Wyndham Vacation owners are hit?
If so... tell Wyndham not to publish our numbers!!!

I get so many calls... remind them that they are calling my cell and DNC number... persistent... so hang up... few days later they call again...

The number is a fake... Phone companies, including cell companies should be able to BLOCK those fake numbers... get a better tech on work to just do it for all of us... Thanks

Received call on my home phone from this number (206-260-1122) on 2009.12.28 @ 18:06 US Eastern time. Male caller with distinct foreign accent, wanted to know if I was interested in selling a timeshare. I TRIED to cut him off at that point by saying the answer is NO and my number is on both Federal and State do not call lists & please add me to your do not call list. This did not slow him down at all except to make him say they didn't care about do not call lists, & he was still yapping when I hung up. I will report to FTC. (If this had been on my mobile phone it would have been added to my junk caller list which has the ring tone set to "none".)

Call received at 6:45PM on 01/05 - did not answer the call and no message left.  The same name of Tarsem has appeared before in the past two weeks with no message left.  In the past two weeks two separate calls from "Time Share" companies have been received (Florida & Texas) offering to buy a time share which I do not have for sale.  The offers, not specified, required up front either $1,200 or $2,000 to handle the transaction.  Advised the callers not interested and to take me off the calling list.  Followed up via google to check the companies out as well as call the BBB in each of the two states and many complaints against both. Definitely beware of these types of scam calls.

The person rattled off the company name as MGM Universal Timeshares. When I asked him to repeat this it was just Universal Timeshares. Asked if he worked for Wyndham he did not. Says he wants to buy my timeshare. I mentioned that my number is on the National Do Not Call list he said he didn't care. I asked to speak to a supervisor but he would not allow me to do that. Said I would report this call and he said "go ahead I don't care what you do". Then he belligerent and went on to say he was going to call me every day to show me he can call anybody and no list is going to stop him.

I just received a call from someone named Linda Martin. I didn't call back, nor do I intend to. She says it is about my timeshare and I need to call her back immediately. Definitely sounds like a scam. I do own a timeshare, but when they call, they at least identify themselves as being from the timeshare I own.

Just received a call from Universay Financial Group - 8665 W Flamingo, Las Vegas -- Suite 2022-2023
Claims to be affiliated with MGM and MGM Universal Timeshares -- wants to sell my timeshare for way more than I think they can get and also wants $1798 up front for "lawyer fees" - promised a check for
$2500 "rental fee" within 4 weeks of listing  -- says they work through II and RCI ---

When it sounds too good to be true -- it is!!!  Glad I checked them out!!  He also told me they were the finance  company for the mortgages on the timeshare sales..

I got a call from this number, person representing himself as Tony Rivera from "Universal."  I asked universal what, and he could not answer.  Stated he wanted to try and sell my timeshare.  I have gotten calls before from them and know from my last owner update meeting that these are all scams, they want your money up front and never sell or call you back.  I got a little nasty with him (havin a rough day i guess) and said this is a scam, i am on the national do not call registry, do not ever call me back.  I also said I know you are not affiliated with Wyndham and that you got this info from the registrar of deeds office.  He insisted it was not a scam, but then would not give me his address.  I also reported this to consumer protection with Attorney General's office.  It makes me so angry to read that so many vulnerable people have been swindeled out of thousands of dollars.

Florida Cracks Down on Timeshare Resale Industry
2009 was record-breaking year for consumer recoveries

By James Limbach
ConsumerAffairs.com

March 15, 2010
Florida Attorney General Bill McCollum continues to go after those in the timeshare resale industry who engage in questionable and - in some cases - fraudulent practices.

Among the actions is what the AG's office calls "a significant settlement that could yield as much as $1.3 million in consumer refunds" and the filing of a lawsuit against a major player in the state's timeshare resale industry.

McCollum also unveiled ongoing investigations into at least 17 timeshare companies and their affiliates throughout the state for deceptive trade practices.

"Florida's consumers are trying to make prudent financial decisions," the attorney general noted, "but many timeshare resale companies are blatantly scamming people by promising sales or refunds and failing to provide services even after taking hefty up-front fees."

