I just finished formally filing a complaint and got the confirmation and case number from the FCC. Funny enough though, the faxes stopped about 3 weeks ago when I called Fire Mountain Beverage Company's so called company representatives and yelled at them on their voice mail. I would sadistically read back the add to them and tell them what a crock it was and that I knew they were the ones behind the scam. If you ever call Fire Mountain's phone system you can tell it's cheap and fake. It always rolls over into voice mail and their fax number rings forever and never gets picked up. It's a shell company. It exists only on paper and a web site. I have never bought any BS drink from these have you? I bet you don't even know anyone who even sells or buys the drink either huh?

Don't buy the bull, it is Fire Mountain Beverage doing it under their BS alias Stock Watch which is conveniently named after an actual company called Stock Watch who is completely denying all of it. This is a classic penny stock scam. A couple of con men either create a fake company and then throw some 5 cent valued stock out and then tout it everywhere in cheap mags and ads especially junk faxing which costs them like nothing. Then they see if any fools jump and buy the cheap stock enough to artifically inflate the value and then they dump the stock for a higher cost even though the company itself is really worthless. Google penny stock scam and see for yourself. Check out www.junkfax.org and get that wider area opt out number from them. It really did get rid of the majority of the junk faxing and never back down from calling any numbers you find on the paper or on the internet and anonymously yell at them or insult them about their business using junk fax. I like to say how stupid their company is to the call center person for wasting other peoples' ink, paper, time and money. And throw out a few expletives and tell them are @#cking crAssholes.

Well unfortunately I filed an official complaint with FCC along with copies of all of the faxes we had received.  I received a letter from them a month later that says "Sorry"  they don't adjudicate individual complaints. They do, however, closely monitor these situations to determine whether independent enforcement is warranted.  I thought the fact that you could not stop the unsolicited faxes warranted action, but apparently not.  FYI, this number 214-377-0512 is also tied to a site called pillsless.com and myfirstpharma.com.  I have been unable to stop these as well!  Our government tax dollars at work folks!!!!!!!

You must be joking. There is no way I would be buying stock from a company that is involved with illegal practices! You are setting yourself up for trouble!

I have my fingers crossed that this is the key to getting them to stop

It is unlikely that the company has anything to do with the unsolicited faxing and or the promotion of the stock.  There are numerous "Back Room" operations that prey on small corporations with "Penny Stock." And look for ways to reach GREEDY investors, looking for that big return!

They will go in and buy a block of the stock, which then would show up on the charts that there is a sudden reason for activity, it might even correspond to an actual event like the small company announcing a big new contract or expansion of the building.  They then use this as a reason to "HYPE" the stock via any means possible-hence, the unsolicited stock.  What they get is a sudden run-up of the stock value and that creates more of a feeding frenzy as people buy into the hype.  The "Back Room" will suddenly sell the stock amidst all of the buying activity and run away taking their profit.  If they can buy $200,000 worth of stock at 1.7 cents a share and run it up to 3.4 (Double) in a couple of days then dump it they have made a nice tidy $200,000.  But they want you to hold on to see that promised "Long term target of $0.25"  They are hopping you are a greedy investor...but the "Back Room" guys will be long gone.

The poor company is left holding the bag as their stock then dives as the bloom wears off the rose when the rest of the investors sell quickly to limit their losses.  Not only have they got a PR problem with the new stockholders, they could also be facing financial ruin or bankruptcy soon.

As in this case, the "Back Room" folks do everything they can to mask their identity.  It is interesting to see them mask the phone number of the FAX to make it appear to be a legit number of the company.  I know I can set the header and phone number of my FAX machine to anything I want.  I dont know if that is the number that is also reported to me on the call received report or not, or if my machine uses an actual caller ID number, which I can also set to block from my FAX when I make the call.  And, as far as them being the source, I believe under SEC rules they would actually be in BIG trouble if they were actually the ones hyping their stock in this manner.  But, no doubt the FAX is always "busy."  If I were Fire Mtn Beverage, I would take my FAX off the hook, too, so I wouldn't keep getting angry messages faxed to me to cease sending FAXES.

I just received this email from "landy" at Fire Mountain Beverage Co:
"We are not really too clear on the specific location of the faxes and I rather not give information that has not been verified. This issue is being investigated and I also have to continue assisting the corporation in our daily business task."

I replied that it would be in their best interest to get them to stop sending the faxes in their name!

Yeah, I've been deluged, too.  I'm sending all my copies to the local office of the NYS Attorney General, and recommend you do the same.  It should be possible for the authorities to track down the owner of that number, even if we can't.
I did a search under the name of the CEO of Fire Mtn. Bev. - his is one name you get when you call the company's number, even though none of the three are identified by title.  That search turned up an official statement from Tony Miller, CEO, saying his company has nothing to do with the unsolicited faxes.  Maybe so, but exactly how much are they doing to stop it?  If you want to read the text of his statement, here's the link:
http://biz.yahoo.com/bw/070502/20070502005938.html?.v=1

I think everybody who gets one of these faxes should send an email to Fire Mountain Beverage telling these spamfaxes really need to be tracked down and stopped.  When they get deluged by emails, they may actually solve the problem that we can't do ourselves.  Fire Mountain's email is info@firemountainbeverage.com

Good luck.