Timeshare resale complaints have recently surpassed mortgage-related complaints as the most commonly reported consumer complaint received by the office's Consumer Hotline.

ConsumerAffairs.com has received a sizable number of complaints about the practices of timeshare sellers from consumers across the nation.

"In September of 2007 I paid Timeshares Only almost $600 to list my timeshare which was to be a one time fee and they would run the ad until it sold," says Shannon of Harrisburg, NC. "Well, I have not had one call regarding an offer for my timeshare although I have reduced the price a few times. I also decided to check the ad myself on the web site and could not find it. When I contacted them to ask why they told me I had to periodically 'reactivate it'. If I paid you a fee and you agreed to run the ad until it sold, I should not have to call and reactivate it! This business is a complete SCAM!"

"I was told by timeshares only they guaranteed to sell my timeshare or rent it," John from Baltimore writes ConsumerAffairs.com. "Well it's been over three years since they took my money and still not one call to sell or even rent. I was also promised that they would refund my money if I sold it before they did. Well I did sell it and still no refund either."

The lawsuit filed in Florida against Resales Buy Owner.com, Inc. contends the company engaged in a systematic pattern of deception that improperly induced consumers to pay up-front fees for timeshare resale services that were never provided.

According to consumer complaints, the company would indicate it either had a buyer or renter interested in the timeshare and that there would be no problem renting or selling the timeshare within 90 to 120 days. The lawsuit maintains the company merely advertised the property listings, if taking any action at all, and allegedly charged consumers' credit cards even after consumers opted not to do business with the company. The lawsuit seeks an order prohibiting the company from engaging in further deceptive conduct and seeks full restitution on behalf of victimized consumers, civil penalties and reimbursement for fees and costs.

McCollum's Office also announced a significant settlement with Virtual Group, Inc., resolving allegations the company failed to provide promised refunds to consumers. Virtual Group, which does business under the name Realty Trade, offered timeshare resale and rental advertising services to consumers looking to sell or lease their timeshare properties.

As a result of the investigation, Realty Trade has already paid over $800,000 in refunds to 799 consumers. The company will also make another $500,000 available to consumers who make new refund requests.

In addition to the litigation and the settlement announced today, in recent months, the Attorney General's Office has subpoenaed 17 timeshare resale companies and their affiliates over allegations of potentially deceptive business practices.

Common complaints about these companies involve the use of false and deceptive claims to entice consumers to pay up-front fees, including assertions that buyers are allegedly ready and willing to buy or rent the consumers' timeshare.

Companies also often allegedly fail to honor cancellation policies, misrepresent the actual services that will be provided to consumers, and fail to comply with elements of state and federal telemarketing acts.

The initiative was launched in 2009 in response to the growing number of timeshare resale complaints received by the Attorney General's Office.

On Feb. 5, 2010 at 6:00pmET I received a call from 206-260-1122 regarding my Sheraton timeshare and he did know the Sheraton phase that I own in. The person said that he was with MGM Universal Timeshares and he had a buyer for my timeshare and asked if I was interested in selling it. He said he used to sell the timeshares and knows the presentation takes more than 90 minutes. He must have stolen the owner names and/or phone numbers directly from the Sheraton database as I don't know how he got our phone number. I asked how the sale would work and he said it would cost me $1,700+ so I said I was not interested and hung up. I didn't give him time to get ask for other information.

I spoke with a man from this number just minutes ago.  The same scenario for me saying he would have to talk with his manager and then comes back with an offer to good to be true. Then saying all I would be responsible to pay is the $1798 up front before any transaction is started.  This has the feel of a very large scam waiting to happen.

I spoke with Jack Zirrilla of MGM Universal time shares.  His buyer (a family) "offered" me more than I paid for HGVC.  He wants $1798. via check or credit card now.  When I asked why do I not pay that upon closing he said no... they don't do it that way.  When I asked the purchasers name he hesitantly said Mr. Rogers.  Phone is 818 766 8899. (a California Number) but the office was Vegas.  This whole thing stinks to high heaven and I told him so.
